Please show the typical details of the proposed opaque board -on -board fences required for the road efficiency buffer and dumpster pads. 2) Mailbox Access. Staff is concerned that the proposed location of the mailbox shelter may be unsafe. Please demonstrate how vehicles and pedestrians will safely access the mailboxes at this location. A separate pull-up lane may be necessary. In addition, reasonable provisions for handicapped individuals should be considered. 3) Limited Power of Attorney. Please have the owner and your firm complete the attached limited power of attorney form. I will need all approved review agency comment sheets and at least five copies of the final plan for approval. Price On behalf of H&W Construction we've prepared plans for 64 two bedroom apartments on lot 65 of the Shawnee Village Subdivision (Approved 1 January 2002). This area was identified for this use on the Final Master Development Plan (MDP 03-01, approved 19 March 2002). Our plan shows four, 16 unit building buffer and the required 15' side and 50' rear yard setbacks. The general arrangement of these buildings was provided to the Planning Office in April of this year to verify that those locations did m fact meet the setback and buffer requirements. We were told the locations were fine, but a final site plan needed to be prepared and review agency comments obtained. We moved on to final design and submitted plans for review on 5 August 2003. We received comments from the Planning Office on 13 August 2003. One comment indicated that the 50 foot perimeter setback was applicable and not the 15 foot side yard. It was our understanding that the 50 foot perimeter setback is applicable to the entire project area as identified on our Master Development Plan. The Shawnee Village MDP shows this perimeter setback, but between the separate residential uses provides for only the interior residential screen. We asked your planner to reconsider but were told that the 50 foot perimeter setback was in fact applicable. We would like for you to look into this matter. We believe our plan is in conformance with the ordinance and the Master Development Plan. We are near to approval of the plan and release of this project to construction. Needless to say, the impact of this potential reversal in interpretation is very significant. If you would like to meet, we would be please to do so. Your questions about Staffs comments are answered below: 1) Item 3 - the approved MDP simply shows the same landscape element you show on the proposed Site Plan plus a "6' Berm, Fence, Hedge or Wall". The C opaque screen element is required. All you need to do is provide details of the proposed board -on -board fence and include it in the typical road efficiency buffer detail. 2) Item 7 - correct, it is Staffs belief that a 100 square foot sign would not be appropriate in this residential setting. Thus, we ask that you voluntarily limit the signage to a max of 50 square feet. 3) Item 8 - Ok, Caledon Court will not be a state road. A stop sign, street sign and striping still need to be provided. Please show these on the site plan. 4) Itel 11 - Yes, this is what I'm looking for. 5) Item 12 - No, the 50' perimeter setback applies to the future lot for the apartments, not the entire MDP area. The 10' interior buffer is a provision in the ordinance which allows a reduction in the required residential separation buffer only. REVIEW COMMENTS: 1) Interior Residential Screen. The lack of screening between the proposed garden apartments and the one single family lot, located to the north, is not sufficient. Please extend the proposed interior residential screen by 90 feet, the approximate width of this one lot. 2) Additional Landscaping Requirements. Section 165-36 requires additional landscaping for residential developments. If the ornamental landscaping option is chosen, this development would require tiv ee shrubs for every two units and one tree per two units. Thus, 96 shrubs and 32 trees are required in addition to the landscaping required for buffers and parking. Please adjust the landscaping plan and landscaping calculations to account for this additional landscaping. 3) Road Efficiency Buffer. Please provide an additional row of trees and a six-foot berm within the inactive portion of the proposed road efficiency buffer as approved on the master development plan. The landscaping plan and typical road efficiency buffer details would need to be changed to address this comment. Please also note that the installation of a berm would also serve to screen headlights from the parking lot. 4) Caliper. Two-inch caliper trees are the standard of the Frederick County Zoning Ordinance. Two and one half -inch caliper trees are certainly acceptable; however, you may want to change this to two-inch caliper on the plan to allow for greater flexibility during the planting process. 5) Mailboxes. In the case that a community mail box center is planned, please show this on the site plan and account for the additional pedestrian and vehicular traffic that it will generate. Review Comments for S.P. #33-03 August 13, 2003 6) Phasing and Numbering of Buildings. I suggest that you show a phasing of the development on the phasing plan, found on page five of eight. The Department of Building Inspections is familiar with the phasing of projects similar to this by identifying each building with a letter (Building A - Building D). This would also assist other departments when inspections occur. 7) Comment #9 - Signs. Please change comment number nine so the maximum size of sign permitted for the development is the same as the maximum size of sign shown on the actual site plan. Staff suggests that this sign be limited to 50 square feet in size. 8) Existing Driveway. Please label the existing driveway as Caledon Court. This is expected to be a state road in the future. Please also provide a stop sign and street sign for this road. 9) Impervious Area. Please provide the total square feet of impervious area in the project summary section of the site plan. 10) Accessory Building. Typically, the homeowners association for garden apartments requires an accessory building to store lawn inowers and other maintenance equipment. If it is anticipated that one of these buildings will be built in the future, please include it on the site plan. 11) Recreational Units. Please provide a statement which explains how the required recreational units are being met with this development. 12) Setbacks. There are two locations where an inadequate setback is provided on the site plan. The first of these is the 18.6' setback between what would be Building B and the driveway into the development. Building B is required to be at least 20 feet from this driveway. Second, the 15.6' setback between what would be Building A and the perimeter boundary line should be at least 50'. A major change in the layout of this development or the boundary line appears to be required to address this comment. I will need all approved review agency comment sheets and at least five copies of the final plan for approval.
