Unfortunately you will need to meet the full requirements of the ordinance and building code for this addition, even though you may have intentions to remove the structure in the future. The ordinance dealing with temporary trailers as a part of a larger construction project is found in section 165-45(AO of the Ordinance (see below). Since there is no open permit for construction on the site this section doesn't apply. § 165-45. Temporary trailers. A. Temporary trailers shall be allowed as a part of construction projects. However, they shall not be used for residential purposes. In addition, temporary trailers shall be removed before a final certificate of occupancy is issued for the use under construction. All such trailers shall meet applicable requirements of the Frederick County Code. In general, the trailers shall remain only where specifically allowed by this chapter and only if all applicable requirements are met. Permits for such trailers will be for a maximum of one (1) year. Applicants for such permits shall furnish on affidavit to the Zoning Administrator, stating that the use shall be limited as required. B. Temporary mobile homes used for residential purposes shall only be allowed in the RA Rural Areas Zoning District. Such temporary mobile homes may be used on a lot where a single-family home is being constructed only if an affidavit is provided to the Zoning Administrator stating that the mobile home will be removed before a final certificate of occupancy is issued for the single-family home. In such cases, a permit shall be obtained for the mobile home and the mobile home shall meet all requirements of the Frederick County Code. Permits for such mobile homes shall be for a maximum of one (1) year. In looking through the approved site plan, I also noticed that the church is currently using a pump and haul system. The site plan states that you will need to hook up to public sewer before the expansion of the church exceed 3,762.5 Square Feet. The proposed 20' by 60' (1,200 square feet) proposed trailer would count towards this threshold, and may affect your ability to construct the phase one portion of the church addition prior to the hook up to public sewer. This is further complicated, as I am sure you are aware, by the fact that the church is not currently within the sewer and water service area. IT may be important to prioritize between the temporary trailer and the phase I church addition. I have attached the information from the site plan for further clarification. The site plan is approved for the construction of a new 3,762.5sf addition (Phase I) to the existing Church of the Nazarene as well as a new two story 800seat sanctuary (Phase 11) located off of Cedar Creek Grade. Phase 11 of the plan (the sanctuary) cannot be constructed until the site is served by public water and sewer. Once the new sanctuary is constructed, the one story church and addition area will not be Utilized as a sanctuary; it will be turned into church offices and Sunday school areas. City Planning Staff have the following comments: Sheet 1: Under General Notes, please revise note 1 to recognize the City of Winchester as the review authority for any Construction in the Public Right -of -Way, as this lots public street frontage is located within the City's corporate limits. Under Project Information, please confirm use of site. Understand proposal is for expansion of a church sanctuary, but the weekday traffic count seems rather high; will educational or other accessory uses take place during the week? Under Project Information, waiver will be needed from the Planning Commission for curbing of portion of driveway in the City, as well as waiver of curbing and sidewalk along Middle Rd. Under Project Information, confirm requirements listed for signage located within the City limits conform to City Zoning Standards. At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Comments: 1. Phasing. Please delineate the portions of the plan that are associated with Phase 1 and the portions that are associated with Phase 2. 2. Future Expansion. State that the new sanctuary will not be allowed to be constructed unless the entire site is serviced by public sewer. 3. Signs. It has been determined that church signs in the RA Zoning District may have signs with a maximum area of 50 square feet. Change the allowed sign area to 50 square feet. 4. Magisterial District. This site is in the Shawnee Magisterial District, not the Back Creek Magisterial District. 5. Easements. Due to increased waste flow, a new pump and haul permit will be needed in order to construct the one story addition to the existing church.
