Department of Planning and Development will review the application to ensure that it is complete. If

Dear Ron:
The Frederick County Department of Planning and Development administratively approved the above -
referenced plan on October 29, 2001. Currently, there are no adverse comments by any of the required
review agencies; however, any future comments by these agencies should be addressed promptly. Below
is a list of the primary improvements of this development:
• Construction of a 12,500-square-foot warehouse building.
• The existing screen and buffer shall be maintained and improved in some locations. The existing
landscape screen along the southeast property line shall be maintained as part of the required buffer
between the RP (Residential Performance) and M 1(Light Industrial) Zoning Districts. Improvements
include an eight -foot- high opaque fence. The fence will be located along the center of the southeast property
line and shall be 535 linear feet long.
• Improved parking conditions are required. Although the new building will not require any additional parking
spaces, the site plan requires new pavement, signs, striping, and re -striping.
• Improvements shall be made to the existing entrance off of Ebert Road (Route 837).
• The existing trailer and tank will be relocated. A building permit shall be required for both.
I have provided you with five copies of the approved site plan. Please forward these to the appropriate
representative. Furthermore, please advise the owner that a copy should be kept for future reference and an approved
copy must be kept on the construction site throughout the development process. Once site development is complete,
the owner should contact this office to schedule an on -site inspection. Please do not hesitate to contact me if you have
any questions.

Once satisfactory application has been made, a permit will normally take approximately thirty

Building shall comply with The Virginia Uniform Statewide Building Code and section,
311, use group S (Storage ) of the BOCANational Building Code/1996. Other code that
applies is CABO A117.1-92 Accessible and Usable Buildings and facilities.
Note HC parking and building access is not shown on the site plan.
The existing Trailer and Propane tank to be relocated shall require building
permits and inspections.
Section 1110.2.1 Exception #1 (The ADA 20% rule for additions and renovations) shall
apply in chapter 11 of BOCA. Also note the requirements in chaper 17 of BOCA for
special inspection requirements for this type of structure.
Please check section 707 of BOCA for firewall requirements and section 904 for Fire -
Suppression system requirements or exemtion.

We've revised the Zuckerman Expansion plan per your comments of 20 July 2001. I've attached one copy of
the plan for your approval. The changes include:
1 V A water line extension to a hydrant behind the expansion area has been added.
Pavement overlay is required at the entrance on Ebert Road.
%3! The zoning classification of the parcel has been revised.
4/The note regarding setback of signs has been revised.
S/The adjoining property owner information, for the Valley Fertilizer site, has been added.
�,An additional note, specifying that no outdoor storage is proposed, has been added.
7. The use of all buildings has been specified on the plans. The area summary has also been revised to reflect
tl a warehousing use. This use is integral to the industrial operation of the site.
8.v/A parking calculation for the site has been added to the plans. As stated previously, this expansion will not
uire additional employees to be hired.
9. rgqhe employee parking locations are shown. I visited the site and reviewed these areas with Mr. Mark
Phelps, my contact at Charles Zuckerman. He verified that the locations shown are correct. I also
observed that the surfacing materials, designated by Marsh and Legge Land Surveyors on their base
mapping, are correct. All of the parking areas are currently paved, but for the 4 spaces between the
b} ildings. That area will be paved as part of the expansion.

Upon review of the above -referenced site plan, the Department of Planning and Development is
requiring that you submit a revisal. The following comments have not been addressed and should be
included in your revised copy. To assist you, I have enclosed a numbered plan which corresponds
with the following requests.
Zoning Information. The Official Frederick County Zoning Map indicates that the subject
property is zoned M-1, rather than M-2 as you show on the referenced site plan. Please
correct the zoning and make all other associated changes, such as the percentage of open
space (landscaped area) required.
2.✓ Construction Road. Please provide the location of the construction road that is mentioned
on the site plan. Furthermore, if this entrance to the property is not an approved commercial
entrance, please provide a statement to the effect that during normal operating times this
/entrance will not be used.
3. v Sign Setbacks. You state on the site plan that signs shall be located three feet from the curb.
However, the Frederick County Zoning Ordinance requires that all signs be setback at least
five feet from curbs and at least 10 feet from property lines. Please change your statement
to indicate at least five feet, rather than three feet.
4. � Adjoining Property Information. Please show all required information for the adjoining lot
located across Ebert Road from the northern corner of the property. The Property
Identification Number for that lot is 44-A-6, and the zoning is M-2.

5 Outdoor Storage. Since no outdoor storage areas are shown, please provide a statement to
the effect that there will be no outdoor storage on the premises.
6" Use of all Buildings. Please provide a more detailed description of the use for each building.
Furthermore, explain what the use of the relocated trailer will be. Tshwy
7. Zpffkin.& Calculations. Please provide staff with the required parking calculations.
Manufacturing uses require three parking spaces for every four employees. Therefore, you
need to state how many employees work on the premises. The existing office building should
be included in the calculation, but there should be one parking space for every 250 square feet
of office area.
8. V Handicap Parking Spaces. Please show how many handicap parking spaces are required. In
addition, please show the location and dimensions of these spaces on the site plan. There are
presently no handicap parking spaces at the property.
9. EmRlloyee Parking Locations. During an inspection of the premises, I noticed that there are
actually four areas that are being used for employee parking. All of these areas are at a
standard less than what is required by the Frederick County Zoning Ordinance for parking lots
in the M-1 Zoning District. Staff is looking to see an improvement in the parking situation
with this proposed expansion. After you have calculated the required number of parking
spaces, please show on the site plan all areas that will be utilized for parking. All parking
areas should be hard surfaced and each parking spaces should be striped.
10. \/ Location of Utilities. Please provide the location of all electric utilities, the on -site well, and
the drainfield.
1 J Fire Code Improvements. Please show and label the location of all fire hydrants and fire lanes
required by the Fire Marshal.

Screening & Buffer. Staff has observed two problems with the proposed screening. First,
the applicants proposal to use the existing trees along the perimeter of the property as a
landscape screen fail to meet the requirements of the Zoning Ordinance. The Ordinance
requires that all landscape screens be composed of mostly evergreen trees. The majority of
existing trees are deciduous. A second problem with the proposed screening is that the 6'
opaque fence does not extend far enough along the eastern property line. Staff would like
for the applicant to propose a better screening plan. I advise that you extend the fence at least
68 feet (as shown) and increase the height of the fence by 2 foot (as shown) to compensate
for the less than standard landscape screen.

After you have revised the site plan, please resubmit one copy so that I may verify the information

I've enclosed plans for a 12,500 S.F. facility expansion at the Charles Zuckerman Plant on Ebert Road. In
addition to the building, a new driveway will be installed for access, and a detention pond constructed to
mitigate increased flows. Zuckerman will have no additional employees for this project. The existing parking
is adequate. We intend to maintain the existing landscape screens to the east and south, augmenting that with a
board fence to satisfy the residential buffer requirement.
