Dear Mr. Smith:
The purpose of this letter is to confirm action taken by the Frederick County Planning Commission
at their December 5, 2001 meeting. During the meeting the Planning Commission approved your
request for a waiver to the requirements of Section 165-37 B (2) of the Frederick County Zoning
Ordinance. Specifically, they approved a landscape screen along the south property line ofPowell's
Plumbing, instead of the normally required full screen. Therefore, the fence shown on the approved
site plan of the site is no longer a requirement for this development. All other improvements are
required as specified on the site plan.

In accordance with your request of 06/22/01 you are given permission to install a temporary
construction entrance at the referenced location. This letter is to be considered your permit to
do so. The following provisions will be required:
• Work area protection signage is to be in accordance with the current Work Area Protection
Manual while working on the right-of-way.
• All work on the right-of-way is to be confined to the temporary entrance location only.
• A minimum 6" depth of VDOT #1 (2-3 inch stone) at a minimum width of 12' is to be placed
from the edge of pavement and extended a minimum of 70' with a filter fabric underliner.
• All materials spilled, dropped, washed or tracked from vehicles onto the roadway or into
storm drains must be removed immediately.
• Positive drainage is to be maintained within the right-of-way at all times.
• A wash rack will be required.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to
this entrance will be repaired by you to our satisfaction.
• This permit is being issued for 180 days.
• All work is to be completed in accordance with the enclosed Virginia Erosion & Sediment
Control Handbook, Specification 3.02.
• The entrance is to be installed at the location shown on the site plan prepared by Greenway
Engineering dated April 25, 2001.
The Department of Transportation will not be held liable for suit should such result from this
operation nor is it granting permission to grade on the property of others or disturb underground
utility lines. If the above listed items are not followed this permit may be revoked.

Dear Scott:
The Frederick County Department of Planning and Development administratively approved the above- referenced
plan on August 28, 2001. The site plan meets all requirements for development in the B3 Zoning District.
Currently, there are no adverse comments by any of the required review agencies; however, any future comments
by these agencies should be addressed promptly. Below is a list of the primary improvements of this development:
• Construction ofa 12,250-square-foot warehouse building intended to be leased out to individual users that
are permitted to operate their business in the B3 Zoning District. Seven (7) warehouse/office units are
approved for the structure, with an average size of 1,750 square feet.
• Associated parking and landscaping.
• A Category "A" buffer running along the front property line, beginning at the end of the existing
landscaped screen and ending at the corner of the property adjoining Interstate 81. (Prior to the issuance
of an occupancy permit, the owner of the property will be required to either construct the full screen as
specified or provide staff with a "letter of credit. " If the latter is chosen, the owner will first need to
provide staff with at least one estimate from a credible business which summarized the cost of the fence,
including labor and other associated costs. Once staff has agreed on the dollar amount, the owner
should provide staff with the "letter of credit"along with a formal letter agreeing to construct the fence
within a reasonable time frame. )
• A second dumpster with a concrete pad and enclosure.
I have provided you with three copies of the approved site plan. Please forward these to the appropriate
representative. Furthermore, please advise the owner that a copy should be kept for future reference and an
approved copy must be kept on the construction site throughout the development process. Once site development
is complete, the owner should contact this office to schedule an on -site inspection. Please do not hesitate to contact
me if you have any questions.

Upon review of the above -referenced site plan, the Department of Planning and Development is
requiring that you submit a revisal. The following comments have not been addressed and should
be included in your revised copy. To assist you, I have enclosed a numbered plan which corresponds
with the following requests.
1. Buffering. A category B buffer with a landscape screen requires a 75 foot inactive buffer.
The site plan you submitted only provides a 70 foot inactive buffer, a shortage of five feet.
Please either increase your inactive buffer by five feet or provide a full screen.
, 2. Outdoor Storage. Please provide the location of all existing and proposed outdoor storage
areas. All outdoor storage is required to be fully screened. If no outdoor storage is proposed,
provide a statement on the site plan that clearly.
3. Signature Box. Please remove the existing approval box and insert one for the Zoning
Administrator's Signature. A statement below the Zoning Administrator's signature should
state that approval is valid for five years.
-'4. Utility Hookup. Please clarify how electric will be hooked up to the proposed building. All
new utilities are required to be located underground.
-'5. Fire Code. If any other improvements are required to meet fire code please provide their
locations.

7. Parking Calculations. Please change your parking calculations to account for the entire
property, both the existing facility and the proposed building. Furthermore, please provide
the total number of proposed employees for the entire site.
8. Perimeter Landscaping. Staff calculates that the perimeter of the new parking area is 252
feet. This would require 7 perimeter landscaping trees. Please change your landscape
calculations and landscape plan to reflect this.
9. Height. Please provide the height of the proposed building.
10. Outdoor Lighting. Please provide the location of all proposed and existing outdoor lighting.
In addition, please provide a statement to the effect that all outdoor lighting will be directed
away from adjoining properties and roads.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will then need all approved review agency comment sheets and five copies

§ 165-37 FREDERICK COUNTY CODE § 165-37
Commission and may result in the Commission revoking the
modified screening approval.
(7) (Added 3-13-19961 Land proposed to be developed in the M1
Light Industrial District and the M2 Industrial General District may
be permitted to have a reduced buffer distance that is consistent
with the required side or rear building setback line, provided that
the following requirements are met:
(a) The property to be developed with a reduced buffer distance
is part of an approved master planned industrial park.
(b) There are no primary or accessory uses within the reduced
buffer distance area, including driveways, access drives,
outdoor storage areas, parking areas, staging areas, loading
areas and outdoor dumpster areas. All-weather surface fire
lanes necessary to meet the requirements of Chapter 90, Fire
Prevention, of the Code of Frederick County, Virginia, shall be
exempt from this performance standard.
(c) A full screen is required to be created within the reduced
buffer distance area which shall be comprised of a
continuous earth berm that is six (6) feet higher in elevation
than the highest elevation within the reduced buffer distance
area and a double row of evergreen trees that are a minimum
of six (6) feet in height and planted a maximum of eight (8)
feet from center to center.
(8) Proposed developments required to provide buffers and
screening as determined by § 165-37D(1)(b) of this chapter may

easement with the adjoining property. The common shared
buffer and screening easement shall include all components of a
full screeP which shall be clearly indicated on a site design plan. A
legal agreement signed by all appropriate property owners shall
be provided to the Department of Planning and Development and
shall be maintained with the approved site design plan. This
agreement shall describe the location of the required buffer
within each property, the number and type of the plantings to be
provided and a statement regarding the maintenance
responsibility for this easement. The required buffer distance may
be reduced by fifty percent (50%) for a common shared buffer

(9) [Added 2-11-19981 When a flex -tech development is split by a
zoning district line, the Planning Commission may allow for a
reduction of the distance buffer and the relocation of the
screening requirements. Such modifications shall be allowed at
the Commission's discretion, provided that all of the following
conditions are met:
(a) The zoning district boundary line for which the modification is
requested is internal to the land contained within the Master
Development Plan.
(b) The required landscape screen is relocated to the perimeter
of the flex -tech development. This relocated landscape
screen shall contain the same plantings that would have been
required had the screen been placed along the zoning district
boundary line.
E. Road efficiency buffers.
