application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).

Phis is to follow-up on our conversation several months ago. The auto dealership under construction on
Route 1 I South by the Millers does not have water and sewer- service available from the Authority in
accordance with their current site plan.
When the original st'ucturc was built about Iiftccil years ago, the Millers refused to dedicate the water and
sewer lines on their property to the Authority. Thus the lines serving that property are privately o\Viled.
Now that the property has been subdivided, the Authority refuses to allow service to the new dealership
until the existing lines are dedicated to the Authority in accordance with the standards and regulations of
the Authority. I shall inform you when such service is available.

Dear Tim:
The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on October 30, 2003. The site plan is approved for the construction of a used car
sales and service facility on the same parcel as the existing car dealership. The property is located within
the Shawnee Magisterial District.
The proposed building will be 11,485.44 square feet in area. The required 94 parking spaces are
provided. However, a total of 499 parking spaces are proposed in all. The majority of these spaces will
be for automobile display purposes. Landscaping, curb & gutter, sidewalks, handicap access, striping,
fire code improvements, storrnwater improvements, loading spaces, a fully screened dumpster, two front
display areas, and a 24 foot driveway will also be provided with this development.
I am providing you with three (3) copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the development
process. Once site development is complete, the owner(s) should contact this office to schedule an on -
site inspection. Do not hesitate to contact me if you have any questions or concerns.

The interior floor drainage trench and pipe system shall be trapped and have an approved grease
oil separator installed in accordance to the International plumbing Code. The discharge through
the storm water system shall be approved by the Virginia Department of Health prior to permit
issuance for the system.

We have received your revised site plan dated October 7, 2003 for the referenced project. It appears all
of our earlier review cormnents have been satisfactorily addressed. Please advise the owner of our
approval. Also please provide six (6) sets of approved coustructiou plans with signed seal for
VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 11 (Valley Pike)
right-of-way_ The permit is issued by this office and will require a minimum processing fee, surety bond
coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all recorded plats of
dedication for drainage easements or additional right-of-way required for implementation of this
proposed project should be provided to VDOT prior to issuance of any land use permits. Dedication,
should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty days to
process and issue. Should you have any questions, do not hesitate to call.

Thank you for the submission of the above -referenced site plan. Below is a list of Staff s comments
regarding the proposed development on the above -referenced property. Please review these comments
and prepare a revised site plan which adequately addresses each.
Review Comments:
1) Vicinity Map. Please provide a scale for the vicinity map [165-146]..
2) Handicap Parking Spaces. A parking lot containing 499 parking spaces requires nine handicap
parking spaces, not two. Please corTect your handicap parking calculations and provide handicap
spaces as necessary [165-27 E(6)].
3) Main Travel Aisle. Please widen the primary travel aisle to 24 feet. This is the travel aisle
which will provide two-way access to each proposed phase of the development [165-27 E(7)].
4) Loading Spaces. Please provide loading space calculations and the required loading spaces on
the site plan [165-28].
5) Total Impervious Area. Please note that the building structures area does not need to be
included in the total impervious area for landscaping purposes [165-27 E(11)]
6) Tree Species. A Hedge Maple is not an acceptable tree species for required parking lot
landscaping[]65-36 BJ. I would suggest that you use a Japanese Maple (Acer palmatum), Red
Bud (Cercis canadensis), or another acceptable small tree.

7) Hedge Row. Please provide an evergreen hedge row in fi-ont of the parking bays that face Valley
Pike (Route 11). Acceptable shrub species can be found in Section 165-36 B, of the Frederick
County Zoning Ordinance. The required size at planting is based on container size. Three -
gallon container size is the minimum.
8) Wetland Plant List. Please explain the purpose of the wetland plant list. Also, only a few of
these proposed plants are shown on the landscape plan.
9) Overall Layout Plan & Phase M. Please provide a statement on Page 3b/l0 to clarify that this
site plan does not approve Phase III, and that a separate site plan will need to be submitted for
this phase in the future. I would also note that it may be beneficial to modify the landscaping
plan so fewer trees will need to be removed when Phase III is constructed.
10) Parking of Cars in Main Travel Aisle. There appears to be an area along the left side of the
travel aisle which may be intended for display. Please clarify the intent of this area and label all
proposed display areas on the site plan. No vehicles shouldbe parked in required travel aisles.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will need. all approved agency comment sheets from the Fire Marshal, Public
Works, Airport Authority, Sanitation Authority, Building Inspections, and VDOT. At least five
copies of the final site plan are required for final approval. Do not hesitate to contact staff, if you have
any questions or concerns regarding this letter.
