application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the

Application
APPLICATION is hereby made for permit as shown on the accompvpying plan or sketch and as described below. Said activity(s) will be done under and in
accordance with the rules and regulations of the Commonwealth Transportation Board of Virginia, in so far as said rules are applicable thereto and any agreement between the parties herein
before referred to. Where applicable agreements may be attached and made a part of the pennit assembly including any cost responsibilities covering work under permit. Applicant agrees to
maintain work in a manner as approved upon its completion. Applicant also hereby agrees and is bound and held responsible to the owner for any and all damages to any other installations
already in place as a result of work covered by resulting permit. Applicants to whom permits are issued shall at all times indemnify and save harmless the Commonwealth Transportation

granted in such permit to the extent allowed by law. In consideration of the issuance of a permit the applicant agrees to waive for itself, successors in interest or assigns any entitlements it
may otherwise have or have hereafter under the Uniform Relocation and Assistant Act of 1972 as amended in event the Department or its successor, chooses to exercise its acknowledged
right to demand or cause the removal of any or all fixtures, personality of whatever kind or description that may hereafer be located, should this application be approved.

The Frederick County Department of Planning and Development administratively approved the
above -referenced site plan on January 25, 2005. The site plan is approved for the construction of a
9,931 square foot hotel along Millwood Pike (Route 50 East) in the Shawnee Magisterial District.
Landscaping, screening, buffering, parking, curb & gutter, handicap accessibility, stormwater
management, and other improvements are required for this development as detailed on the approved
site plan. All requirements of the Frederick County Zoning Ordinance have been met in the
approved site plan, including review agency comments from all relevant review agencies.
I am providing you with tlu•ee (3) copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future

We have received your revised site plan dated December 13, 2004 for the referenced project. It appears all of
our earlier review comments have been satisfactorily addressed. Please advise the owner of our approval.
Also please provide five (5) sets of approved construction plans with signed seal for VDOT
distribution.
The site plan is showing CG-6 curb and gutter and your proposed plan is showing CG-7. Please add the CG-7
so there will be no misunderstanding during construction.
The appropriate land use permit may now be applied for to cover work within the Route 50 right-of-way. The
permit is issued by this office and will require a minimum processing fee, surety bond coverage, and the salary
& expenses of a State assigned Inspector. A copy of any/all recorded plats of dedication for drainage
easements or additional right-of-way required for implementation of this proposed project should be provided
to VDOT prior to issuance of any land use permits. Dedication should be made to the Commonwealth of
Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty days to process
and issue. Should you have any questions, do not hesitate to call.

Building Code/2000 and The Virginia Uniform Statewide Building Code. Other code that applies
is CABO Al 17.1-98 Accessible and Usable Buildings and Facilities.
HC parking and access to the building appears to be in compliance provided slopes do not exceed
2% across area. All egress shall be accessible along with 50% of the entrances . Detail and permit
is required for accessible ramp located on the end of the building.

Demolition permit and asbestos inspection prior to issuance is required to remove the existing

The above referenced site plan was reviewed and the following comments are offered
on behalf of the Winchester Regional Airport Authority:
1. All outdoor lighting should be shoebox type to prevent light pollution to
approaching or departing aircraft.
2. Twenty-four hours prior to all crane operations, coordination must be made
with David Foley, Winchester Airport Operations Supervisor, (540) 662-5786
in order to ensure coordination with the Dulles approach center. Depending
on the height of the crane during operations, the operator may be required to
flag it with an aviation obstruction flag or to take other safety measures in
accordance with Federal Aviation Administration policies.
3. Due to the close proximity to the flight path of the airport, the owner should be
aware of the airport's existence and forewarned about aircraft noise and fly-
over nuisance from aircraft that could possibly impact their business. Owner
should consider including noise attenuation in the construction of the building.
These comments should be included in the general notes of the site plans. If these
conditions are followed, the Winchester Regional Airport Authority has no objections to
this proposal.
Thank you for allowing us the opportunity to review this plan to ensure the safe and
continued operations of the Winchester Regional Airport.

