SITE PLAN APPLICATION CHECKLIST
The checklist shown below specif es the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Departrment of Planning & Development to determine which review
agencies' are relevant to their site plan application_ A list of potentially relevant

Dear Ms. Schmidt:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staffs comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Conuncnts:
1) Lot Consolidation. A lot consolidation %ill be required before this site plan can be approved.
2) Buffers and Adjoining Properties. The property to the south (Gray) is listed as vacant; this site
is actually residential and requires a Category C buffer.
3) Fence Type. The plan shows a chain link fence with vinyl slats; the County does not permit this
type of fence to be utilized for screening. Revise the areas that require a screening fence to
board -on -board. In some areas a double row of evergreen trees might be more appropriate as
indicated on sheet 6.
4) Building Breakdown. Show the breakdown of the building shown on sheet 1 in the building
footprint on sheet 6.
5) Driving Arrows and Stop Signs. Provide additional driving arrows as indicated.
6) Pavement Details. Provide pavement details for the site.
7) Curb and Gutter. Curb and Gutter (minimum CG-6) needs to be provided as indicated on sheet
6. All parking spaces need to have curb and gutter (minimum CG-6) as well as a sidewalk. The
detail shown on sheet 27 needs to be revised.
8) Storage Area. The rear storage areas needs to be completely enclosed as indicated on sheet 6.
Also, the storage area is permitted to be gravel if preferred.
9) Fueling Area. On sheet 5, show and label the fuel pump.
10) Employee Parking Spaces. The employee spaces are shown as 10' x 30'; it is unclear why the
employees need a 300sf parking space.

1 1) Uses. There are parking areas and a dump station for RV's shown on this plan. The RV parking
areas are very close to the entrance road. Please note that RV parking is not permitted.
12) Building Entrance. Due to the orientation of this building, it is unclear where the main entrance
will be. Please label the main entrance.
13) Loading Areas. Loading areas need to be a minimum of 12' x 45' and be striped.
14) Bays. The coversheet accounts for 24 bays, but on sheet 6 there are more than 24 bays indicated
by the provided symbol.
15) Si2n Data. Sheet 23 states that the freestanding sign for this site will not exceed five feet and
your comments state that five feet would be the minimum. The plan states that, "shall not exceed
five feet in height", which would mean five feet would be the maximum height for the sign. The
plan needs to indicate the actual size of the sign that will be installed on the site.
16) Dumpster Location. On sheet 6 provide the location of the compactor that is shown on sheet
27. A fence needs to be shown around the compactor site (board -on -board).
17) Tree Protection. Your response letter stated that a tree protection fence was provided on the
grading plan; the only fencing shown is the security fencing. Please provide tree protection
fencing as indicated on sheet 5.
18) Site Plan Application. Provide a copy of the site plan application for this development.
After you have revised the site plan, please resubmit two copies so that i may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies of
the final plan for final administrative approval. Comment sheets are required from the following
agencies: the Frederick County Inspections Depariment, the Frederick County Del -ailment of Public
Works (Count)) Engineer), the Frederick County Fire Marshal, the Frecerick County SanitationAulhorio)
and the Virginia Depar-tment of Transportation.

12) Fueling Area. On sheet 5, stripe where the fueling vehicle is supposed to sit.
13) Uses. There are parking areas and a dump station for RV's shown on this plan. RV service areas
are not permitted in the M 1 Zoning District.
14) Parking Areas. The parking areas located adjacent to the loading dock are required to have curb
and gutter, a sidewalk and an island at the end. Also, some of the parking areas are out of place.
The driving areas around the eastern side of the building are very broken up and the 15' x 76'
parking areas near Zachary Ann Lane would necessitate weaving around to get to the eastern side
of the building. A less broken up and confusing parking Configuration needs to be planned for
this site. Also, provide a handicap ramp for the parking area at the front of the building.
15) Customer and Office Parkinj4. Customer and office parking spaces need to be a minimum of
180sf (9'x20') and be close to the office/parts pickup areas. Label the areas intended to serve as
the parking areas for these uses and label the areas intended to serve as employee parking.
16) Loadiniz Docks. The site shows loading docks but no loading spaces. The docks are also shown
adjacent to customer parking areas and could be dangerous. Locations for the three 12' x 45'
loading spaces required need to be shown and striped along with separate, safer locations for
loading.
17) Bays. Label the location of all the bay doors.
18) Dumpster Location. Provide a dumpster area for the site along with a detail.
19) Sign Data. Sheet 23 states that the freestanding sign for this site will not exceed five feet. Please
verify if that is the height the business desires.
20) Island Trees. On sheet 23, center the island trees as indicated.
21) Tree Numbers. The site requires a total of 149 deciduous trees. The plant list states that 149 are
provided and the site plan only shows 144.
22) Tree Type. On sheet 23 under the plant list, White Pine should be removed.
23) Tree Save Areas. On the grading plans and the site plan, show silt fences around the entire tree
save area to ensue they are not accidentally removed during land disturbance.
24) ScreeninjZ Trees. On sheet 23, provide additional screening trees as indicated.
After you have revised the site plan, please resubmit two copies so that i may verify the information

