SITE PLAN CHECKLIST
The checklist below indicates all the information -that needs to be -submitted as part of the site plan
application. All required information must.be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Enclosed is your approved Land Use Permit #855-04422 to cover the construction and
maintenance of two commercial entrances at the referenced location.
Please ensure a copy of the approved permit assembly is kept at the job site whenever
working within the Route 645 right-of-way. I would also like to remind you of the need
to erect and maintain proper traffic control in accordance with our Virginia Work Area
Protection Manual.
For your information the account receivable number for this project is 0245 8602. Any
inspection costs we incur will be billed to you monthly.

An extensive review of the intersection of Routes 776 and 645 (Airport Road) and
Admiral Byrd Drive which is adjacent to the referenced project has been conducted.
The conclusion has been drawn that the entrances for access to Pegasus, Phase II from
Route 645 do not justify a signalization agreement as part of the permit process. The
owner does not need an agreement at this stage of development. However, as
additional development occurs on Route 776 and/or on Admiral Byrd Drive,
signalization at the subject intersection should be addressed.

This letter is to inform you that the Frederick County Planning Department administratively approved
site plan #045-97 on January 22, 1998.
This site plan consists of a 17,920-square-foot building. In addition to the proposed building, there
will be 127 parking spaces within an asphalt and concrete curb/gutter parking lot; 91 parking spaces
will be constructed initially. Landscaping will be installed around the perimeter of the parking lots,
and along the western edge of the access drive.
Attached are two copies of the approved plan. This will enable you to provide your contractor with
an approved copy, and maintain a copy for your records. Please have the contractor contact this
office to schedule an on -site inspection once all improvements are complete.

I have reviewed the above referenced site plan received by this office December 23, 1997. Most of
the concerns mentioned in my letter dated November 13, 1997, have been addressed. The following
concerns continue to require clarification.
Sheet 4 of 7
1) The proposed parking lot does not comply with the required dimensional
dk specifications. While you have adjusted the dimensional labels, the actual drawing
scale does not satisfy requirements. In particular, the parking lot along Airport Road
only provides a 20-foot aisle; the label states `22-foot'. This area needs to a modified

1) General Notes #7: Parking lot perimeter landscaping requirements. I calculated the
parking lot perimeter to be 1,495 feet. Therefore, 37 shade trees would be required for
perimeter landscaping. This would bring the total parking lot landscaping total to 50
shade trees. Please confirm, correct, and update as necessary.
2) General Notes #8: Parking space requirements. Only 91 and 36 parking spaces were
counted, respectively. The plan states that 95 and 38 spaces, respectively, will be
provided.

1) Clarification concerning the 80-foot ingress/egress easement. This project appears to
be utilizing more than 40 of the 80-foot easement for parking and landscaping. The
access easement agreement also states that all Phase II construction commerce before
July 29, 1998. Would a failure to commence by the set date invalidate the access
agreement? I would request that a meeting with representatives from Project Hope
and Adams -Nelson & Associates be arranged so that all affected parties are familiar
with the development concept. Please inform me when this meeting is scheduled.
2) A landscape easement on the Project Hope property guaranteeing that the proposed
landscape will not be disturbed. If this landscaping is a requirement of the ordinance,
then it should not be removed to accommodate future development proposals.
6 , 3) Parking spaces may not be designed so that vehicles back from parking spaces into
access roads. All parking spaces must be located within a parking lot with parking
aisles; the access easement is not intended to act as a parking aisle. It is our belief that
this access easement, and the buffer waiver issued by the Planning Commission, was
intended to enable truck access to loading areas, truck access that was clearly separate
from vehicular access. Therefore, proposed parking on the west side of the proposed
building would not be permitted.

parking lot perimeters to prevent headlights from shining on road right-of-ways.
These plants should be placed at four foot centers.

