The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review

Dear Austin:
The copies of the revised site plan, submitted to staff on February 17, 2004, were approved on February 23,
2004. The site plan is approved for the renovation of existing warehouse space into a two-story general
office area. Ten (10) new parking spaces are being provided to accommodate this new use. This expansion
of a nonconforming parking lot is permitted under Section 165-151 B (1). Any future expansion may
require that existing parking areas be improved to meet current design standards of the Frederick County
Zoning Ordinance. This could potentially include adding parking islands at the end of parking bays, curb
and gutter, and landscaping.
I am providing you with three copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the development process.
Once site development is complete, the owner(s) should contact this office to schedule an on -site inspection.

I have revised the Highway Motors Site Plan to address the information in your second
review comments letter dated January 29, 2004. The following is a response to each
comment:
1) The parking lot design has been revised to provide for a 9-foot striped island at
the end of the new parking bay. All new parking spaces are identified to be
striped. Concrete wheel stops are identified for each new parking space in the
new parking bay.
2) Our research of the Frederick County Zoning Ordinance identifies that Section
165-146 Site Plan Contents does not require a note stating that future expansions
and/or modifications shall require that the entire site be brought up to standard
with current Zoning Ordinance design standards. Furthermore, Section 165-151
limits areas of expansion for legally nonconforming uses but does not require site
coil formance for expansions or modifications of legally nonconforming uses.
I-lowever, Section 165-151 is not applicable, as the Highway Motors facility is not
a legally nonconforming use. Doug Toan and I met with Eric Lawrence to
discuss this issue and were informed that this comment was not required.
I have submitted final site plans that meet all requirements of the Frederick County
Zoning Ordinance. Please contact nle when they are approved and ready to be picked up.

Planning Staff has reviewed the revised preliminary site plan for the above -referenced project. This site plan is
denied until the following comments are adequately addressed.
2"`' Review Comments:
1) Parking. Please provide nine -foot wide islands at both ends of the new parking bay. Striped islands would
be acceptable in this situation instead of raised concrete landscaped islands. Please also provide concrete
wheel stops and striping for all parking spaces.
2) Note Regarding Future Expansions. Section 165-151 requires site conformance for expansions or
modifications of legally nonconforming uses. Staff believes that it is appropriate to provide a note on this
site plan to the effect that future expansions and/or modifications shall require that the entire site be brought
up to standard with current Zoning Ordinance design standards. This may include adding curb & gutter,
additional landscaping, raised landscaped parking lot islands, and other site improvements. The purpose of
this note would be for informational purposes to the owner of the property.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the
plan. Once these issues are adequately addressed, the site plan will be ready for approval. I will need at least five
copies of the final plan for final administrative approval. Comment sheets have already been received from the other
relevant review agencies. Please do not hesitate to contact me, if you have any questions or concerns regarding this
letter.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs continents listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Parking Islands. Please provide nine -foot wide islands at both ends of the new parking bay.
2) Surface Material. Please provide asphalt paving for the proposed parking area.
2) Parking Lot Landscaping. Please provide perimeter and interior landscaping for the new
parking. General landscaping calculations must be provided on the site plan. The species, size
and location of all trees and shrubs shall be illustrated on the site plan.
3) Outdoor Storage or Parking. Vehicles in the rear of the building shall be fully screened, as
required for outdoor storage, or parked in an approved parking lot. Parking facilities shall meet
the parking lot requirements of Section 165-27 E. of the Zoning Ordinance.
4) Building Entrances. Please show all building entrances of the facility.
5) Edge of Pavement/Gravel. Please show the extent of the paved/gravel area and ensure that
appropriate width is provided for travel lanes.

6) Existing Sign Location. Please relocate the existing sign to the facility to a location on the
property at least ten feet from property lines and at least three feet from the edge of pavement
or curb. The existing sign appears to be a violation of the Frederick County Zoning Ordinance.
I would suggest that a landscaped area be created adjacent to the sign so the sign could be moved
back from the property line. This would also decrease the amount of on -site impervious area.
7) Note Regarding Future Expansions. Please note that the entire site will need to conform with
current ordinance requirements for any future expansion or modification.
After you have revised the site plan, please resubmit one copy so that I may verify the inforination
contained on the plan. I will need all approved review agency conunent sheets and at least five copies
of the final plan for final administrative approval. Connrient sheets are required from the following
agencies: the Frederick County Inspections Department, the Frederick County Department of Public
TVorks (County Engineer), the Frederick County Fire Marshal, the Frederick County Sanitation
Authority, the Frederick County Airport Authority, the Frederick County Department of GIS, and the
Virginia Department of Transportation.