We have received your revised site plan dated December 13, 2004 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval. Also please provide five (5) sets of approved construction plans
with signed seal for VDOT distribution.
The site plan is showing CG-6 curb and gutter and your proposed plan is showing CG-7. Please
add the CG-7 so there will be no misunderstanding during construction.
The appropriate land use permit may now be applied for to cover work within the Route 50
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of any
land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

General) Zoning District. However, in accordance with Section 165-134C, this property may be eligible

this department wide correspondence requesting a waiver and explaining why this property is eligible. If
this property is subdivided in the future or additional development occurs on the site, a Master
Development Plan will be required.

Width of Travel Aisles & Parking Aisles. It appears that the eastern portion of the parking lot is not 24'
wide. Please ensure that all two-way traffic travel aisles are at least 24 feet in width. If this portion of the
parking lot is intended for one-way traffic, please provide traffic arrows and one way signs.
Traffic arrows and one-way traffic signs have been added to plan to clarify die proposed traffic circulation plan.
We believe the driveway widths are adequate.
V') Loading Spaces. The two loading spaces provided for the hotel are abutted by parking spaces and each
end. Section 165-28B (2) of the Frederick County Zoning Ordinance states that loading spaces shall be
designed to permit loading and unloading without requiring the moving of any parked motor vehicle. It

appears that these loading spaces do not meet this requirement and must be relocated to a more
appropriate location.
Loading spaces are for patron vehicles and light tnlcliS. A note to this affect has been added to tic plan.
Sidewalks. Since the parking lot surrounds the entire hotel building, the sidewalk should extend around
the entire building to ensure the safety of the patrons.

9) Dumpster Screening. Provide a detail for the dumpster screening.

10) Zoning District Buffer Landscaping. A category B zoning district buffer is required along the adjacent
RP zoned properties. A 50' distance buffer is shown on the plan; however, the required plantings
associated with a 50' category B full screen have not been shown on the landscaping plan.
Category B full screen planting detail has been added to plan. The combination of a small retaining wall and
fencing will satisfy die frill screen requirements.
11) Retaining Wall. It appears that the retaining wall is being used as part of the screen. The detail for this
wall shows a height of four feet -six feet max. Please provide a note stating that the rear portion of the
wall must be at least sex feet high.

entrance spacing to gain independent access to U.S. Route 50, an access easement will be provided through parcel
64A-((4))-8 should a maintenance quid use agreement be ratified by both parties.
15) Owner Information. On Sheet 2 of 6, the information provided on the lots state that the owner is Billett.
Please correct this information to reflect the new owner.

Upon rcview of the subj,ct site plan, we offer the following continents:
1) Provide additional product information for the proposed Atlantis Matrix D Rain tank. \Ve
will require the use of an impermeable liner beneath the entire structure. Based on the
detail provided, the outlet pipe fi-om the rain tank is located one (1) foot above the bottom
of the excavated area. Because the system will be constructed in the Martinsburg Shale,
the water discharged from this outlet pipe will not infiltrate the soil. Therefore, the outlet
pipe should discharge from underneath the excavation to ensure that the water doesn't
pond and stagnate in the bottom of the structtuV.
2) PI'oVICIc language related to the long-term effects of algae buildup in the system. After
several ),cars of use and the volume has been diminished duc to buildup on the grid, how
will the geogrids be cleaned?

We've prepared a site plan on two existing commercial lots on the north side of US Route 50, just west of the
Purdue Avenue intersection. A 70 room motel is proposed.
Access to the site is from US Route 50, one entrance with an associated right turn lane is provided.
All utilities are located along the Route 50 right-of-way. Public water line extensions to provide hydrant
coverage and serve the sprinkler system are required. A sewer lateral is extended from the main at US Route 50.
Storm sewer discharge is to an existing inlet at Route 50. An on site, underground detention system is provided
to mitigate increase flows due to development.
The topography of the site necessitates the use of low dry stack retaining walls along the rear perimeter of the
site. These walls will bear no live loads.
The layout meets the requirements of the Frederick County Zoning Ordinance. The necessary parking and
landscaping is provided. In lieu of 36" high shrubs to shield adjoining properties from headlights, the drop in
grade and the walls mentioned previously are utilized. The change from shrubs to the grade change, serving that
screen purpose, is clearing shown.