Upon review of the subject site plan, we offer the follo.vi,,g comments:
Your plan indicates a slope within the storill vvatcr pond of less tllan one (1) percent. The
county requires the slope in stormwater ponds as well as all drainage channels to be a
minimum slope oft percent to eliminate the likelihood ofstamling water, insect issues as
well as the growth of cat tails and other wetland plants. We are aware that the pond has
been designed as a BIv11' which is not required by the county; hog-vever, it would improve
the water quality runoff from the large parking area. Ifa two percent slope is
unachievable, it will be necessary for the owners to submit a letter which acknowledges
the consequences of installing the pone( will, a flat slope as well as their responsibility for
maintaining the pond in accordance with the speci f,cations reflected on Sheet 26 of 28.
It will be necessary to ensure positive drainage in the corner of the parking area which
drains to structure 25.
The plan indicates a diesel fueling area adjacent to a proposed store, sewer opening. The
placement of the storm sewer opening in this area creates a potential problem in the event
that a fuel spill would occur as it could drain directly into the storm sewer system. It will
be necessary to ensure that this site plan design is in compliance with all of the necessary
state and federal regulations. In addition, it will be necessary to ensure that the owners
are aware of this potential problem.
4. The plan indicates a one (1) percent slope within the clitcl, located upstrean, ofthe twin
36 inch RCP culvert. If the two percent slope required by the county is unachievable, it
Will be necessary to provide a concrete trickle ditch or a french drain to ensure positive
drainage.

x A preconstruction conference be held by the engineer and/or developer with the attendance of the
contractor, various County agencies and VDOT prior to initiation of work.
Materials used and method of construction shall apply to current observed VDOT Road & Bridge
Specifications applicable during construction of this development.
n Our review and comments are general in nature. Should conditions in the field exist such that
additional measures are warranted, such measures shall be completed to the satisfaction of the
Department prior to inclusion into the Secondary Road System.
x Attached is a copy of the minimum requirements and information needed prior to acceptance of
subdivision streets into the Secondary System. This is the responsibility of the developer.
All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any undetermined length of
time. VDOT will also require 48 hours notice for inspections.
x The appropriate land use permits shall be obtained before any work is performed on the State's
right-of-way. The permit is issued by this office and will require a minimum processing fee, surety
bond coverage, and the salary & expenses of a State assigned Inspector.
Any entrances constructed from the referenced street(s) shall meet VDOT minimum standards. This
is the developer's responsibility.
Any signs to be installed will be in accordance with the Manual on Uniform Traffic Control Devices
(MUTCD) and the approved plans.

l I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled
completely with C.R. Type I 21-B Stone. This will greatly reduce the possibility of any pavement
settlement.
A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior to issuance
of any land use permit. Dedication should be made to the Coin monwealth of Virginia.

The above -referenced site plan was approved on September 18, 2006. The site plan is
approved for the construction of a 94,005 square foot Alban Tractor facility on Zachary
Ann Lane, in the Stonewall Magisterial District. Required site improvements include the
following:
• Construction of a parking lot with 233 (employee, customer, display) spaces
(including six handicap accessible), including curb and gutter, landscaping,
sidewalks, striping, and handicap access.

