The checklist below indicates all the information=that needs to be -submitted as part of the site plan
application. All required information must.be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Hello Patrick,
I have recieved and reviewed drawings for the Airport Road
relocation in front of the AMK building. The plans show the existing
fire hydrant being relocated to the entrance at AMK. This hydrant was
not shown on the original site plan submitted by Mr. Max Kotlowski from
a few years ago. The relocation of this hydrant meets the 300 ft.
distance requirement and can replace those shown on thier original
plans.

I've attached five copies of revised sheets 2 and 3 of the AMK site plan. The commercial entrance on Airport
Road has been shifted to the western property line. VDOT has approved this layout and FCSA has provided

Enclosed are drawings illustrating the staircase and ladder we have chosen for our
mezzanine access. The manufacturer describes the staircase: as a "BOCA" staircase.
Please let me know if this appears to be acceptable.
Our project include: asphalt in the parking for and around the building. On Monday I
spoke to the site contractor about application of the asphalt. He strongly suggested
saving this work for the spring due to the cold. VDOT for example requires 50" and
rising temperatures. He said that application of asphalt now could easily result in
problems due to settling of the frozen ground (our parking lot is on the North side).
Apparently this is one of the reasons the asphalt plants close about this time of the
year, We will have a much better and longer lasting surface if the gravel base is
allowed to settle properly and the asphalt is appliod during warm weather,
Would we be allowed to take occupancy with the gravel base in place ?
Restroom lights. We have wet location light fixtures in the showers, are wet location
fixtures required in the remainder of the restroom 'r I` jet location is not required can
we use track lighting ?

Developer, or his agent to comply with said ordinance as a condition of the approval of the
subdivision or site plan to the satisfaction of the Zoning/Subdivision Administrator."
We hereby engage with drawers, endorsees and bona fide holders that all drafts drawn in compliance
with the terms of this credit shall be duly honored upon presentation and delivery of the above
documents. This Irrevocable Letter of Credit shall remain in full force and effect for a minimum
of one (1) year from the date hereof and shall be automatically extended for additional terms of six
(6) months from the present or future expiration dates, unless sixty (60) days prior to such date or
dates, the above named bank or financial institution issuing the instrument, notifies the County in
writing by certified mail, that they elect not to renew the instrument for such additional period.
During the last thirty (30) days while this Letter of Credit is in force and effect after notice of
termination has been given, the County may draw up to the full amount of the sum when
accompanied by a document stating that has
failed to provide an acceptable substitute Irrevocable Letter of Credit or deposit in escrow, and a
document stating that "The drawing will be held by the County for the sole purpose of providing for
the completion and/or maintenance of the site plan and/or subdivision requirements to the satisfaction
of the Zoning/Subdivision Administrator or his authorized representative." This credit shall be
terminated upon the Zoning/Subdivision Administrator or his authorized representative giving written
release to (Permittee or Developer)
stating that they have satisfactorily performed and fulfilled the obligations and requirements of the
subject site plan or subdivision.

SUBJECT: AMK Revised entrance location and parking note

Entrance location -The proposed entrance to the AMK site has been shifted slightly to the west. The
entrance has been approved by VDOT, and it meets the requirements of Section 165-29.A.(6) which
specifies that spacing for business and industrial entrances on major collector roads be spaced at least
150' apart. The closest existing entrance is 180 feet away.
Parking -The owners wish to eliminate one of the handicap spaces, leaving just one handicap space.
This is acceptable because the requirement is for only one space based on the total number of spaces.
In addition, the area allotted for two spaces in front of the residence will not be striped. Therefore,
the total number of striped spaces is ten. As shown on the original approved site plan, the parking
area is to be asphalt.
The owners also wanted to double prime and seal the loading area and travel aisle to the loading area.
Staff advised the owners that this was possible if curb and gutter were applied to front parking area
of the site. Staff also advised the owners that curb and gutter should be shown on the site plan, if
they were going to make this change. The owners did not wish to go through another site plan
revision to show the curb and gutter. Therefore, the asphalt surface shown on the originally approved
plan applies to both the parking and loading areas.

