Those in attendance were Eric Lawrence, Eric Meske, Ron Peterman, and Sam Doan. (1) The representatives desired a reduction in the landscaping along the Route 50 frontage. Current plan provides a full Distance Road Efficiency Buffer and the proffered enhanced landscaping. Initially sought was an ordinance amendment to enable a PC granted modification to the REB. After extensive discussions about their request, the enhanced landscaping to be provided, and the post -construction resulting topography, it was believed that they could request of 165-203.02.E(3) — PC waiver if topography warrants modifications. Post -construction topography results in a 10ft differential from road ROW to building pad grade, and structure setback exceeds 200 ft. Any modification requests should be supported with illustrative depicting planned landscaping if modification to evergreen tree plantings is granted. (2) The representatives indicated an interest in relocating the dumpster pad/enclosures approximately 50 ft. New site warrants a slight deviation to the sidewalk system and shrubs. Would require site plan modification (3) The representatives sought the ability to create a covered resident drop-off at the SE corner of facility. Appears to be enabled with a site pan modification. Design team will seek modification from REB enabled by 165-203.02.E(3). Once completed (granted or denied), a site plan modification will be submitted to address these issues. It was also noted by Mr. Meske that Candice had previously permitted deviations to the various landscape screens around the site's perimeter. With the exception of Paragraph 3.2 below, the remainder of Parcel 538-3-24 shall be exempt from these proffers. All other B-2 uses shall not be permitted on this site unless they are approved by Prederick County as part of a revised Proffer Statement. 1.2 All site improvements, as shown in the GDP, such as: Route 50 frontage improvements; Ward Avenue frontage improvements; an enhanced 100' road efficiency buffer along Route 50; enhanced Category B buffer yards along east, west, and south property lines; on -site drive aisles and parking; sidewalks; and site landscaping and lighting shall be constructed or bonded by the Applicant at the earlier of within twenty-four (24) months of Zoning Approval or issuance of a Certificate of Occupancy. This does not include connections to future adjacent roads as illustrated on the GDP. 2. SITE DEVELOPMENT 2.1 Site entrances shall be limited to three (3) as shown on the GDP. Egress via the right in/right out entrance shall be restricted to Allegheny Power vehicles only, and shall be posted with signage accordingly. The thud access point is shown along the southern boundary to maintain access to the existing Allegheny power service substation and to allow for a future connection to the Round Hill Road extension by others. The exact design and location of each entrance shall be determined upon final engineering and pursuant to the specifications and approval of the Virginia Department of Transportation (VDOT). 2.2 The Applicant agrees to use a mix of brick and siding to break up the elevations of the structure and to provide an attractive facility generally as depicted in exhibits provided and which are attached, A incorporated as Exhibit A. Any future additional structures will be required to use compatible materials for design continuity. TRANSPORTATION 3.1 The Applicant agrees to dedicate a 25' right of way to allow for the construction by others of the future Round Hill Road extension as depicted on the GDP. Such dedication shall occur within ninety (90) days of receipt of a written request from either VDOT or Frederick County. If it is determined by Frederick County that 2 the alignment of the southern road (anticipated to be the future Round Hill Road extension) changes such that all or any portion of the proposed dedication is outside of the new alignment, the Applicant will be relieved of the obligation to dedicate all or a portion of the right of way to the extent that the proposed dedication is outside the new alignment. 3.2 Right-of-way shall be dedicated along the Ward Avenue frontage of Parcel 5313- 3-24 and Parcel 53I3-3-25 to permit the continuation of the three (3) lane curb and gutter road section to the southern boundary line of the Property (Parcel 53I3-3- 25), and to 1110«, for the construction of the proposed improvements to Ward Avenue as shown on the GDP. The Applicant shall dedicate all such right -of -Way within twelve (12) months of Zoning Approval. 3.3 The Applicant ,vill allow for inter -parcel access to adjacent properties to help facilitate future connectivity within the Round I-Iill Land Use Plan (RI-ILUP) area. The location(s) of such future inter -parcel connections shall be determined after agreement Nvith the adjacent property owners. 3.4 The Applicant agrees to contribute to Frederick County the sum of $25,000.00 for additional road improvements in the vicinity of the development. The payment shall be made by the Applicant upon the issuance of the building permit. 