application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).

Dear Mr. Fletcher:
In accordance with your request dated October 25, 2005 you are given permission to install a temporary construction
entrance at the referenced location. This letter is to be considered your pernut to do so. The following provisions
will be required:
• Work area protection signage is to be in accordance with the current Work Area Protection Manual while
working on the right-of-way.
• All Work on the right -of -Way is to be confined to the tempormy entrance location only. A land use permit
Will need to be applied for and issued prior to any additional Work on the right -of -Way. This permit requires
a fee and surety bond coverage.
• A minimum 6" depth of VDOT 111 (2-3 inch stone) at a minimum width of 12' is to be placed from the edge of
pavement and extended a minimum of 70' with a filter fabric underliner.
• All materials spilled, dropped, washed or tracked from vehicles onto the roadway or into storm drains must be
removed immediately.
• Positive drainage is to be maintained within the right-of-way at all times.
• A wash rack will be required.
• A 30'x15" culvert will be required.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this entrance will be
repaired by you to our satisfaction.
• This pernut is being issued for 180 days.
• All work is to be completed in accordance with the enclosed Virginia Erosion & Serlin:ent Control Handbook,
Specification 3.02.
• The enhance is to be installed at the location shown on the site plan prepared by PHR&A, pc dated March 9,
2005.
The Department of Transportation will not be held liable for suit should such result from this operation nor is it
granting permssion to grade on the property of others or disturb underground utility lines. If the above listed items
are not followed this permit may be revoked.

We've revised the plans per your comments of IS April. Needless to say we were
surprised to receive your letter as we had been told the plans were ready for
approval. The changes are:
1. We've added an island with a fence and landscaping to screen the storage
area from die right-of-way.

landscaping.
3. Additional trees and a detail of the new island have been added.
As I've indicated over die phone, we disagree with your interpretation of the tree
requirement. You are citing paragraph 165-27.1-LI1 which clearly pertains to parking
lots. Subsection (a) requires perimeter trees biked on an area of Impervious parking
lot. There is no mention of storage areas in this "landscaping" section of the
ordinance. Neither is there any mention of landscaping requirements in the outdoor
storage paragraph 165-33. While the County may in the past have interpreted para
" 165-27.r.11.a to apply to any impervious surface, a reasonable reading of the
ordinance would show that this is clearly a parking lot requirement.

The above -referenced site plan was approved on April 27, 2005. The site plan is approved for
the construction of a new contractor yard located on Aviation Drive. The site consists of a 960
square foot office and an 80,722 square foot outdoor storage area. Required site improvements
include the following:
Construction of a parking lot with four spaces (including one handicap accessible),
including curb and gutter, a sidewalk, striping, and handicap access.
Construction of a dumpster pad with a six (6) foot wooden fence for screening.
A six foot board -on -board fence to screen the outdoor storage area, and an island located
at the entrance with a fence and two trees to screen the storage area from Aviation Drive.
I am providing you with four (4) copies of the approved site plan. Please forward these copies to
the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept
for future reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions

Staff is in receipt of the site plan for the above -referenced project, accepted on January 12, 2005. At
this time, the site plan is denied until the following comments are adequately addressed.
Review Comments
1) Landscaping Requirements. On Sheet 2 of 4 under the project summary, the required
perimeter landscaping is shown as being three trees. The impervious area also includes gravel
areas in addition to pavement. There is 80,722 square feet of gravel area; this would equate to
40 trees for the gravel storage area alone. The landscaping requirements need to be revised to
show the additional impervious area as well as the site plan revised to reflect the location of
the trees.
2) Landscaping Notes. Provide a statement on Sheet 2 of 4 which states that all plantings shall
conform with §165-3613 of the Frederick County Zoning Ordinance and that all plant
substitutions must be approved by the Frederick County Planning Department.
3) Outdoor Storage Area. The outdoor storage area needs to have screening around each side.
The section by the parking area needs to be screened and include a gate for access, as I have
noted on the site plan.
4) Dumpster Screening. The dumpster area is being screened by a single row of cypress trees.
The trees are shown as 48" (four feet) at time of planting; these trees need to be six feet (72")
at time of planting.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five
copies of the final plan for approval. Comment sheets are required from the following agencies: the
Frederick County Deparhnent of Building Inspections, the Frederick County Fire Marshal, the
Frederick County Engineer, the Air l.?ort Authority, and the Virginia Deparhnent of Transportation.

Dear Mr. Mislowsky:
Staff is in receipt of the site plan for the above -referenced project, accepted on January 12, 2005.
At this time, the site plan is denied until the following comments are adequately addressed.
Review Comments
1) Dumpster Screening- Your plan indicates that the required six foot opaque fencing ends
at the edge of the dumpster pad and utilizes what appears to be five Leland Cypress trees
to screen the dumpster. Please indicate what type of trees are being used for the dumpster
screen, as well as place one more in the gap between the dumpster pad and the edge of the
proposed office building as indicated on the attached plan.
2) Notes- Please change the words "Shenandoah County" to Frederick County in number 4
of the Notes section located on sheet 2 of 4.
Once you have adequately addressed all of these comments, please resubmit a copy, which
includes the seal of a licensed .engineer, for my re -review. I will need all approved review
agency comment sheets and at least five copies of the final plan for approval. Comment sheets
are required from the following agencies: the Frederick County Department of Building
Inspections, the Frederick County Fire Marshal, the Frederick County Engineer, the—Fr�k
and the Virginia Department of Transportation. Feel free to contact

Memorandum
We've prepared plans for a new contractor yard at lot 4 in the Airport Business Center. This site is at the end of
the Cessna Drive cul-de-sac.
A standard VDOT commercial entrance is proposed. A small office building will be installed, but most of the
site will serve as a contractor storage yard. Adequate screening to provided water and sewer service is proposed.
A fire hydrant exists at the end of the cul-de-sac.
The erosion and sediment control measures are also provided. In order to mitigate increased flows from the site
a detention pond is provided. The Erosion and Sediment Control Narrative with stormwater calculations is also
enclosed. The calculations demonstrate the detention pond is adequate should the contractor yard ever be
paved. It is the intent of the plan however to provide only a gravel surface in the storage area.
Two sets of plans are enclosed for your review.