(1) year from the date hereof and shall be automatically extended for additional terms of six (6) months
from the present or future expiration dates, unless sixty (60) days prior to such date or dates, the above
named bank or financial institution issuing the instrument, notifies the County in writing by certified mail,
that they elect not to renew the instrument for such additional period. During the last thirty (30) days
while this Letter of Credit is in force and effect after notice of termination has been given, the County
may draw up to the full amount of the sum when accompanied by a document stating that

The two hydrants required 800' of pipe (see site plan), one hydrant would require
600' of pipe. Installing one hydrant should cost at least a proportionate 25% less.
The Pine Knoll quote of $17,655 less 25% equals $13,241.
This is a generous figure because it discounts the hydrants by only 25% instead
of 50%.

Since we are living at the game location we would also like something nice to look at.
So below is what we would like to do to integrate the Screening and the Hedge to create an
aesthetically pleasing view from both sides. This dif fens only in placement, we would still be
maintaining the overall concept.

We are talking with several Landscapers in the area and they are suggesting 3-4 ft. high
trees will take better in our soil and be hardier in the long term. I understand the Hedge is
suppose to be 6 ft. & opaque forpday one - this may be hard to achieve. If I crowd the trees
they will not grow full (thick) and will have to be thinned in c couple of years. Where as if we
plant 3-4 ft trees at first with the right spacing in several ,years we could have nicely filling out
and a healthy Hedge with out having to thin out any trees.

adjoining property line, as shown in the example diagrams.'
(1) Inactive distance buffer. This portion of a buffer area permits no
activity except the necessary utility functions provided by
transmission lines, underground conduits, etc.
(2) Active distance buffer. This portion of a buffer area may not be
encroached by a building or other principal structure or activity.
However, accessory activities, such as parking, are permitted in
this area. Active buffers shall not contain road rights -of -way.
Adjacent structures shall be considered structures on the same
or abutting properties or structures in the same general vicinity.
(3) Wherever proposed developments are adjacent to or within 1,000
feet of the boundaries of existing uses, the Planning,.Commission
may require increased or additional distance buffers t arate
different uses to achieve the intentions of this section.
B. Screening. Screening is designed to work with distance buffers to
lessen the impact of noise or visual interaction between adjacent
activities. There are two levels of screening: landscape screening and
full screening. The higher the level of screening provided, the lower
the level of distance buffer required. The example diagrams show how
this works.2
(1) Landscape screening. A landscape screen consists of a totally
landscaped easement at least 10 feet in depth. Within the
easement, there shall be a minimum landscaping density of three
plants per 10 linear feet, and they shall be at least four feet in
height at planting and intended to reach a minimum height of six
feet at maturity. There shall be at least three species of plants,
with the majority being evergreens and at least 1/3 being
deciduous. Where natural barriers, topography or other features
achieve the functions of the landscape screen, the requirement
may be waived by the Planning Commission.
-�—(2) Full screen. A full screen provides all the elements of a landscape
screen and also includes a six -foot -high, opaque hedge, fence,
wall, mound or berm. A woodland strip of 50 feet may be allowed

as a full screen. As with landscape screens, if natural barriers,

screen, the requirement may be waived by the Planning
Commission, and the requirement may be changed to maintain
highway sight distances.
(3) Wherever proposed developments are adjacent to existing uses,
the Planning Commission may require additional landscaping or
landscaped easements to separate different uses and to achieve
the intentions of this section.
C. [Amended 5-11-19941 Residential separation buffers. Perimeter and
interio residential separation buffers shall be established to
adequa ly buffer single-family detached traditional and cluster
dwellings from other housing types. The function of the perimeter
separation buffer shall be to adequately separate different housing
types within adjoining developments, while the interior separation
buffer shall adequately separate different housing types within mixed -
use developments. The requirements for perimeter and interior
residential separation buffers are as follows:
(1) Perimeter single-family separation buffers
(a) [Amended 10-27-1999] Wherever possible or practical,
single-family detached traditional, urban, cluster and single-
family zero lot line and single-family small lot housing shall
not be placed adjacent to other residential lots or structures.

