SITE PLAN CHECKLIST
The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

agencies prior to final site plan approval. It is recommended that applicants contact

Agreement for the Installation of Traffic Signal
WHEREAS, Space, LLC is constructing Trex Center in Frederick County, Virginia at the
intersection of Exeter Drive and Route 522 and,
WHEREAS, during the traffic and engineering review of plans for the Trex Center zoned
B2 to determine what traffic control measures would be necessary at the intersection of Exeter Drive
and Route 522, and,
WHEREAS, it is recognized traffic projections are to be used in determining whether or if
signalization may be required and actual traffic conditions may vary which may influence the need
for a traffic signal for a business development of this size,
IT IS THEREFORE AGREED:
1. The Department of Transportation will not require the developer to have a traffic signal
installed as a condition of the initial entrance permit.
2. The Department of Transportation will secure actual traffic counts after the business is open.
If at that time or at any time for a period of five (5) years after the business is opened the
Department determines a signal is warranted based on the traffic volumes, generated from
Trex Center, or other condition(s) as outlined in Section 4C-2 "Warrants for Traffic Signal
Installation" of the Federal Highway Administration's 1988 Manual on Uniform Traffic
Control Devices, during that five (5) year period, a signal shall be installed. In this event,
3. Space, LLC shall pay for 50% of design, materials and installation costs to provide a traffic
signal at the intersection of Exeter Drive and Route 522 as described above, the actual
process of design and installation to be on an accounts receivable basis or under permit as

may be agreed upon by Space, LLC and the Department of Transportation at the time the
need for a signal is verified.
4. If the need for a traffic signal is verified, it shall be designed and installed in accordance with
the Department of Transportation specifications and will become the property of the
Department of Transportation upon completion.
5. Space, LLC shall furnish a surety bond or letter of credit acceptance to the Department of
Transportation in the amount of $50,000.00, which is 50% of the total estimated cost of the
traffic signal, the bond or letter of credit to be in force for the five (5) year period described
above, to guarantee the installation of the signal in the event such installation is required.
Under no circumstances will Space, LLC be required to pay more than $50,000.00 under the
terms of this Agreement.
6. The Virginia Department of Transportation agrees if additional development by others occurs
at this intersection within the prescribed five (5) year period, which would hasten or
otherwise affect the need for a traffic signal at the location, the Virginia Department of
Transportation will re-evaluate the aforementioned 50% cost sharing agreement with Space,
LLC and the terms of this agreement may be reduced at the reasonable discretion of the
Department of Transportation.
7. Future Need for Signal: VDOT shall have the option to renew the foregoing five (5) year
period, for an additional five (5) years, should impacts from this development at the
intersection of Exeter Drive and Route 522 demonstrate said need.

All drafts must bear the clause "Drawn under Wachovia Bank, N.A. Letter of Credit No. LC874-126653, dated March 28, 2001."
We hereby engage with drawers, endorsers and bona fide holders that all drafts drawn in compliance with the terns of this Credit shall be duly
honored upon presentation and delivery of this document. This Irrevocable Letter of Credit shall remain in full force and effect for a period of five
(5) years from the date issued to guarantee the installation of the signal in the event such installation is required.
Except as otherwise expressly stated herein, this Credit is subject to Uniform Customs and Practices for Documentary Credits (1993 Revision),

As discussed and concluded during our meeting Monday, April 16, 2001, progress on completing
millwork, carpeting and final inspections culminating in an Occupancy Permit have not been
accomplished as planned.
In the best interest of the Owner, we respectfully request the completion date be extended until April
30`h. The need for the Owner to deliver and install shelving and store books in the meeting room can
be accommodated as directed in the specifications and as discussed,
We regret this delay but to rush the finishes at this point, we all agree, may result in an undesirable
product and is not to the Owner's advantage,

Dear Jeremy,
We would like to have site inspection on Thursday, April 12, 2001. Be. advised that there
will be several items incomplete as listed below.
1 . The front entrance sign is being held up for Trex approval.
2. The seeding and planting will be complete by April 27, 2001,
except at the corner for tenant construction. Please see the
attached letter from Boyer Landscapes, Inc.
Total value $23,501.00 and is on going.
The tenant construction planting will be done in September 2001.
The value $1483.00
3. A flag pole will be added later.
4. The trash gate will be completed by April 20, 2001.
The value $800.00
5. The ramp hand rails will be going in place and complete Friday,
April 13, 2001.
If the weather holds, we will have all asphalt paving and handicap parking complete
Thursday noon.