We have completed our review of the proposed site plan for the subject site and offer the
following comments:
1. Sheet 5 of 7
There is approximately one and one-half acres that will be disturbed during this
phase. There needs to be a sediment trap placed on -site to control erosion run-off
during construction. Indicate the location, dimensions and provide a detail of the
sediment trap.
2. Extend the silt fence as indicated on the marked up plan to contain any run-off
along this perimeter.
3. The proposed culverts along Airport Road need to have inlet and outlet protection
to control erosion due to increased run-off velocities. Indicate approximate
lengths for all rip -rap protection. Also, include inlet and outlet protection at the
existing 24 inch CMP under Bufllick Road.
4. Determine if the existing 24 inch CMP under Bufllick Road is adequate for a ten-
year design storm due to the increase in run-off from the proposed site.
5. Provide a rip -rap channel at the proposed three foot curb cut to control erosion at
this opening.

6. Stormwater management has been provided by a regional pond located on the
Kohl's site.

We have received your revised site plan dated January 7, 1998 for the referenced
project. It appears all of our earlier review continents have been satisfactorily
addressed. Please advise the owner of our approval.
It will be necessary for the developer to enter into a signalization agreement with VDOT
where the developer agrees to pay 100% of installation cost if VDOT monitoring reveals
the warrants arise in five years from the completion date of this project. VDOT retains
the privilege to extend the agreement after five years.
The appropriate land use permits may now be applied for to cover work within the
Route 645/776 right-of-way. The permits are issued by this office and will require a
minimum processing fee, surety bond coverage and the salary & expenses of a State
assigned Inspector. Once satisfactory application has been made, a permit will
normally take approximately thirty days to process and issue.
Please note all necessary easements and right-of-way dedications need to be completed
prior to VDOT issuance of any land use permits.

We have reviewed the preliminary site plan dated October 22, 1997 (received 10/23/97)
for the referenced project. VDOT comments are as follows and shown in red on the
plan sheets:
1. It appears the west entrance utilizes the adjacent property through an
ingress/egress easement. Is the entrance to be joint use? If so, a shared entrance
agreement should be provided.
2. The CG-7 should be provided between the multiple entrances accessing Route 645.
See multiple entrances with right turn lane and taper found in the Minimum
Standards of Entrances to State Highways, Page 28 for illustration.
3. Consideration should be given to a storm sewer system on portion of drainage from
the west end of the west culvert to the west end of the east culvert adjacent to Route
645 to avoid utility conflict.
Another option could be to move culverts to the north of the existing gas line.
4. The taper at the east entrance should be deleted in lieu of an extension of the right
turn lane east to tie into the lane on the east side of the intersection with Route 776
(Bufflick Road). This would provide a smooth line of transfer for right turns into the
site entrance.

5. Additional right-of-way should be dedicated at the southeast corner of the site to
provide adequate space for 50' radius needed at the intersection. Also a 20' drainage
easement should be provided for future maintenance of drainage and culvert.
6. Due to the continual development by commercial activities in the immediate vicinity
of the intersection of Route 645 (Airport Road) with Admiral Byrd Drive, our
District Traffic Engineering Section is being asked to provide current traffic volume
counts and percent truck traffic at the intersection. This should assist all interested
parties in the determination of traffic signalization warrants and to determine
appropriate application of signal installation agreements.
7. The proposed pavement widening, installation of tapers and right turn lane at the
site entrances should be constructed by use of the Route 645 (Airport Road)
pavement structure (typical section) copy attached.
All miscellaneous notes shown in red on the plan sheets should be addressed. Any
changes made in design features should meet or exceed the standard.
When you have addressed all the above comments, please submit five copies of revised
plans for review.

