SUBJECT: Winchester South Lot 2 Subdivision - Utility Extension Plan
Please find attached a proposed subdivision design/utility extension plan for the subdivision of Lot 2 at
Winchester South Marketplace at the intersection of Front Royal Pike and Route 522. The proposed lot
would be accessed by existing entrances located on Route 522 (right -in only and Maranto Manor Drive
(right-in/right-out) and via private interparcel connections with the adjoining Walmart parcel and the
remaining Lot 2 tract. Would you please provide me with any comments that you may have. We are in the
process of preparing a site plan for a proposed fast food restaurant on the proposed 0.95 acre tract and plan
to have that submitted in the coming weeks for your review.

The above -referenced site plan was approved on June 18, 2009. The site plan is approved for the
development of a new commercial development located at the corner of Front Royal Pike and Maranto
Manor Drive in the Shawnee Magisterial District. Required site improvements include the following:
• 4,000sf Bank
• 25,200sf strip center (I 8,800sf retail/6,400sf restaurant)
• Construction of parking areas with a total of 175 spaces (7 handicap spaces), including curb and
gutter, landscaping, striping, and handicap access
• Two loading space and a multiple screened dumpster locations
• Sidewalks and landscaping as shown on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

This is to acknowledge receipt of your revised plans with latest revisions dated 3/27/09
for the referenced project. The plans appear satisfactory and are approved. Please
advise the developer accordingly. Please provide 5 sets of approved construction plans
with signed seal for VDOT distribution.
I offer the following general comments:
x A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
x Materials used and method of construction shall apply to current observed VDOT Road
& Bridge Specifications applicable during construction of this development.
x Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department.
x All drainage is to be carried within the right-of-way in ditch lines or gutters
along the street to a pipe or drainage easement.
x The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
x The appropriate land use permits shall be obtained before any work is performed on
the State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
* Any signs to be installed will be in accordance with the Manual on Uniform Traffic
Control Devices, 2003 Edition, and the approved plans.
x I suggest any utilities and/or storm sewer placed within the proposed right-of-way
be backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the
possibility of any pavement settlement.
* A copy of any/all recorded plats of dedication for drainage easements or additional
right-of-way required for implementation of this proposed project should be provided to
VDOT prior to issuance of any land use permit. Dedication should be made to the
Commonwealth of Virginia.
* A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for implementation
of this proposed project should be provided for VDOT review prior to issuance of any land
use permit.

Dear Cyrus:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be granted.
At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as
well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments
listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) BuildinI4 Location. This site proposes to construct a strip -type center with the rear of the building facing
Route 522. The building should be screened from Route 522 with additional landscaping.
2) Sidewalks. Sidewalks need to be provided as indicated on sheet 3. While not located on this property,
this site is part of the overall development with Wal-Mart and contained on the same MDP. The sidewalks
referenced were not part of the Wal-Mart site plan and should be provided with this development to create
additional pedestrian opportunities.
3) Landscaping. Additional shrubs need to be provided as indicated on sheet 5. It appears that the
placement of some of the trees may conflict with the storm drainage system.
4) Road Improvements. Reference the road improvement plan for Route 522.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the
plan. I will need all approved review agency comment sheets and at least five copies of the final plan for approval.
Comment sheets are required from the following agencies: the Frederick County InsImctions Department, the
Frederick County Department of Public ff'orks (County Engineer), the Frederick County Fire Alarshal, the
Frederick County Sanitation Authority, the health Department, and the Virginia Department of Transportation.

Review Comments:
1) Special Limited Power of Attorney Form. Please have the property owner sign the attached Special
Limited Power of Attorney Form prior to further review or approval. This form should be notarized
and completed to grant the applicant (you) with authorization to represent them for this site plan.
2) Signature Block. The signature block on the coversheet is incorrect.
3) Proffers. A sheet for the proffers that apply to this site need to be included.
4) Building Location. This site proposes to construct a strip type center with the rear of the building
facing Route 522. The landscaping plan should be revised to provide evergreen screening between
Route 522 and the rear of this building.
5) Dumpster Location. Dumpsters cannot be located within any front setback area; relocate as
indicated on sheet 3. The proposed bank is shown with a dumpster location; clarify that they need a
dumpster or if it can be removed.
6) Proiect Summary. The bank has not been accounted for in the proposed use and the total ground
floor area.
7) Sidewalks. Sidewalks need to be provided as indicated on sheet 3.
S) Building Height. Label the actual height of the strip center and the bank. The height and size of the
canopy need to be provided as well.
9) Loading Spaces. The strip center requires two loading spaces.
10) Proffers. It does not appear that this site plan is in compliance with Rezoning #02-07 (Proffer 4.2)
regarding the visibility of loading areas.
11) Symbols. There is a symbol used on sheet 3 that is not labeled and not included in the legend.
12) Directional Arrows. Directional arrows need to be provided throughout the site.
13) Lighting. The lighting detail on sheet 7 is unreadable. Revise the detail and ensure that the fixture
consists of a flat lens. Provide the locations and type of any building mounted lighting if proposed.

14) Headlight Screening Additional evergreen shrubs need to be provided as indicated on sheet 7. It
appears that the proposed retaining wall is intended to serve as screening for portions of the parking
area. This retaining wall is listed as "segmental" with portions being a retaining wall and portions a
chain link fence. Show which sections are retaining, as well as the height of the wall.
15) Chain Link Fence. It is unclear why a chain link fence is being placed along Route 522; alternative
materials should be considered along this major roadway.
16) Road Improvements. Reference the road improvement plans for Route 522 and Tasker Road
associated with this development.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan

We've prepared plans for the site development of Lot 2 of the Winchester South Marketplace. Lot 2 is located
Oil the corner of US Route 522 (Front Royal Pike) and Maranto Manor Drive in Frederick County. The
development will include the construction of a 25,200 square foot retail and restaurant building and a 4,000
square foot bank with 3 drive-thnu lanes, meeting all loading area and parking requirements. The total disturbed
are for this site is 4.0 acres.
The site will drain through proposed inlets and culverts through the Lot 1 (Wal-Mart) development to a future
storm water detention pond that is to be constructed as part of the Maranto Manor Drive Road Plans by
PHR&A.