I offer the following additional comments:
A preconstruction conference be held by the engineer and/or developer with the attendance of the
contractor, various County agencies and VDOT prior to initiation of work.
Materials used and method of construction shall apply to current observed VDOT Road & Bridge
Specifications applicable during construction of this development.
Our review and comments are general in nature. Should conditions in the field exist such that

additional measures are warranted, such measures shall be completed to the satisfaction of the
Department prior to inclusion into the Secondary Road System.
Attached is a copy of the minimum requirements and information needed prior to acceptance of
subdivision streets into the Secondary System. This is the responsibility of the developer.
All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any undetermined length of
time. VDOT will also require 48 hours notice for inspections.
The appropriate land use permits shall be obtained before any work is performed on the State's
right-of-way. The permit is issued by this office and will require a minimum processing fee, surety
bond coverage, and the salary & expenses of a State assigned Inspector.
Any entrances constructed from the referenced street(s) shall meet VDOT minimum standards. This
is the developer's responsibility.
Any signs to be installed will be in accordance with the Manual on Uniform Traffic Control Devices
(MUTCD) and the approved plans.
I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled
completely with C.R. Type 121-B Stone. This will greatly reduce the possibility of any pavement
settlement.
A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior to issuance
of any land use permit. Dedication should be made to the Commonwealth of Virginia.
A copy of any/all RECORDED PLATS of dedication to public use (the County of Prederick) for
drainage easements or additional right-of-way required for implementation of this proposed project
should be provided for VDOT review prior to Issuance of any land use permit.

In response to the comments dated June 27, 2006, regarding the above Referenced project, we
offer the following:
1. Comment: Lot Consolidation — A lot consolidation will be required before this
site plan can be approved.
Response: We have met with Mark Clicrran to finalize the consolidation plat.
2. Comment: Buffers and Adjoining Properties — The property to the south
(Gray) is listed as vacant; this site is actually residential and
requires a Category C buffer.
Response: The lot use and buffer have been revised. {See sheets 4 & 51

3. Comment: Fence Type — The plan shows a chain link fence with vinyl slats;
The County does not permit this type offence to be utilized for
screening. Revise the areas that require a screening fence to board -
on -board. In so►ne areas a double row of evergreen trees might be
more appropriate as indicated on slieet 6.
Response:
The fencing specified is to serve as a security fence and it not meant for
screening. The vinyl clad chain link fence is a chain link fabric which is
vinyl coated. The vinyl coating will likely be green or black. This
fence does not include any vinyl slats. The "Vinyl Clad Chain Link
Fence" detail on sheet 27 has been revised to better describe this type of
fencing. In addition, note 3 has been added to this detail to specify that
slats shall not be Used. The fence 1'C111a111S for SCCLlrlty pLlrposCs, with a
double row of evergreens specified on the landscape plan for screening
purposes. A note has been added to sheets 5 & 6 which states that
proposed landscaping can be found on sheet 23. {Sce sheets 5, 6, 23 &

4. Comment:
Building Breakdown — Show the breakdown of the building shown
on sheet 1 in the building footprint on sheet 6.
Response:
The building breakdown information has been copied to sheet 6.
5. Comment:
DriyiIig Arrows and Stop Signs— Provide additioIlal driving arrows
as indicated.
Response:
Additional driving arrows have been provided on sheet 6.
6. Comment: Pavement Details — Provide pavement details for the site.
Response: The pavement details (typical sections) are provided on sheets 11 and
27. The hatch legend on sheets 3-8 has been revised to note where these
typical sections can be found. {See sheets 3-8, 11 & 271
7. Comment: Curb and Gutter— Curb and Gutter (minimum CG-6) needs to be
provided as indicated on slieet 6. All parking spaces need to have
curb and gutter (minimum CG-6) as well as a sidewalk. The detail
shown on slieet 27 needs to be revised.
Response: Curb and gutter, either CG-6 or CG-6R, has been provided as requested.

