The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan_ It is recommended that applicants
contact the Department of Planning & Development to determine which review
agencies' are relevant to their site plan application. A list of potentially relevant

The Frederick County Department of Planning and Development administratively approved the above -referenced
site plan on December 1, 2005. The site plan is approved for the construction of a 3,876sf McDonalds located on
the development known as Kernstown Commons. The site is located on Valley Pike (Route 11) and will be
accessed off of the southernmost commercial entrance into the development. Some of the required site
improvements include the following:
Construction of a parking lot with a 55 spaces (three handicap spaces, seven spaces reserved in adjacent
parking area), including curb and gutter, landscaping, striping, sidewalks, and handicap access.
One 12' x 45' loading space.
Dumpster Pad with a six foot opaque screen.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including
review agency comments from all relevant review agencies. I am providing you with four (4) copies of the
approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the
owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the construction
site throughout the development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or concerns.

• Should any work take place on VDOT road right-of-way, the appropriate land use permits shall be
obtained before any such work is performed. The permit is issued by this office and will require a
minimum processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
• The plans for commercial entrances and improvements to U.S. Route 11, Valley Pike, need to be
reviewed and approved by VDOT. The Route 11 improvements will need to be completed prior to
occupancy of any sites at the Kernstown Commons development.

Dear Ron:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be granted.
At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as
well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments
listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Parkin2 Requirements. The parking number provided on sheet 2 for the hotel is incorrect; this is an 81
room hotel, not 65.
2) Landscapine. A tree should be placed as indicated on sheet 15; a tree from elsewhere on the site could be
relocated to accommodate this.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the
plan. I will need all approved review agency comment sheets and at least five copies of the final plan for approval.
Comment sheets are required from the following agencies: the Virginia Department of Transportation, the
Frederick County Inspections Department, the Frederick County Sanitation Authority, the Frederick County
Department of GIS, and the Frederick County Health Department.

Comment 9. Sidewalk and Hedge Row. The sidewalk needs to be shifted over to
provide for the hedge row. The sidewalk also appears to need a I -IC ramp
at the end and the crosswalk should be moved so it is adjacent to the
sidewalk.
Response 9. The Sidewalk has been shifted over to provide for the liedge row. A
HC ramp has been provided at the end of the sidewalk and the
crosswalk has been moved adjacent to the sidewalk. {Sec Sheet 41
Comment 10. Drive Thru and Signage. Label the drive thru and the gateway sign.
Also, provide a statement that the main McDonald's sign will be
incorporated into the development's monument sign and will not have an
individual freestanding sign. The note from the site plan (note 5 on sheet
2) needs to be placed on this site plan as well.

Response 11. According the Kernstoxvn Commons Site plan, the wheel stops
shown in the sheet 4 arc proposed structures. During the time of
the construction of this McDonald's site, all these Wheel stops
have to be removed. This is the reason why there is a label saying
Removc existing Wheel stops. {Sheet 4}
Comment 12. Landseapit�. As stated in comment 9, the sidewalk needs to be moved
closer to the entrance. There are also plantings shown on the sidewalk on
sheet 15. Some additional bushes should be placed in the grass area by
the parking spaces facing the building.
Response 12. The side -walk has been moved and the plantings arc shown
between the curb and the sidewalk. Additional hushes are not
provided as it is only required to avoid glare on public right -of-
ways and adjoining properties. {Sec Shcct 15}

Comment 13. Outdoor lighting. Since the McDonald's arc open late, the location and
type of outdoor lighting needs to be shown on this plan.

Comment 14. Trash Coral. The dumpstcr area is located along the entrance and is very
visible. The screening for the dumpstcr should match the IMcDonalds
facade instead of a board on board fence.
Response 14. McDonalds prefers to use board on board fence. We believe that
the landscaping proposed around the dumpstcr• arch will Provide
additional screening.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be granted.
At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as
well as all issues of the other review agencies, have been adequately addressed. Please review Staff's comments
listed below and then prepare a revised site plan which adequately addresses each concern.

McDonalds proposes a new 3876 s.f. fast food restaurant at the main entrance to Kernstown Commons. This is
Lot 6 of Kemstown Commons. One drive thru lane is provided.
All utilityextensions required are provided by the Kemstown Commons plan.
Storm sewer discharges to existing connection at Kemstown Commons STR 56. An adequate outfall is
provided. Storm controls are provided by the regional pond.
Plantings as required by the ordinance are provided.
No direct access is provided to state roads (US Route 11). All site access is to shared driveway constructed with
the plans for Kemstown Commons.

This is to acknowledge receipt of your plans as revised September 30, 2005 for the referenced
project. The plans appear satisfactory and are approved. Please advise the developer
accordingly. Since no work under this project is anticipated to take place on VDOT right-of-way,
a separate VDOT-issued land use permit will not likely be required. Please provide two (2)
sets of approved construction plans with signed seal for VDOT distribution.
I offer the following comments:
• Should any work take place on VDOT road right-of-way, the appropriate land use permits
shall be obtained before any such work is performed. The permit is issued by this office
and will require a minimum processing fee, surety bond coverage, and the salary &
expenses of a State assigned Inspector.
• The plans for commercial entrances and improvements to U.S. Route 11, Valley Pike, need
to be reviewed and approved by VDOT. The Route 11 improvements will need to be
completed prior to occupancy of any sites at the Kernstown Commons development.
