In your letter, you stated that you believed Sections 165-145G, 165-146C (29) and 165-147 of the Frederick County Zoning Ordinance have been satisfied in regard to this property. Section 165-145G requires that any site plan shall expire within five (5) years after approval. This property has a site plan that was approved on May 6, 1994 and, therefore, this plan is vested for all the improvements. In accordance with Section 165-147, any changes, new additions or improvements to this site will require a new site plan. On December 21, 2004, Mark Cheran and I had a meeting with Patton Harris Rust representative Christopher Molui to discuss the letter you wrote this office dated December 8, 2004. In this meeting, Mr. Cheran outlined several issues the county would require in order to approve the site plan for Shenandoah Building Supply. While several of these issues have been resolved in your most current submission, two requirements have yet to'be met. At this time, the site plan is denied until the following comments are adequately addressed. Review Comments 1) Screening for Parking Areas: Screening needs to be provided along the existing parking area abutting parcel #43-19-50, per section 165-27 E(11)a of the Frederick County Zoning Ordinance. 2) Space Demarcation: Each parking space, in both the existing and new parking areas shall be marked by durable painted lines or curbs extending the length of the space, per section 165-27 E(2) of the Frederick County Zoning Ordinance. Once you have adequately addressed all of these comments, please resubmit a copy for my re - review. I will need all approved review agency continent sheets and at least five copies of the final plan for approval. Comment sheets are required from the following agencies: the Frederick County Department of Building Inspections, the Frederick County Fire Marshal, the Frederick County Engineer, the Frederick County Health Department, and the Virginia Department of Transportation. Kent Street Winchester, VA 22601 RE: Shenandoah Building Supply Dear Marls, A few weeks ago we subnnitted plans for improvements to the Shenandoah Building P1L 1- ll Supply site on Lenoir Drive in the Stonewall Industrial Parr. Shenandoah Building HSupply has been a valuable member of the Frederick County business community for many years. The operation on Lenoir Drive is in compliance with a site plan approved by the County in 1994. The current operation consists of 14,800 sq. ft. of office/storage/sales buildings and approximately 70,000 sq. ft. outdoor storage. The proposal would add additional covered storage to the site increasing the building area ,, OFFICES to 29,200 sq. ft. but decreasing the outdoor storage area to 58,400 sq. ft. No change to the parking area, existing building or remaining existing storage is planned. As this building expansion is over 5,000 sq. ft. and more than a 20% expansion to the building area, we filed the plan as a major site plan. Regardless, this is a revised site plan. I 5--oc- Mr. Beniamino has responded indicating that due to the size of the addition, the parking lot landscaping and outdoor storage screening will need to be improved to meet the current ordinance requirements. Specifically, he has justified his position by citing Section 165-146.C.(29) relating to expirations of site plans as well as Section 165-147, which requires site plans to meet ordinance requirements. As I've indicated M-,;,U,ND OFFICES to Mr. Benianniio, we disagree with his interpretation of the ordinance. Tine expiration note referred to in Section 165-146.C.(29) references the vesting provision of Section 165-145.G., which stipulates that a site plan approval shall expire within five }'cars of the approval date "runless building permits have been obtained for construction." Building pern-rits were obtained for construction WEST Vt;CINIA pursuant to the approved site plan, and all improvements were implemented OFFICE accordingly. As such, the approved site plan remains valid, and the property owner is vested in the improvements outlined by the approved plan, The Zoning Ordinance does not state or otherwise imply that a properly owner must sacrifice the 5`11) `,e'' ;' 3`' validity of an approved site plan or any of its parts to enable its revision. It is important to reiterate that this site plan revision simply provides for an addition that 0 0 will enclose an e. isting area Of outdoor storage. This proposal does not intensify the use of the site in any measurable way, as the area covered by the addition will continue to be used for storage. We lulow of no ordinance requirement that would empower the Zoning Adi inistrator or his designee to compel the retroactive improvement of areas vested under an approved site plan simply due to a proposed revision. The scope of review of the Shenandoah Building Supply site should therefore be hnu'ted only to the area associated with the proposed addition. Perimeter landscaping needs to consist of one tree for every 2,000 square feet of impervious area up to the first 100,000 square feet, and then one tree for every 5,000 square feet thereafter. A tlu-ee-foot high evergreen hedge needs to be placed on all parking areas that face public rights -of -ways and adjoining properties to prevent headlight glare. In addition, a minimum of 5% of the interior of parking lots must be 1 landscaped according to the aforementioned sections. Once you have adequately addressed all of these comments, please resubmit a copy, which includes the seal of a licensed engineer, for my re -review. I will need all approved review agency comment sheets and at least five copies of the final plan for approval.
