Dear W. Lee and Mr. Hudson:
On May 10, 2010, site plan #61-08 was approved for the Lee Conullcrcial Center located at 175 Fairfax
Pile in the Opequon Magisterial District. The approved site plan specified Please 1 road inlprovenlents to
Route 277 that include the following:
1. New site entl'ance.
2. Concrete sidewalk along the Lee Commercial Property and in front of Arby's site.
3. Box culvert extension.
Road inlprovenlents approved as part of' a site plan are generally required to be installed prior to the
issuance Of any occupancy permit. However, Frederick County and the Virginia Department of
Transportation have agreed to defer the road inlprovenlents for a specified period of time as outlined
below:

Page three of this document contains an acknowledgement of the above referenced three conditions that
needs to be signed and notarized. By completing page three, you acknowledge that Frederick County is
deferring the required road improvements until November 1, 2011, this must be secured by a bond, and
if not inlplenlcnted by said date, Frederick County will revoke the business license alld the OCCLIpancy
permit from the site and the use must discontinue operation.

LEE COMMERCIAL SITE PLAN CONSTRUCTION TIMING AGREEMENT
A
THIS AGREEMENT made and entered into this 7 day of 1"n. , 201U, by and
between Jai Euk Lee hereinafter called the "Landowner", and the Planning Department of Frederick
County, Virginia, hereinafter called the "County."
WITNESSETH, that
WHEREAS, the Landowner is the owner of certain real property described as 7413 0)) Section
2 Lot D as recorded by deed in the land records of Frederick County, Virginia as Instrument Number
090011105, hereinafter called the "Property";
WHEREAS, the Landowner is proceeding to build on and develop the property; and
WHEREAS, the Site Plan known as Lee Commercial Site Renovations prepared by Painter -
Lewis P.L.C.with the latest revision date of March 29, 2010 , hereinafter called the "Plan", which is
expressly made a part hereof, as approved or to be approved by the County, provides Improvements to
Route 277 at the property entrance as shown on sheet 3/9 of the Plan, hereinafter called "Phase 2"; and
WHEREAS, the County and the Landowner, its successors and assigns, including any
homeowners association, agree that the safety and welfare of the residents of Frederick County, Virginia,
require that the Phase 2 improvements at the property entrance be constructed within five years of the site
plan approval date OR when the building addition is constructed for Phase 2, whichever occurs first, unless
an extension is formally requested and approved by the County.
NOW, Ti-fEREFORE, in consideration of the foregoing premises, the mutual covenants contained
herein, and the following terms and conditions, the parties hereto agree as follows;
The improvements to Route 277 and the property entrance shall be constructed by the
Landowner, its successors and assigns, in accordance with the plans and specifications identified in the
Plan as Phase 2.
2. The Phase 2 improvements shall be constructed within five years of the site plan approval
date OR when the Phase 2 building addition is constructed, whichever occurs first, unless an extension is
formally requested and approved by the County.
This Agreement shall be recorded among the land records of the Frederick County, Virginia,
and shall constitute a covenant running with the land, and shall be binding on the Landowner, its
administrators, executors, assigns, heirs and any other successors in interests, including any homeowners
association.
4. This agreement shall be governed by the laws of the Commonwealth of Virginia.
5. Any disputes arising from or as a result of this Agreement shall be resolved in the Circuit
Court for Frederick County, Virginia.
6. If any provision of this Agreement is found to be illegal, invalid, or unenforceable, that shall
not affect the validity or enforceability of any other provision of this agreement.

Please provide three (3) sets of approved construction plans with signed seal for
VDOT distribution. In addition, please provide VDOT with PDF's of individual plan
sheets.
The appropriate land use permit may now be applied for to cover work within the
right-of-way. The permit is issued by this office and will require a minimum processing
fee and surety bond coverage. Once satisfactory application has been made, a permit
will normally take approximately thirty days to process and issue.

Dear Ms. Perkins
We received your comments dated December 18, 2009 and have addressed each as
listed below
1. The cover sheet notes have been revised per your request.
2. We have added sheet 3 to the plan set. Sheet 2 shows the Phase 1
improvements only and sheet 3 shows the Phase 2 improvements.
3. The sidewalk has been revised per VDOT comments dated January 22. 2010
which requested that it be located with in the VDOT right-of-way.
4. The CG-2 and rolled down curb has been changed to CG-6 as requested. The
wheel stops shall remain as they are promoting good LID practice. The large
existing ditch is acting as a BMP and promoting sheet flow across the site to the
existing ditch is an LID technique, as required by the Commonwealth of Virginia.
5. The inactive buffer district line is shown on the plans.
6. The buffer plantings have been revised per your request.
7. The evergreen shrubs have been provided for additional headlight screening.
8. The zoning ordinance reference has been revised.
9. A photometric plan has been added to the plan on sheet 5.

Dear Ms. Perkins:
We received your comments dated November 18, 2008 and have addressed each as
listed below:
1. The power of attorney form is attached with this plan set.
2. The proposed uses for this site have been clarified on the cover sheet.
3. The right-of-way dedication and frontage improvements are now shown on the
plan per VDOT and shall be installed per the written agreement between the
owner, the county, and VDOT.
4. The entrance to the site has been revised to reduce confusion.
5. The sidewalk has been added connecting to the Arby's to the east and in
alignment with the sidewalk located in front of Advance just outside of the right-
of-way limits. Sidewalk is provided on the west side adjacent to the proposed
curb.
6. Curb and gutter is located along the eastern side of the parking lot. Along the
building front there is an existing 6" rolled down curb at the edge of the existing
sidewalk. Along the western side of the parking lot there is an existing sheet flow
condition that drains the site to an existing grass swale which treats the water
and filters out impurities before it enters the storm sewer system. By adding the
curb and gutter in this location the treatment of the water will not occur. Some
wheel stops have been added along the pavement edge in this location.

Dear Mr. Lee and Mr. Hudson:
On May 10, 2010, site plan #61-08 was approved for the Lee Commercial Center located at 175 Fairfax
Pike in the Opequon Magisterial District. The approved site plan specified Phase 1 road improvements to
Route 277 that include the following:
1. New site entrance.
2. Concrete sidewalk along the Lee Commercial Property and in front of Arby's site.
3. Box culvert extension.
Road improvements approved as part of a site plan are generally required to be installed prior to the
issuance of any occupancy permit. However, Frederick County and the Virginia Department of
Transportation have agreed to defer the road improvements for a specified period of time as outlined
below:
Conditions:
1. The specified road improvement shall be completed no later than November 1, 2011.
2. Jai Euk Lee (property owner) must pull a permit from the Virginia Department of Transportation
for the specified road improvements that must be secured by a bond in the amount of $25,000
prior to Frederick County issuing a business license for Terry Hudson, who is the operator of
Tippy's Taco and before signing a temporary occupancy permit. This bond shall be posted with
the Virginia Department of Transportation.
3. If the specified road improvements are not completed by November 1, 2011, Frederick County
will revoke the business license and the occupancy permit from the site and the use must
discontinue operation.
Page three of this document contains an acknowledgement of the above referenced three conditions that
needs to be signed and notarized. By completing page three, you acknowledge that Frederick County is
deferring the required road improvements until November 1, 2011, this must be secured by a bond, and
if not implemented by said date, Frederick County will revoke the business license and the occupancy
permit from the site and the use must discontinue operation.