The Frederick County Fire Marshal has agreed to allow the AMK site to develop without installation of the fire
hydrants. I've attached a copy of Tim Welsh's letter of 12 July 2000 for your reference. We've revised the
plan, adding a note indicating that the water improvements may be delayed 2 years. The Fire Marshal did
require that an onsite water source be provided in the interim.
By copy of this letter I am requesting the Fire Marshal and FCSA to comment on this new arrangement.
Will we be required to submit a formal site plan revision request with application and $500 fee?

The purpose of this memo is to record the allowed modifications to the AMK site plan. Specifically,
a double prime and seal treatment is going to be permitted on the entrance driveway that traverses
airport property. The asphalt treatment shown on the site plan still applies to the site itself. That is,
the parking, loading, and travel aisles for the AMK property will be asphalt as detailed on the plan.
Allowance for this modification was approved by the Department of Planning and Development
Director on August 18, 2000. In light of the fact that airport road will eventually be relocated and
because the site is not included in a master development planned industrial park, these allowances
were made. Additionally, this information was relayed to the contractor on August 21, 2000. It has
been made explicitly clear that the double prime and seal treatment is to apply only to the access road.

In reference to our conversation on July 11, 2000, the proposed Phase I building for
AMK Products at 800 Airport Road, the site plan indicated an 8" water line in excess of 600'
from the existing Airport Road. Additional piping for two hydrants on the site provides fire
protection for the buildings. In a discussion with Max Kotlowski, he indicated the County code
required the piping to be installed.
However, on their site plan, there is indication of a future entrance by Virginia
Department of Transportation, which makes it much closer to their property. The relocation of
Airport Road is going to include the relocation of utilities. A water line should be run along that
same area which will save approximately 500' of 8" water line, which would be a cost savings to
the building owner. Our original discussion with Max and Lisa Kotlowski was for an on site
water supply to be maintained for fire department use. As this building is not sprinklered, their
proposal was to install an above ground water tank with fire department connections containing
several thousand gallons so that immediate water was available.
In reviewing this proposal we found that the fire department would be able to utilize this
water supply but only for a short amount of time. Ultimately fire hoses would have to be laid
back to the existing Eire hydrant at the existing entrance to this property. This would create an

extensive amount of wasted money for the property owner to install this water line and then have
the roadway placed in front of their property at a much closer distance.
We had a discussion with the primary response lire department to determine if this
situation can be delayed for the installation of the fire hydrant. This will be possible as long as
emergency vehicle access is maintained through the existing entrance and the future entrance by
VDOT during the road construction is maintained to allow access to the existing hydrants. I
have received a letter from Max Kotlowski indicating if the road was not moved within 24
months or was seriously postponed that they would agree to install a line of hydrants as proposes
on the plan.

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on June 21, 2000. This site plan, for the construction of an industrial manufacturing
and warehouse facility, meets all County requirements for development within the M 1 (Light Industrial)
Zoning District. Specifically, this site plan allows for the construction of a 12,000-square-foot building.
In addition, an existing residence will remain on site for the owners to occupy. Parking for the site consists
of eleven (11) spaces for the industrial component and two (2) spaces for the residential component. A full
screen buffer, consisting of six -foot -high evergreen plantings and a 10-foot-wide landscaped buffer, have
also been provided.
I have provided you with several copies of the approved site plan. Please forward these approved plans
to the owner and advise the owner to keep an approved copy for their files. Furthermore, the owner should
ensure that an approved copy is maintained on the construction site throughout the development process.
Once site development has been completed, the owner should contact this office to schedule an on -site
inspection.