8. Comment: Storage Area — The rear storage areas needs to be completely
enclosed as indicated on sheet 6. Also, the storage area is permitted
to be gravel if preferred.
Response: We have informed my client regarding the gravel and they prefer the
concrete. Also, while discussing your request for screening fence in this
area we would like to propose the following. We propose that the fence
in question be chain link with privacy slats and that they would be able
to be easily moved as to not interfere with operations.
Comment: Fueling Area — On sheet 5, show and label the fuel pump.
Response: The fuel pump will be designed by others. The fucl pump location has
been labeled where the underground diesel fuel tank is located. {See
sheet 51
10. Comment: Emplovee Parking Spaces — The employee spaces are shown as
I O'x30'; it is unclear why the employees need a 300sf parking space.
Response: The 10'x30' employee parking spaces are for employees who have
service vehicles. These spaces have been labeled as reserved for
employees with service vehicles.
11. Comment: Uses — There are parking areas and a dump station for RV's shown
on this plan. The RV parking areas are very close to the entrance
road. Please note that RV parking is not permitted.
Response: The RV parking areas have been labeled as "After Hours Service
Parking". The purpose of these spaces is for vehicles scheduled for
service which need to be dropped off after business hours. These spaces
are not intended for overnight camping purposes. The RV dump station
allows for emptying of RV waste tanks prior to servicing of the RVs.

12. Comment: Building Entrance — Due to the orientation of this building, it is
unclear where the main entrance will be. Please label the main
entrance.
Response: The main entrance has been labeled on the east side of the bUllding,
which faces Interstate-81. {See sheet 61

13. Comment: Loading Areas — Loading areas need to be a minimum of 12'x45'
and be striped.
Response: The two loading spaces located under the covered ramp have been
striped and will be 15'x62' each. One additional 12'x50' loading space
is located at the after hours service parking. {See sheet 6)
14. Comment: Bays — The coversheet accounts for 24 bays, but on sheet 6 there are
more than 24 bays indicated by the provided symbol.
Response: Not all of the overhead doors denote service bay locations. Some of the
service bays are also drive-thru service bays and span the entire width of
the building. Therefore, in some cases two overhead cloors on opposite
sides of the building represent one service bay. Some of the overhead
doors do not represent service bay locations, but are locations for
unloading and loading. A note has been added to the overhead door
symbol which states that service bays may span the width of the
building. {Sce sheets 5&61
15. Comment: Sign Data — Slieet 23 states that the freestanding sign for this site
will not exceed five feet and your comments state that five feet
would be the minimum. The plan states that, "sliall not exceed five
feet in height", which would mean five feet would be the maximum
height for the sign. The plan needs to indicate the actual size of the
sign that will be installed on the site.
Response: Sheet 23 has been revised to include a pole sign detail. The sign will be
25 feet in height. Note 1 of the Signage Notes has been revised to
specify that the sign shall not exceed 25 feet in licight. {See sheet 231
16. Comment: Dumpster Location — On sheet 6 provide the location of the
compactor that is shown on sheet 27. A fence needs to be shown
around the compactor site (board -on -board).
Response: The dumpster (trash compactor) will not be adjacent to the building, as
the photos show on sheet 27. The location will be in the west side
storage area and the label text has been bolded on sheet 6. Board on
board fencing has been specified around the trash compactor area with a
detail added to sheet 27. {Sec sheets 6 & 271

17. Comment: Tree Protection — Your response letter stated that a tree protection
fence was provided on the grading plan; the only fencing shown is
the security fencing. Please provide tree protection fencing as
indicated on sheet 5.
Response: The 4/27/06 response letter stated that tree protection fence was shown
on the E&S Plan, sheet 20. Tree protection fence is an erosion and
sediment control measure defined in the Virginia Erosion and Sediment
Control Handbook Standard and Specification 3.05. This standard
defines tree protection as "a temporary sediment barrier consisting of a
synthetic filter fabric stretched across and attached to supporting posts
and entrenched". Since tree protection is an erosion and sediment
control measure, we have shown it on sheet 20.
18. Comment: Site Plan Application — Provide a copy of the site plan application
for this development.

