Dear Scott:
The above -referenced site plan was administratively approved by staff on August 8, 2002. The site
plan complies with all of the County's requirements for development within the B2 (Business,
General) Zoning District. To be precise, the site plan is approved for the development of an eighty-
six (86) room hotel. The project will be located along Route 522 (Front Royal Pike), directly across
the road from the Route 1367 (Costello Drive) intersection. A summary of the most significant site
improvements associated with this development is listed below:
• Construction of eighty-nine (89) pat -Icing spaces, which includes four handicap spaces. All
parking areas shall have curb and gutter, landscaping, sidewalks, islands, striping, lighting,
and will be appropriately designed to handle stormwater.
• Construction ofa VDOT-approved commercial entrance off ofFront Royal Pike, along with
numerous improvements to the Costello Drive and Front Royal Pike intersection.
• Planting of 252 Azalea shrubs, 20 October Glory maple trees, 19 Shademaster Locust trees,
12 Leyland Cypress trees, and 12 Dark American Arborvitae trees. All plants shall comply
with the caliper, height, and location requirements shown on the approved landscapingplan.
• Construction of a dumpster site_ which includes a concrete dumpster pad with an opaque
fence gate.
• Construction of a retaining wall, which will be located in the rear of the proposed hotel.

We are in receipt of the comments dated April 11, 2002 and offer the following responses:
Comments from Frederick County Department of Ylanning and Development
Comment 1: Lot Consolidation. Staff will not be able to approve the site plait until the two lots have been
consolidated. Prior to final approval of the site plan, you should provide staff with an approved and
recorded copy of the plat for the lot consolidation. I,unherinoi-e, a continent should be provided oil the site
plait to the effect that the two lots will be consolidated prior• to approval. I can not field where you said you
wrote this oil Page 2.
Response: The note on sheet 2 is located just above the 15 parking spaces at the front of the site along
Route 522. A copy of the recorded plat is enclosed with this letter.
Conintent 2: Catekoi-V A Biif ei. Please provide a statement which referenced the approval of' Variance
#21-01, which allows the reduction of the required buffer by 40 feet.
Response: The note has been added to the landscape plan, sheet 6.
Comment 3: Buffer Landscape Screen. As part of the application for the variance to the Category A
buffer, the applicant/owner proposed to plant all evergreen screen in the 10-foot buffer that would renlruri.

Sanitary Sewer
1. The proposed 6-inch lateral must enter the sewer system at a manhole.
Please revise.
2. Please add an arrow to show that the manhole information is for the existing
manhole.
3. The Plans should show all existing sanitary sewer easements.
4. The proposed retaining wall may not be located within the sanitary sewer
easement.
5. Please show the diameter and material of the existing sewers.
6. Please show the existing sanitary sewer profile with the storm sewer profile.

Water
1. Please submit a water system report that shows that the proposed system
will meet the requirement of the City Standards.
2. The existing water pressure must be verified through hydrant testing and
shown to be sufficient to supply 1000 gpm with a minimum of 20 psi in the
main.
3. Please note that 2-1/2 inch services are not permitted. It must be either 2-
inch (copper) or 4-inch (ductile iron).
4. Please note the size of the existing water main.
5. Show a tapping sleeve and valve as the method of connection.
6. The proposed water main material must be Class 52 DIP. The material
should be corrected on both the Plan and Profile for the proposed water
main.
7. The Drawings show a siamese connection on the building. Will the proposed
building have a fire suppression system? If so, the Drawings need to show
the configuration of the domestic and fire suppression services. In addition,
the Drawings need to note that a backflow prevention device (RPZ) is
required. The test results from the RPZ need to be submitted to the City and
an inspector from the Winchester Public Utilities Department should be
contacted to inspect the installation.
8. Show stationing on the Plan to match stationing on the Profile drawing for the
water main.
9. Please remove the note that shows the hydrant as dedicated for the siamese
connection.
General
1. Please show all existing easements for the sanitary sewer and water mains.
Show the deed book and page number for associated easements. Consider
that easements dedicated to the City for sewer and water may not be
encroached upon by storm sewer easements, pipes or structures.
2. Notes on the Cover Sheet should be revised to reflect City of Winchester
requirements rather than FCSA.
3. Utility availability fees are applicable for this project.
4. As -built drawings are required to be submitted to the Winchester Department
of Public Utilities before the waterline shall be approved for use and
activated.
5. Plan preparation standards for the City of Winchester note that the upper half
of the drawing shall show the utility line in plan and the lower half shall show
the utility line in profile along with the existing and proposed final ground
surface. Please revise drawings to conform to this requirement. Stationing
shall be shown on the plan view to match with the profile.
6. Since the water main is proposed to be constructed on fill, please include
information regarding the requirements of controlled fill, submit compaction
results to the Winchester Public Utilities Department.

After review of the Federal Aviation Administration's aeronautical study the Winchester
Regional Airport will not request that the proposed structure be lit with obstruction
lighting, however as outlined in the first paragraph on page two of the FAA's reply,

3. Builder should take extra precautions to ensure proper insulation levels and
be made aware of the airport's existence and forewarned about aircraft noise
and fly -over nuisance from aircraft that may or may not impact their client's
business.