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on May 19, 2000. This site plan, for the construction of a 60,000-square-foot office
complex meets, all County requirements for development within the B2 (Business General) Zoning District.
A total of two -hundred -forty (240) parking spaces have been provided, including eight (8) handicap
accessible spaces. Adequate perimeter and interior landscaping have been provided. In addition, a 3-foot
high berm has been supplied along the southwestern property line to mitigate the impacts of car headlights.
Finally, a waiver of the minimum spacing requirement for new entrances was granted by the Planning
Commission on May 3, 2000 to allow the Trex entrance to be placed 9 P from an existing residential
entrance to the south.
I have provided you with several copies of the approved site plan. Please forward these approved plans
to the owner and advise the owner to keep an approved copy for their files. Furthermore, the owner should
ensure that an approved copy is maintained on the construction site throughout the development process.

March 22, 2000. The following comments should be addressed and included in a revision of this site
plan. I have also marked the enclosed plan for your use.
Please provide the current use of all adjoining properties. In addition, the parcel identified
as 42-A-C 1 should be labeled as 42-5-C 1. Likewise, the parcel identified as 42-A-C2 is 42-5-
C2.
2. Please extend the front sidewalk to accommodate the seven spaces on the side of the building.
Please refer to the mark-up plan for details regarding the location of the sidewalk.
3. Please ensure that all proposed signs meet the requirements of Section 165-30 by providing
a statement to that effect.
4. Please ensure that number 12 of the general notes reads as intended. FBMA maps designate
areas of minimal flooding as Zone C.
5. Please provide a statement ensuring the underground placement of all new utilities.
6. Please note that only 230 parking spaces have been provided. As indicated by the parking
space requirements on Sheet 1, at least 240 spaces must be provided.
7. The interior landscape calculation is based on 240 spaces. However, Sheet 1 indicated that
244 parking spaces will be provided. Please ensure that the parking calculations are
consistent with the landscape tabulation.

I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer With the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
• Materials used and method of construction shall apply to current observed VDOT
Road & Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to
the satisfaction of the Department prior to inclusion into the Secondary Road
System.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for inspections.
• The appropriate land use permits shall be obtained before any work is performed on
the State's right-of-way. The permit is issued by this office and will require a
minimum processing fee, surety bond coverage, and the salary & expenses of a
State assigned Inspector.

Any entrances (CG-11) constructed from the referenced street(s) shall meet VDOT
minimum standards. This is the developer's responsibility.
suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the
possibility of any pavement settlement.
As indicated in previous review comments, the developer should prepare and
present an agreement to pay 50% of the cost for design, material and installation of
a traffic signal at the intersection of site entrance with Route 522 (North Frederick
Pike), if the warrants are found to exist through VDOT traffic counts. An example
agreement is attached. The agreement should be presented to VDOT prior to
issuance of a land use permit.

Upon review of the subject site plan, we offer the following comments:
1. Place a note on the plan indicating that a land disturbance permit shall be obtained from
the public works department prior to initiating site grading work and a pre -construction
meeting shall be held on -site with the our department and the contractor.
2. Place a note on the plan indicating that the installation of the by-pass storm sewer system
shall be part of the first step in site grading in conjunction with the proposed sediment
pond and sediment trap. The proposed pond is not sized to detain the run-off generated
off -site.
3. We recommend that the inlet elevation of the proposed stormwater pond be at the bottom
of the pond. The plan indicates that the invert of the eight (8) inch inlet is 0.35 feet off the
bottom of the pond. Once the sediment riser is removed when the site is stabilized, water,
would remain standing in the pond. Also, we recommend that the bottom of the pond have
a minimum slope of one (1) percent to reduce the risk of ponding water.
Once these comments are addressed, submit two copies of the site plan for further review.