4. FIRE &. RESCUE- 4,1 The Applicant shall contribute to Frederick County the sum of $100,000.00 for fire and rescue purposes upon the issuance of the building permit. In addition, the Applicant agrees to make art annual contribution in the amount of $5,000.00 to Frederick County to be used for fire and rescue purposes. Said payment shall be made on or before each annual anniversary of the issuance of the first building permit for the Property. Said annual $5,000.00 payment shall expire when and if Frederick County requires a fee -for -service for the dispatch of fire or rescue vehicles. While we agree that our proffer agreed to defer final VDOT specifications that related to our site entrances, we do not agree that the signal head that is being required at the intersection of Route 50 and Ward Avenue has anything to do with our site entrances. In fact, as you know, the lack of a signal head is a condition that exists today and certainly predates our project. Further still, you will recall that the County required the developer to have a right -in only entrance on Route 50. The net of all of this is that the proffer design of the entrances for the HHHunt development will not put any vehicles to the intersection of Route 50 and Ward Avenue where the signal head is being requested, and, if anything, the right -in feature into the HHHunt site will take trips away from the existing intersection where the signal head is being requested. The simple fact is that the HHHunt proffer providing for a $25,000.00 payment was to be used for improvements in the Route 50 corridor area. The good news is that those funds are available, and apparently the County and VDOT would like to have improvements made to the corridor in the form of this signal head. HIIIIunt certainly has no objection to the proffered funds being used in this manner, but we must receive a credit against the proffer payment for this expenditure. If we do not, then we will be in a position where we are being required to pay more than the amount required under the proffers. Eric R. Further, as you know, when the rezoning for this project was approved, it also included a Generalized Development Plan ("GDI'"), which showed, among other thiIlgs, all transportation improvements. SubscgLlCllt to the approved rezoning and the GDP, we have learned there is a need to do some additional signalization off site in the vicinity of the intersection of Ward Avenue and Rt. 50. While we are pleased to do that work in order to make for a better corridor, we would assume, and this letter is being sent to confirm, that the cost for the additional signalization (approximately $7,000.00) will be either paid directly by the County from the $25,000.00 proflcr funds or the developer will receive a credit against the $25,000.00 payment for the actual cost of the installation of said signalization. Perkins, AICP, Senior Planner Subject: Public Meeting — Route 50 Assisted Living — Road Efficiency Buffer Waiver Request Date: August 2, 2010 Staff has received a waiver request from GcoForestry, Inc., and Bowman Consulting to allow for an alternative buffer design for the road efficiency buffer for the Route 50 Assisted Living property (Spring Arbor). The property is located on Northwestern Pike (Route 50W) and Ward Avenue (Route 1317) in the Back Creek Magisterial District. The site is zoned B2 (Business General) and was rezoned in 2008. Properties zoned B2 typically are not required to provide road efficiency buffers, however § 165-204.01 - 11 dull care residences, assisted living care f icililies an(I convalescent or nursing homes, requires that these facilities, when located in the B2 District, provide road efficiency buffers as specified in §165- 203.02E. The Zoning Ordinance requires that the site provide a 100 foot distance (50 feet active/50 feet inactive) and a double row of evergreen trees. In addition to the Zoning Ordinance requirement, Nvhen the Route 50 Assisted Living property was rezoned, an "enhanced" road efficiency buffer was proffered (enhanced with eight canopy trees, two ornamental Shl'ubs, and 24 shrubs). In accordance with Section 165-203.02E (3), the Planning Commission may allow for alternative designs which meet the intent of the section in the event of topography or sight distance constraints. The assisted living building is located over 200 feet from Route 50W and is approximately 15 feet above grade from Route 50W. Therefore, the applicant is requesting an alternative landscaping plan for the Road Efficiency Buffer. The proposed landscaping would consist of I 1 canopy trees, two ornamental trees and 24 shrubs that are grouped together. The applicant has provided a copy of the revised site plan (landscaping sheet) and details of what the requested buffer modification would look like. I thought that our meeting was insightful and beneficial in understanding the code requirements and provisions. On behalf of our client, HI-IHunt Corporation, we request that the Frederick County Planning Commission approve an alternative landscape design for the Route 50 Assisted Living Facility/Spring Arbor site located in the Back Creek Magisterial District. Citing Zoning Ordinance Sec 165- 203.02.E(3). "The Planning Commission may allow for alternative designs which meet the intent of the section in the event of topography or sight distance constraints." We request that an alternative design be approved in lieu of the required planting of a double row of evergreens for the Road Efficiency Buffer. The site is located along Route 50 near the entrance to the western side of the City of Winchester. The B-2 business district has a mix of retail, banks and hotels in this area. Stoplights, traffic controls and connecting walking paths are now in place, signaling a transition from the more rural divided highway character of the roadway further west. The building on the subject site is set back approximately 220-250 feet from the roadway. The closest parking is located 130 feet from the roadway. The 27.5 foot tall building is sited approximately 15 feet above the roadway with a stepped tiered landscape including walkway, berm, storm water