The checklist below indicates all the information that needs to be submitted as part Of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department Of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Violation of the Frederick County Zoning Ordinance
Dear Mr. Twyford:
On Friday, April 18, 1997, this office received a complaint concerning construction activity at the
above referenced property. I immediately conducted a site inspection to find that the required 50-foot
landscape buffer along the eastern property line had been violated. As you were not available when
I telephoned Datalux Corporation following my site inspection, I spoke with Robert Wilson
concerning this matter.
My site inspection revealed that the 50-foot landscaped buffer had been completely cleared of
vegetation, graded, and curb and gutter forms had been set. The construction crew was in the
process of placing gravel within the forms. It was during this site visit that I advised the construction
crew to stop work on this project.
The removal of the vegetation within the 50-foot buffer, both natural and planted, violates the
--
zpproved Master Plan for the Airport Business Center (MOP_# 009-81) i� addition to the approved
Site Plan for Datalux Corporation (Site Plan # 13-94). It is my understanding that this action also
violates the covenants for the Airport Business Center.
These violations may be remedied by restoring the vegetation within the 50-foot buffer. All curb and
gutter forms, rebar, gravel, and other construction materials shall be removed from the 50-foot buffer.
As it is not possible to restore the natural vegetation that previously existed, plantings to satisfy the
Full Landscape Buffer requirements of the Zoning Ordinance shall be implement. A Full Landscape
Buffer will require: a minimum landscape density of three (3) plants per ten (10) linear feet; at least

three (3) species of plants with a minimum caliper of 2 inches at time of planting; and a majority of
the plantings being evergreens and at least one-third (1/3) being deciduous. A landscape plan should
be submitted to this department and approved prior to installing the plantings.

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on February 6, 2001. This site plan, for the addition of a canopy over an existing
loading dock, meets all County requirements for development within the MI (Light, Industrial)
Zoning District. The canopy does not increase the number of employees. Therefore, no additional
parking or landscaping is required for this site improvement.
I have provided you with several copies of the approved site plan. Please forward these approved
plans to the owner and advise the owner to keep an approved copy for their files. Furthermore, the
owner should ensure that an approved copy is maintained on the construction site throughout the
development process. Once site development has been completed, the owner should contact this
office to schedule an on -site inspection.

Dear Ron:
The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on March 28, 2000. This site plan, for the expansion of an existing manufacturing and
warehouse facility, meets all County requirements for development within the MI (Light Industrial)
Zoning District. This site plan allows for the construction of a 4,998-square-foot addition to the existing
building. Parking for the site has been increased accordingly, providing a total of sixty-one (61) spaces,
including three (3) handicap accessible spaces. Adequate perimeter and interior landscaping have been
provided. In addition, a sloped embankment has been supplied along the eastern property line to mitigate
the impacts of car headlights.
I have provided you with several copies of the approved site plan. Please forward these approved plans
to the owner and advise the owner to keep an approved copy for their files. Furthermore, the owner should
ensure that an approved copy is maintained on the construction site throughout the development process.
Once site development has been completed, the owner should contact this office to schedule an on -site
inspection.

We've revised the plans per your comments of 3-22-00. The changes are:
1. We've clarified that the required parking includes 1 1 office and 49 employee spaces for a total of
60. The ADA requires 3 of these to be handicapped accessible. We provide 61 spaces, 3 of which
are ADA compliant.
2. We've added one white pine.
3. We've revised our summary to indicate no loading space is required.
4. We've extended the concrete at the 6 space area to the flume, and added a walkway along the length
of the new parking area.
5. We've adjusted the perimeter calculation and provided an additional tree.

Dear Ron:
I have had the opportunity to review the revised plan submitted to our department on March 15, 2000. The
following comments should be addressed and included in a revision of this site plan.
Please note that one parking place is required for every 250 square feet of office space. Therefore, the
number of spaces required to accommodate the office use is eleven (11), resulting in a total of sixty-
three (63) required spaces. Furthermore, please note that a total of sixty-one (61) parking spaces have
been provided whereas the site plan indicates that sixty-three (63) have been provided.
2. Please note that the site plan shows four (4) white pine trees whereas the plant schedule indicates that
there are five (5).
Based on the existing information, it does not appear as though a loading space is required. However,
the project summary states that one loading space is required.
4. Please consider extending the 4 ft. sidewalk past the concrete flume in the row of six new parking
spaces near the entrance. In addition, please provide sidewalks to the new parking areas to facilitate
the safe and efficient movement of pedestrians and vehicles.
5. The modified parking configuration results in approximately forty-three (43) feet of additional parking
lot perimeter. Therefore, one additional shade tree will be required.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained
on the plan. I will then need all approved review agency comment sheets and five copies of the final site plan
for approval. A comment sheet is required from the Frederick County Sanitation Authority.

I spoke to Mike Ruddy yesterday. He indicated a 5 foot wide island would be acceptable. We've revised the
plan further to meet this interpretation of the ordinance.
A copy of the revised site plan is enclosed. I believe all of your previous comments have been addressed. As I
mentioned previously, Datalux would like to get started as soon as possible. In fact I understand they will
obtain the Land Disturbance Permit next week. So, anything you can do to move the approval process along
would be appreciated.
I've attached copies of all review agency approvals but FCSA. I expect to get that early next week. The
boundary line adjustment plat is also provided.

We have received your revised site plan dated February 28, 2000 for the
referenced project. It appears all of our earlier review comments have been
satisfactorily addressed. Please advise the owner of our approval. Also please
provide seven (7) sets of approved construction plans with signed seal for
VDOT distribution.
The appropriate land use permit may now be applied for to cover work within
the Route 990 right-of-way. The permit is issued by this office and will require
a minimum processing fee, surety bond coverage, and the salary & expenses of
a State assigned Inspector.
Once satisfactory application has been made, a permit will normally take
approximately thirty days to process and issue. Should you have any questions,
do not hesitate to call.

I've attached a complete site plan application for a 4998 sq. ft. expansion at the Datalux site at 155 Aviation
Drive. As this is an expansion of less than 5000 sq. ft., the minor site plan fee of $500.00 is also provided.
Just recently, a boundary line adjustment with the Henzel property was completed. This additional area
allowed Datalux to both expand its facility and provide the necessary parking area to serve its employees.
Datalux is anxious to move forward and will be looking for issuance of the necessary land disturbance and
foundation permits in advance of final site plan approval.