I've attached revised plans for AMK Industries. The changes include:
1. Addition of new residential service to the residence and clarification that the sewer service
from the house needs to be rerouted to the new pump station location.
2. EC-1 and ES-1 details have been added to sheet 5.
3. A note indicating the master plan has been waived is provided.
4. The proffer statement has been clarified to indicate funds for fire and rescue are required for
each building permit application.
5. The residential use to the east has been noted.
6. The note regarding conversion of the residence to office use has been amended to note that
any increased parking requirements will need to be addressed.
7. The parking calculation has been adjusted to show 12 required spaces.
8. All driveway areas are shown to be paved. The temporary access has been removed.
9. The category C buffers have been amended to reduce the length required.
I believe all agency comments have been addressed. Please forward indication of final approval so that

I have had the opportunity to review the revised site plan submitted to our department on March 1,
2000. The following comments should be addressed and included in a revision of this site plan.
�1. Please provide a note on the site plan which states that as allowed by Section 165-123.B. of
the Zoning Ordinance, the Director of Planning and Development has granted a waiver of the
Master Development Plan requirement.
�2. Please note that the proffer amount stated in note number six applies only to Phase I building.
Please insure that additional moneys shall be proffered for Phase II by providing a note to that
effect.
,/3. Please insure that all adjoining property owners and uses are correctly identified. Please refer
to the enclosed copy of the boundary line adjustment involving this parcel.
V/4. Please note that 600 ft. of office space results in the need for three (3) parking spaces rather
than two (2) as stated in the project summary. Therefore, the total number of spaces required
is twelve (12).
i5. Please modify the statement in the project summary regarding the use of the residence for

We have revised the AMK Industries site plan. I've attached one copy here for your approval. The changes
include:
1. The monetary proffer for Fire and Rescue associated with the rezoning is listed on sheet 2.
2. The use, zoning and property identification number for all adjoining properties are shown. A
reduced scale plot of the property boundary is provided on sheet 3. The adjoining owners to the
south and southeast are shown there.
3. The front set back has been adjusted to 75 feet and we've edited the note regarding the dumpster
fencing.
4. We've broken down the building uses and associated parking requirement. Please note the
employee totals are for the fully developed site.
5. An existing entrance to the west of our site is shown. There is no entrance within 200 feet to the
east.
6. We've shown a 24 foot wide driveway access from Airport Road back to the site.
7. Fire lanes have been delineated.
8. The prime and seal surface has been extended from the VDOT CG-I I entrance on Airport Road
back to the end of the driveway east of the building. The loading area behind the building will
remain aggregate surface only.
9. We've revised the required landscaping percentage.
10. We've provided the six foot high opaque fencing in addition to the landscaped screen. The buffer
has also been extended along a portion of the northern property line.
11. Our landscaped screen detail provided an average of 3 plants per 10 feet. We've tried to give the
Leyland Cypress a couple more feet of width in order that they may be allowed to spread out.

We are currently revising our site plan for AMK Products per your and other County agency comments. While
those technical changes are in progress, we'd like to get a clarification on a few issues.
1. Master Development Plan. We have submitted a letter to Mr. Kris Tierney asking that a waiver for
the Master Plan be granted for this parcel. It should be pointed out, however that since a
subdivision of the property had already been approved without a Master Plan, such a waiver must
have previously been granted. If the subdivision did not require a Master Plan, we can not
understand why one would be required here.
2. Driveway Access. This lot was created to allow the relocation of Airport Road. Our site plan
provides for a future CG-11 entrance when that relocation occurs. The access across the Airport
Road property is temporary. You can understand the developer's reluctance to expend resources on
a roadway which will be removed.
3. Planning Commission Comments. We've reviewed the meeting minutes which you kindly sent
along. I'm not sure what comments you would like us to address. We will add a note addressing
the proffered payment to Fire and Rescue.
Before we can finalize our revisions, we will need answers to these questions. Please call to discuss or let me

Please submit either a Master Development Plan for this property or a request for waiver of

2. Please ensure that the engineer's certificate is signed on all final site plan submissions.
3. Please provide a listing of all conditions placed on this site as a result of Rezoning Application

Please provide more information regarding the proposed use of the buildings for each phase
of site development (office, warehouse, etc). Clearly delineate the square footage of each use
within the building footprint and provide adequate parking according to each use.
Furthermore, please specify whether the existing residence will be utilized for office purposes
and delineate the floor area associated with this use.
9. Please show all existing entrances located within 200 ft. of the planned entrance.
10. In accordance with Section 165-27.E(7), please note that the width of driveways serving
parking lots shall be 24' in width for two-way traffic. Therefore, the existing gravel access
road must be paved and must be a minimum of 24' in width.
11. Please delineate the location of all fire lanes on the subject property in accordance with the
requirements of the Fire Marshal or provide a statement which addresses this requirement.
12. Please provide a parking calculation which addresses the site development of Phase I.

