The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review

The above -referenced site plan was approved by staff on July 28, 2004. The site plan is approved
for the construction of three (3) two-story apartment buildings. A total of 33 residential units,
including the existing house on the property, are approved on this site plan. The existing trailer on
the property shall be removed. Recreational units, landscaping, screens, parking, stormwater
management, sidewalks, fire hydrants, and other improvements are provided on the site plan as
required by the Zoning Ordinance and review agencies.
I am providing you with several copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the development
process. Once site development is complete, the owner(s) should contact this office to schedule an

I have reviewed the revised site plan submission for the above -referenced project, received by staff on July
21, 2004. At this time the site plan is denied until the following comments are adequately addressed:
Review Comments:
No Accessory Structure Setback. Please remove the accessory structure setback along the right-of-
way shown as Pennsylvania Avenue. An accessory structure setback is not applicable at this
location because there is a required 35' front setback.
Owner's Sip.,nature. Please have the owner of the property sign the final copies of the site plan
before you submit the plans in for signature.
Public Works Comments. The Frederick County Department of Public Works must approve the site
plan prior to final approval by the Zoning Administrator.
Building Inspections Comments. Please provide the comments from Building Inspections which are
noted as being on the back of the comment sheet, but are not shown on the copy you provided.
After you have revised the site plan, please resubmit one copy so that I may verify the information on the
plan. Staff will need at least five copies of the final site plan for approval. Please call if you have any

We have received your revised site plan dated November 10, 2003 for the referenced project. It appears
all of our earlier review comments have been satisfactorily addressed. Please advise the owner of our
approval. Also please provide six (6) sets of approved construction plans with signed seal for VDOT
distribution.
All standard VDOT items called for on the plan sheets should be those current on the date of installation
on the project.
The appropriate land use permit may now be applied for to cover work within the Route 764, Lee
Avenue right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all
recorded plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to issuance of any land use
permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty days to
process and issue. Should you have any questions, do not hesitate to call.

not have an impact on operations at the Winchester Regional Airport since the
site falls just outside of the airport's Part 77 surfaces. However this site does lie
within the airport's airspace and residents could experience fly -over noise from
aircraft within that area.

We have received your revised site plan dated November 10, 2003 for the referenced project. It appears
all of our earlier review comments have been satisfactorily addressed. Please advise the owner of our
approval. Also please provide six (6) sets of approved construction plans with signed seal for VDOT
distribution.
All standard VDOT items called for on the plan sheets should be those current on the date of installation
on the project.
The appropriate land use permit may now be applied for to cover work within the Route 764, Lee
Avenue right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all
recorded plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to issuance of any land use
permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty days to
process and issue. Should you have any questions, do not hesitate to call.

the plan and would like you to address a few issues in a revision. I have enclosed a red -lined copy
of the site plan to clarify the concerns of staff. Please note the comments I have made below:
1. Re -label "Required Buffers" to "Variance # 17-02".
2. Provide a separate Required Buffer and Screening/Provided Buffer and Screening Table.
You may want to place this on the landscape plan, Sheet 7.
3. The required setback for accessory structures from Penmsylvania Avenue is 5 feet.
Therefore, the proposed tot lot should be relocated to conform with accessory structure
setback requirements.

COMMENTS: The Frederick County Department of GIS has reviewed the requested road names
for use in the Lee Avenue Apartments project, and has made the following determinations: (Please
refer to the attached map.)
There are two options for the structure numbering project:
1. Naming the street - the developer must submit road names) for approval and the
apartment buildings will be numbered consecutively from the new street name.
2. Demolition, structure number removal, and/or reassignment of the numbering of
the structures at the entrance of the project frontage on Lee Avenue. There are currently three
numbers assigned to these structures... residence - 151, storage shed - 153, trailer - 1.
A. The trailer is obviously being removed. Remove the number from the
storage building and then apply the following numbers:
Building A - 153 Lee Avenue
Building B - 155 Lee Avenue
Building C - 157 Lee Avenue
Please advise the Department of GIS as to the course of action that will be taken, so that either the
road name can be processed, or the numbering officially entered into the E-911 system.

Appeals at their meeting on November 19, 2002. This action grants David L. Goode a 50-foot buffer