pond and parking lot landscaping extending between the building to the roadway edge. The combination of the topography, landscaping and total distance will soften the impact of the building to the road and adjacent parcels. A review of the landscape buffers installed on the adjacent developed parcels in this B-2 District reveals aesthetically pleasing landscapes planted with a mixture of planting materials that provides visual interest in both texture and height. The subject site will have a walking path within the Road Efficiency Buffer connecting to the walkways of the adjacent parcels as well. We propose to landscape the area with the proffered planting material, which consists of a mixture of canopy trees, small to midsize trees and shrubs similar to the plantings found in the surrounding developed parcels. • is GeoForestry, Inc. The required single row of evergreens "to grow to a minimum of 20ft tall" would effectively create a solid green wall that would not be aesthetically pleasing or in keeping with the landscaping installed on the surrounding developed parcels. The placement of large evergreens would also be inappropriate for this site as they could pose the risk of interference with the existing overhead electric primaries. The proffered shrub plantings and a few small ornamental trees appropriate for placement beneath the existing overhead utility lines are proposed to be relocated and interspersed along the path in a similar fashion to the surrounding parcels. Relocating the shrub and small ornamental trees to the area around the walking path is intended to alleviate the stress caused by dense planting. The plantings would also create a perceived buffer from the street and result in a safer more welcoming environment for pedestrians. The intent of this alternative landscape design is to provide for an effective and aesthetically pleasing landscape buffer within this B-2 Zoning District. While an unbroken wall of evergreens may be appropriate for a site located along a divided limited access highway such as Interstate 81 or Route 37, this particular site is in an area where businesses and pedestrians are to be considered. As the County's Business District, it is appropriate to provide for landscaping that is in conformance with the types of uses and end users contemplated by the B-2 district regulations. The submitted plan also depicts a reduced number of trees along the rear portion of the property in Enhanced Category "B" Buffer. The large berm that is located along the rear property line provides a more than sufficient screen between the adjacent properties. The plan as presented includes many specimen trees that have been upsized from what is typically required. Many eight to ten foot screening evergreens and five inch caliper shade trees are to be planted on site. During the course of finishing the building we will be requesting a temporary occupancy permit to occupy the building for two different functions as described below. The first temporary occupancy that we are requesting is for the use of the model area that we have finished for prospective residents to view as a part of their decision making process. It is my understanding that John Trenary, Chief Building Official, has approved the models for occupancy and all that is remaining is for you to issue your approval. We respectfully request that you give us permission so that we can begin showing the model as a part of our marketing effort. We have a function tomorrow and would be appreciated it if we could begin to use the model then. During the month of August we will begin to hire our employees and would like to begin our training the third week. It is our desire to use a portion of the building that has been complete with no further construction required for the training to occur in. The new employees will be in the building from the hours of 8AM to 5PM doing their training and will not be allowed to enter other areas of the building except those designated for training purposes. For this function, we will be requesting a temporary occupancy permit for this specific use at a time closer to the second week of August. Given the time of year that we are finishing, we may be asking to put a bond in place in lieu of planting some of the more temperature sensitive landscaping material. We will be installing as much as we can that are not susceptible to heat and dry conditions. In addition, we will also be installing a lawn sprinkler system to aid in watering as needed. Living - Allegheny Power Easement Patti, We have taken a look at the criteria that you provided us for the revised access to the substation and will be able to comply with all of the criteria except for the 100' radius at the entrance. I have attached 3 different exhibits that show the revised access road. Two of the exhibits show the entrance with and with out the truck in it and the other exhibit that shows the revised internal travel isle`bie rear of the property. We are proposinoprovide a straighter shot to the substation. I would like to sit down and discuss the entrance as achieving the requested radius is problematic. The entrance that we have included meets and exceeds VDOT criteria and allows a large WB-50 size vehicle to adequately traverse the site. If we could get all parties that would have a stake in this entrance radius from Allegheny Power to sit down and discuss this in an effort to come up with a solution it would be greatly appreciated. We are willing to meet at whatever location is convenient. Let me know if this is feasible and if so, when everyone would be available to meet.