Complied. We have added a note to the typical detail. The fence will

Pavement Details — Provide pavement details for the site. Any area of
heavy asphalt need to be shaded differently on the site plan.
Response: This site will be surfaced using concrete and Zachary Ann Lane will be
surfaced with asphalt. We have changed the shading patterns to indicate
the different materials.

storage area has three rows, one double and one single. Two double
parking areas should be provided instead.
Response: We have revised tlic parking as requested. {Sce sheet 5}
/ 12. Comment: Fueling Area — On sheet 5, stripe where the fueling vehicle is supposed
to sit.
Response: We have hatched an area around the fueling station. {See sheet 51
13. Comment: Uses — There are parking areas and a dUlllp StatlOn for RV's shown On
this plan. RV service areas arc not permitted in the M 1 Zoning District.
Response: The location of the sanitary dump is for the purpose of cnlpting the
sewage into a holding tank prior to maintenance of the vehicle. A note
has been added to sheet 4 stating that the RV clump facility is to be used
for the SCrVICIng Of 1I111tS Only. In addition, the contents of the RV dump
facility will be pumped and hauled away to an appropriate treatment
facility as necessary.
Comment: Parking Areas — There are parking area located adjacent to the loading
clock are required to have curb and gutter, a sidewalk and all island at
the end. Also, some of the parking areas are out of place. Tile driving
areas around the eastern side of the building are very broken up and the
15' x 76' parking areas near Zachary Ann Lane would necessitate
weaving around to get to the eastern sick of the builcing. A less broken
up and confusing parking configuration needs to be plarincd for this site.
Also, provldC a handicap ramp for the parking area at the front Of the
building.
Response: Revised and Complied.
15. Comment: Customer and Office Parking — Customer and office parking spaces
heed to be a I11111111111I17 Of 180sf (9'X20') and be close to the office/parts
pickup areas. Label the areas intended to serve as the parking areas for

The flocs arc also shown adjacent to customer parking area and could be
dangerous. Locations for the three 12' x 45' loading spaces required
need to be shown and striped along with separate, safer locations for

Response: The loading spaces are indicated at the covered loading ramp and
hatched single loading space located near the RV parking. {See sheet

Response: We have added a symbol to show the approximate location of all the
bays. The exact size and location of the cloors is referenced to the

Response: This site will be serviced by a trash compactor with detachable storage
container. We have provided images of the intended type and size for

not exceed five feet. Please verify if that is the height the business
desires.

The subject property, identified as White Hall business Park, and more, particularly described as the lands
o,Amed by JCA IV White Hall, LLC. Previously, a portion of Tax Maps 33-((A))-89 and 90 obtained by
friendly boundary line adjustment from Fruit Hill Orchard, LLC and further described by instrument
##050015193. This is adjacent to 3 lots currently owned by JCA W located in the White Hall Business
Park currently zoned M-1. These lots are more particularly identified as Tax Map # 39-((9))-6, 7 & 8.
Transyortation
The applicant hereby proffers to work with VDoT to develop a lane striping plan to improve traffic
conditions at the existing entrance at Rest Church Road and Zachary Ann Lane. Also, the developer
agrees to the following improvements to Zachary Ann Lane:
1) Construct and pave Zachary Ann Lane from, Rest Church Road (Rt.669) to Lot 6 of the White
Hall Business Park. This is to be accomplished according to plans prepared by Ebert and
Associates and approved by VDoT in 1997 to current VDoT standards.
2) Add curb and gutter to the edge of pavement shown on the plans prepared by Ebert &
,Associates from the intersection of Rest Church road to a point to be determined by VDoT to
help discourage truck parking and not require the addition of storm drain structures.
3) . Place No Parking signs along both sides of Zachary Ann Lane from the entrance on Rest
Church Road south to the end of the 4acent property currently owned by Flying J.
These improvements shall be impien�ented priar_to issuance of occupancy of the proposed facility.
Water and Sanitary Scorer
The Applicant hereby proffers to ex -tend .public water and sewer services from a point on the eastern side
of interstate 81 near. Duncan run to their area of development, These services have been designed by
Urban Engineering and approved by the Frederick County Sanitation Authority.
Landscaping and Tree Preservation
The Applicant agrees to continue the 50' buffer previously shown on Lot 8 of the Preliminary Master
Development plan prepared for the White Hall Business Park along the southern 50' of -the property to be
rezoned. In addition the applicant agrees to leave an additional tree buffer along lot 8 abutting Interstate
81. This buffer would be a minimum of five feet to a maximum of twenty feet wide. The actual width
will be determined during final engineering of the site so as to obtain a 3:1 slope and withdut the use of
retaining walls to allow maximum utilization of storage area_
Monetary Contributive to Offset Impact of Development
The Applicant herby proffers thatin the event rezoning application # 014-05'is approved, the applicant or