17. Please insure that the buffer key is correctly labeled to reflect the Category C Buffer

Rezoning Application #04-99 of AMK Products, Inc. submitted by G. W. Clifford & Associates, Inc. to
rezone 7.354 acres from RA (Rural Areas) to M1 (Light Industrial). This property is located on the
south side of Airport Road (Rt. 645), approximately 300 feet west of the intersection with Victory Road
(Rt. 728), and is identified with P.I.N. 64-5-4 in the Shawnee Magisterial District.
Action - Recommended Approval with Proffers
Commissioner Wilson said that he would abstain from discussion and voting on this rezoning
application, due to a possible conflict of interest.
Mr. Evan A. Wyatt, Deputy Planning Director, read die background information and review
agency comments. Mr. Wyatt said that this rezoning request is consistent with the policies established in the
Comprehensive Policy Plan and is in conformance with the development patterns depicted in the Route 50 East
Corridor Land Use Plan and the Airport Support Area. He continued, stating that the language within the
proffer statement mitigates the impacts that would be realized by the Fire and Rescue Services, and the
monetary amount slightly exceeds the impact demonstrated by the results of the Capital Facilities Impact Model
run.
A member of the Commission inquired if any other party had proposed to participate in the
construction of the relocation of Airport Road (Rt. 645) and, also, if the proposed lot would have access to a
state -maintained road. Mr. Wyatt replied that this road was identified in the County's Capital Improvements
Plan (CIP); money has been secured from the FAA, as well as State funds and some local contributions that
will be used for the engineering, the right-of-way acquisition, and the construction element. Mr. Wyatt stated
that at this point in time, the money provided through the CIP is for design and right-of-way purposes; the
construction element is still outstanding. He said that this is not on the County's Secondary Road Improvement
Plan. He said that the airport, through their CIP, would relocate the road; however, it should be noted that all
they are doing is simply relocating the existing road right-of-way. It will be the same two-lane segment that
is currently existing on Rt. 645. Mr. Wyatt added that the property would have access to a state -maintained
road because the property in front was secured by the airport.
Mr. Stephen M. Gyurisin with G. W. Clifford & Associates, Inc., the design engineers for this
rezoning application, along with the owner of the property, Mr. Randolph E. Rodgers, Jr., were present to
represent AMK Products, the applicant. Mr. Gyurisin stated that AMK Products is a company from Oklahoma

that is relocating its operation to Frederick County. He said that the site plan will show all site improvements
and will address the concerns raised about access to existing or future Airport Road. He added that AMK
Products is proposing approximately 15,000 square feet of distribution space and they plan to employ 15
people.
Another question from the Commission concerned how the applicant planned to address
potential traffic impacts. Mr. Gyurisin replied that when they prepare the site plan, once they know exactly
the size of the facility, they will prepare a traffic study and analysis for VDOT; this will be submitted to the
Planning staff for review. Mr. Gyurisin envisioned they would initially have access from existing Airport Road
via a 60' right-of-way provided by the airport; they would be looking at a driveway situation across the two
acres owned by the Airport. He said that once the new road is implemented, they would anticipate a permanent
situation and they would provide whatever VDOT required. Mr. Gyurisin added that they would install a
standard commercial entrance and would align it with any airport entrances.
Chairman DeHaven called for public continent, but no one came forward.
No other issues of concern were raised by the Commission.
Upon motion made by Mr. Thomas and seconded by Mr.Ours,

Mr. Eric R. Lawrence, Zoning Administrator, stated that a master development plan would
not be appropriate, nor apply to this site because there are no plans for internal road circulation or storm water
management. Mr. Lawrence said that the staff had a concern with the access onto Shady Elm Road and
discussed establishing possible easements to limit the number of entrances. He said that staff is recommending
that Lots 1 and 2 share an entrance and it should align with Industrial Drive. Lots 3, 4, and 5 should share an