Mr. Wyatt said that Mr. John C. Lewis, P.E. wishes to address the Planning
Commission on the Pegasus Center Master Development Plan and a request for a waiver of the
zoning district buffer. Mr. Wyatt said that the Pegasus Center is located on property owned by
Kevin and Patricia Adams and currently houses the Airport Office Building. He said that the
proposal will create the Pegasus Business Center on 6.25 acres and will improve access to the
adjoining Project Hope facility. The properties are zoned B2 (Business General) and M 1 (Light
Industrial), respectively.
Mr. John C. Lewis discussed the overall concept and phasing of the project which
included flex space for office and storage within a business park setting. He then discussed his
request for a waiver of the zoning district buffer. He proposed to relocate the landscaping
required by the zoning district buffer to other areas on both properties. He said that this proposal
would allow for access improvements to each property and would separate truck traffic from
automotive and pedestrian traffic.
Members of the Commission stated that Mr. Lewis's concept sounded more like
B3 use than B2 use. The staff explained that in prior discussions with Mr. Lewis, he described
retail/restaurant-type uses in a campus -style setting, using the rear of some of the buildings for
storage for the uses in the office space area. The staff's opinion was that the waiver would be
appropriate given die compatibility of -'the uses. With regard to phasing of the master development
plan, members of die Commission felt that if the total number of lots were approved initially. they
would not have a problem subdividing off portions, as long as the development was consistent
with what was previously approved.
A motion was made by Mr. Thomas and seconded by Mr. Romine to approve the
waiver request to allow a redesign of the required buffer between the B2 and M 1 properties which
will require die same amount of landscaping that will he relocated to the perimeter of these sites.

JOINT EASEMENT AGREEMENT
This Joint Easement Agreement, made and dated this Zq ✓
day of v 4__, 1996, by and between C. DOUGLAS ADAMS and
KEVIN D. ADAMS (hereinafter called Adams); and THE PEOPLE TO
PEOPLE HEALTH FOUNDATION (PROJECT HOPE) (hereinafter called
Project Hope).
WHEREAS, Adams is the owner of property containing a total
of 6.0623 acres, located on Bufflicic Road (Rt. 726) and Airport
Road (Rt. 645) in Shawnee Magisterial District, Frederick
County, Virginia, said property being more particularly
described on the plat of Elliott Ritchie, Jr., L.S., dated March
1, 1996, attached as Exhibit A; and
WHEREAS, Project Hope is the owner of property containing
4.6256 acres, located on Bufflick Road (Rt. 726) and Airport
Road (Rt. 645), in Shawnee Magisterial District, Frederick
County, Virginia, and adjoining on the west the above -described
property of Adams; and
WHEREAS, the parties desire to enter into this Joint
Easement Agreement to establish a joint ingress/egress easement
for the joint and mutual use and benefit of their above -
described properties.
NOW, THEREFORE, for the mutual considerations set forth
herein, the parties do hereby agree as follows:
1. The parties do hereby establish an Eighty (80)
foot wide Ingress and Egress Easement, as shown and located on

washing or sweeping as required;
(c) Removal of snow and ice from paved surfaces
and sidewalks;
(d) Maintenance of appropriate parking area
entrance, exit, and directional markers,
and other traffic control signs as are
reasonably required;
(e) Cleaning of lighting fixtures and relamping
as needed;
(f) Restriping as required to keep same clearly
visible;
(g) Maintenance of any electrical and sewer
lines, and other utilities, which
exclusively provide service to the Easement
area;
(h) Mowing, grooming, and irrigation of all
seeded, sodded, grass, or ground covered
areas, and maintenance and replacement of
all landscaped areas;
(i) Maintenance and cleaning of all storm water
drainage systems; and
(j) Maintenance, repair, and replacement of
enclosures for trash receptacles.
Project Hope shall be responsible for twenty percent (200-o) of
the cost of such maintenance and upkeep, up to a maximum of One

Thousand Dollars ($1,0o0.00) per calendar year, beginning in
1996, which maximum annual,amount shall be cumulative; provided,
however, in no event shall Project Hope be responsible for
maintenance and upkeep of more than Three Thousand Dollars

of such maintenance and upkeep shall be the responsibility of
Adams.
5. The owner of each property who holds a right of
ingress and egress through the Ingress and Egress Easement as
established by this Joint Easement Agreement shall maintain
comprehensive general liability insurance (which shall include
coverage for such owner's, its tenant's and invitee's, use of
the Ingress and Egress Easement), naming the other owners as
