RE: Kernstown Commons Lot 3 North Retail Handicap Spaces
John,
My client has a future tenant that requires some additional parking spaces close to their space. This letter is to
inform you of our intentions regarding the referenced spaces.
We will be converting two of the handicap spaces in front of the north retail on Lot 3 to conventional parking
spaces. We will also be adding signage for these spaces as well as "retail only parking signs" for the other spaces
directly in front of the retail spaces. We have included an exhibit showing our intentions for this area.
Justification
• Per plans submitted and approved for Kernstown Commons Phase II (County plan # 53-08), a total of 401
parking spaces were provided for Lot 3 included in that number were 12 handicap spaces. Current ADA
regulations only require 9 handicap spaces be provided on Lot 3. Elimination of the two spaces will leave 10
handicap spaces located on Lot 3.
• This area originally had ten spaces including the handicap spaces. The area will continue to have ten
spaces.
It is our opinion; we have met the current requirements for handicap spaces and maintained the total number of
parking spaces for the project.

After our last discussion on this subject, I spoke with my client and we are planning to proceed with the following
action. We will convert one of the handicap spaces in front of the north retail on Lot 3 to a conventional parking
space. This additional space is intended to be a "take out space" for the one restaurant tenant.
Justification
Per plans submitted and approved for Kernstown Commons Phase II (County plan # 53-08), a total of 401 parking

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on October 30, 2008. The site plan is for revisions to the Kernstown Commons Phase
2 Site Plan (SP #12-08). Revisions to the site include modifications to building 91 (Theater/Retail) to
accommodate the final architecture of the building.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with four (4)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy

Building shall comply with The Virginia Uniform Statewide Building Code and section
309, use group M (Mercantile) and section 303 — use Group A (Assembly) of the
International Building Code/2003. Other codes that apply are ICC/ ANSI A117.1-2003

Dear Ms. Perkins,
We have revised the approved plan to accommodate the final architecture for the building on lot 3 for the
proposed theater and retail space. During these revisions, several pages in the plan have been affected, and we
will be using the following scheme to track changes to the plan. We will keep the signature in the seal the same
date as the approved set. A new plan date will be added to all the sheets and only those sheets with changes will
have a date and description in the revision block.
The following is a brief description of the sheets revised and changes located on those sheets.
Sheet 2: update of parking, loading and FAR tabulations for revised building
Sheets 3, 5&6: Revised curbing, utility connections, parking, handicap locations and grading to accommodate
final architecture for the building
Sheet 7: Added detail for the installation of laterals and grease trap for the theater building.
Sheet 8: Revised locations for utility locations and crossing
Sheet 9: Revised fire hydrant location
Sheets 10&11: Revised and corrected miscellaneous changes to storm
Sheet 12: Revised drainage divides and areas to match final architecture
Sheet 13: Updated storm to match storm revisions on sheets 10 & 11
Sheet 17: Revised landscape plan and computations to meet requirements for final architecture on lot 3