It appears all of our earlier review comments have been satisfactorily addressed.
Please advise the owner of our approval. Also please provide eight (8) sets of
approved construction plans with signed seal for VDOT distribution.
In accordance with previous VDOT comments regarding the approval of this site plan
for its intended use, the developer should provide the following items to VDOT at the
earliest opportunity.
• The estimated cost of $52,000.00 for the material and installation requirements to
modify the existing signal at the proposed intersection of site entrance with Route
522, Front Royal Pike. These monies should be advanced early in order to
implement signal modification in a manner to meet the need for signal to be
operational prior to use of the site entrance by the traveling public.
• An appropriate agreement drawn by the developer between VDOT and Front Royal
Pike L.L.C. to absolve the Department of any maintenance or liability of the
detention basin will be required. This is the developers responsibility. The executed
agreement is needed prior to final approval (construction final inspection) of the
land use permit entrance to the site.

Route 522 right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector. A copy of any/all recorded plats of dedication for drainage easements or
additional right-of-way required for implementation of this proposed project should be
provided to VDOT prior to issuance of any land use permits. Dedication should be
made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately

A VDOT review has been completed on the revised plan dated April 2, 2002 for the
referenced project. Our comments follow.
GENERAL
The elevation database with an approximate difference of about 0.7' remains on the
plan assembly. A note indicating site plan database should be provided.
The old Standard CG-12 has been replaced with CG-12A, 12B or 12C whichever is
appropriate to the condition. In the case of the two located at the Route 522 radii, they
should be CG-12A, please adjust.
A traffic signal modification should be included in the plan notes. A pole should be
shown on the plan at the southeast corner of Costello Drive. The final location of the
pole is to be established by signal contractor/installer.
The signal modification is estimated to be $52,000.00; the cost should be borne by the
developer.

2. The proposed culverts (30" RCP and 36" RCP) should be extended to join each other
and also join with the existing 18" CMP under private entrance at the outlet end of
30" RCP. It also appears desirable to upsize and replace the existing 18" CMP under
private entrance to carry as much of the Garber Lane drainage as possible into the
proposed storm sewer system.
All the above should be joined to each other into an appropriate drainage structure to
meet the condition possibilities. This may be manhole, DI-1, DI-7, DI-12, etc. The
condition appears to meet the criteria for manhole. VDOT would prefer manhole. The
appropriate top should be set to match existing Garber Lane pavement slope. If any
grate type structure is chosen, the grate should be pedestrian accessible.
I understand from the Edinburg Residency Office, the portion of 36" RCP exiting onto
the Route I-81 limited access right-of-way is scheduled to be constructed by VDOT
personnel. However, we alert you to the VDOT policy that no construction activity
whatsoever or entrance onto the limited access is allowed without prior permission by
VDOT.
When all the above comments and all other agreements required by VDOT have been
satisfactorily addressed, please submit two copies of the revised plans to this office for
VDOT review.

I have reviewed the revised site plan for the proposed motel/hotel at the property referenced above.
Please look over my comments listed below and prepare a revision which adequately addresses each
issue. Staffs comments are as follows:
(1) Lot Consolidation. Staff will not be able to approve the site plan until the two lots have been
consolidated. Prior to final approval of the site plan, you should provide staff with an approved
and recorded copy of the plat for the lot consolidation. Furthermore, a comment should be
provided on the site plan to the effect that the two lots will be consolidated prior to approval.
I can not find where you said you wrote this on Page 2.
(2) Category A Buffer. Please provide a statement which referenced the approval of Variance #21-
01, which allows the reduction of the required buffer by 40 feet.
(3) Buffer Landscape Screen. As part of the application for the variance to the Category A buffer,
the applicant/owner proposed to plant an evergreen screen in the 10-foot buffer that would
remain. The exact wording on the application states: "The applicant proposes to provide a
landscape screening buffer of 10' in width and to be in compliance ivith Section 165-37B. (1). "
'Please include this evergreen screen on the site plan.
(4) Height. The maximum height for a motel/hotel building in the B2 Zoning District is 60 feet.
Why have you stated that the maximum height is 40 feet? Please elaborate if there is a reason,
such as, if the FAA only allows a height of 40 feet, and make all necessary notes and changes.

After fiirther review of the proposed site plan, staff has determined that the Frederick County Zoning
Ordinance requires no less than a fifty-(50)- foot distance buffer between Lot 6413-1-4 and 6413-1-1 A.
This must be divided into a twenty- five- (25)- foot inactive buffer and a twenty-five-(25)-foot active
buffer. Section 165-37 D (1) of the Frederick County Zoning Ordinance does not allow a Category
A Buffer to be reduced with the installation of a frill screen or a landscape screen.
Based on the requirements noted above, the proposed hotel location does not satisfy the requirements
of Section 165-37 D (1). In order to satisfy all buffer requirements, you must either provide a
distance buffer of fifty (50) feet or obtain approval of a variance from the Board of Zoning Appeals.
If the latter option is chosen, please consult with staff regarding the appropriate procedure for
applying for such a request.

and have noted that some changes are required before staff can consider final administrative approval.
To assist you, please find the enclosed copy of the site plan with red markings. These markings
should correlate with my comments listed below. Staff s comments are as follows:
Review Comments
(1) Property Identirication Numbers (PINS). The PINs that you have provided are inaccurate.
The subject parcels of land are referenced with PINS 6413-1-4 and 6413-1-5.
(2) Open Space Calculations &Owner's Signature. Please elaborate on how you arrived at the
provided open space calculations. Specifically, are you including both parcels of land in these
calculations? If Lot 5 is included in your open space calculations, and ifthere is not sufficient
open space on the hotel property, you will need to provide the owner's signature of Lot 5 on
the site plan. The County's real estate records indicate that the property is owned by Janet
