A VDOT review has been completed on the final plat dated August 17, 2006 for the referenced project.
The plat appears to reflect the information shown on the approved project plans and is therefore

approved by this letter.
The application for subdivision of this property appears to have significant measurable impact on
Route 7 Berryville Pike, the VDOT facility which would provide access to the property. This section
of street is currently not in the State's Secondary Road System. All entrance design and drainage
features must meet State requirements if the street is to be eligible for acceptance. A complete set of
construction plans will be required for review.
We are returning 5 signed copies of the plat to your office, one copy is being retained for our work file.
Please provide one copy of the plat of dedication fully signed and recorded at the appropriate
County Clerk's Office prior to the issuance of any land use permit from VDOT.

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on February 27, 2006. The site plan is approved for revisions to Site Plan # 15-05.
This site plan revision includes the following:
• Addition of a new pad site (A2 Chik-Fil-A 4,358sf). This site contains 48 parking spaces, a
dumpster area, curb and gutter and sidewalks.
• Shifting of buildings A8 and A 10.
• A sidewalk along one side of Gateway Drive.
• A new monument sign location.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with seven (7)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

Structures shall comply with The Virginia Uniform Statewide Building Code and use
group M ( Mercantile) for the retail use A (Assemble) for the restaurants and use B
(Business) for the bank, of the International Building Code /2000. Other Code that
applies is ICC/ANSI A 117.1-98 Accessible and Usable Buildings and Facilities. The
pump island and Canopy shall comply with use U (Utility) of the IBC and NFPA 30. The
location of the tanks are not shown on the plan at this time. Please indicate the tank
location, the water main, sewer main and restroom location related to the pump island
office.
Please note that the IBC requires most use groups to have fire suppression system on
areas over 12,000 sq. ft. however restaurants require systems when area exceeds 5,000 sq.
ft.
HC parking shall have a minimum van accessible spaces with a striped area of 8' wide for
unloading. Question about the lack of accessible parking spaces in the rear parking lot?
Plans summited for permit application shall be sealed by a licensed Virginia design
professional and this type structure shall require special inspection under Chapter 17 IBC.

Continent 2: Driving Lanes. Driving lanes need to be a minimlan of 24' wide: revise the driving lanes for
A-8 as indicated on sheet 7.
Response: FC Zoning ordinance Section 165-27.E. (7) Entrance Requirements state the width of driveways
serving the parking lot shall be less than 24' for two-way traffic and 12' for one —way traffic. The entrance
serving building A8 is 30'. The Aisles surrounding building A8 serving the parking space for 90 degree
parking shall be no less than 22' per section 165-27E (8).(a). Refer to sheet 7

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staffs comments listed below and then prepare a revised site plan %Nhich adequately addresses each concern.
Review Comments:

Colmnew 1: Parking Calculations. On the cover sheet under retail parking calculations, Building A-8

a restaurant use and world require 48 spaces, not 26. Also the Chik-Fil-A requires 62 spaces, not 48.
Response: As discussed in our meeting, the cover sheet has been revised to reflect the overall shopping
center total that well exceeds the required parking spaces (see sheet 1).
Comment 2: Proposed Building Dinrens•ions. On the cover sheet project information, there is a statement
that proposed building dimensimis shown all plan are approximate. The exact layout of the buildings and
site need to be provided on this plan.
Response: Revised as noted (see sheet 1).
Comment 3: Curb and Gutter. On sheet 8, there are parking spaces by the Chick-Fil-A that have
wheelstops; these parking spaces require curb and gutter. Also, it is unclear why there are wheelstops on
the opposite side oj'the building by the handicap spaces since there is curb trod gutter being provided. The
curb and gutter type (CG-6) needs to be labeled as well.

Comment 4: Labeling. There is a black dos in one of the islands by the Chik-Fil-A that needs to be labeled.

Dear Jeremy:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval
can be granted. At this time, administrative approval cannot be granted. This site plan is denied
until the issues in this letter, as well as all issues of the other review agencies, have been adequately
addressed. Please review Staff s comments listed below and then prepare a revised site plan which
adequately addresses each concern.
Review Comments:
1) Parking Calculations. On the cover sheet under retail parking calculations, Building A-8
states that 26 spaces are being provided (original A-8 had 44 spaces). Under proposed use,
this building is a restaurant use and would require 48 spaces, not 26. Also the Chik-Fil-A
requires 62 spaces, not 48.
2) Proposed Buildiniz Dimensions. On the cover sheet project information, there is a
statement that proposed building dimensions shown on plan are approximate. The exact
layout of the buildings and site need to be provided on this plan.
3) Curb and Gutter. On sheet 8, there are parking spaces by the Chik-Fil-A that have
wheelstops; these parking spaces require curb and gutter. Also, it is unclear why there are
wheelstops on the opposite side of the building by the handicap spaces since there is curb and
gutter being provided. The curb and gutter type (CG-6) needs to be labeled as well.
4) Labelins. There is a black dot in one of the islands by the Chik-Fil-A that needs to be
labeled.
5) Sidewalks. The sidewalks (including ramps) need to be provided as indicated on sheet 7 for
the relocated A-8; a crosswalk is also needed.
6) Stop Sign and One Way. A stop sign and a one-way sign need to be placed in the parking
lot of Retail A-8. A stop/yield sign should also be placed by the Chik-Fil-A as indicated on
sheet 8.

7) Hedge Row. A three foot evergreen hedge row should be placed by A-8 as indicated on
sheet 23 since this is a proposed restaurant use, so that headlights don't shine on the road at
night.
After you have revised the site plan, please resubmit one copy so'that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five
copies of the final plan for final administrative approval. Comment sheets are required from the
following agencies: the Frederick County L?sy-?ectioi?s DepQ!'Ullellt, the Frederick Comity Del)artinent
of Public Works (County Engineei), the Frederick County Fire A1larshal, the Frederick Count),
Sanilcition Aulhorlty, and the Virginia Deparlinew of Trauq)orlation.
