SITE PLAN CHECKLIST
The checklist below indicates ail the information -that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Upon review of the revised site plan dated February 24, 1998, we offer the following
comments:
1. The revised stormwater calculations for pond number one appear to adequately
address the stormwater requirements for this area. We recommend a note be
placed on the weir detail shown on page 5 of 6 indicating the thickness of the
concrete weir. Your calculations indicate a thickness of nine (9) inches; however,
it is not reflected on the plan.
2. Inform the owner that the earth work contractor, Buckley & Layes, Inc., needs to
install the pond as soon as possible because the building is partially completed.
We recommend approval of this change to stormwater pond number one (1). We have
already approved the entire site plan on December 3, 1997.

This letter is to inform you that Frederick County Planning Department administratively approved site plan #043-97 on
January 15, 1998.
This site plan consists of a 71,210 square foot building. In addition to the proposed building, there will be 61 parking
spaces within an asphalt and concrete curb/gutter parking lot. Landscaping will be installed around the perimeter of the
parking lots, and a landscaped buffer will be installed along Tasker Road.
Attached are two copies of the approved plan. This will enable you to provide your contractor with an approved copy, and
maintain a copy for your records. Please have the contractor contact this office to schedule an on -site inspection once all
improvements are complete.

Dear Gary:
I have reviewed the above referenced site plan received by this office November 4, 1997. The
following comments will need to be addressed in order to proceed with approval of this site plan.
Please provide:
Site Plan Checklist
1) Signed and dated certificate of engineer.
2) A space labeled "Approved by the Zoning Administrator" for the approval signature
and date of approval.
3) Surveyed boundaries for all lots and parcels.
4) Use, zoning, and property identification number (PN) of all adjoining properties. This
includes properties located across road right-of-ways.
S) A listing of all conditions placed on the site as a result of a conditional zoning
approval. The property owner's proffer statement is enclosed.
6) Location, height, and specifications of outdoor lighting fixtures. This includes both
parking lot and building mounted lighting. U no outdoor lighting is proposed, please
state accordingly. If outdoor lighting is proposed, please provide statement that
"Outdoor lighting shall be arranged to deflect away from adjoining properties and
public streets. Sources of light on a lot shall be hooded or controlled to prevent glare
beyond the lot line".
7) Location of outdoor trash receptacles and dimensions of structure required to enclose
receptacles. Also, a concrete pad should be provided for all dumpster locations.
8) The proposed use of the building.
9) Location and dimensions of all proposed entrances from public right-of-ways.
10) Calculations describing the required number of loading spaces.
11) Location and dimensions of all parking and loading spaces, driveways, parking aisles,
curbing and other features to be used. This includes identification of proposed surface

materials, and limits of their use. Concrete aprons should be provided at loading bays.
12) Location and dimension of all disabled parking spaces and ramps. This information
should include details illustrating compliance with ADA requirements.
Sheet 1 of 6
1) Sign and date Professional Engineer seal.
2) Proposed use.
3) Statement addressing outdoor lighting glare.
4) Copy of proffers for the site.
5) Zoning Administrator approval signature and block.
6) Update revision block.
7) Building setbacks. All frontages along roads are considered front yard areas. The front
setback should be 75 feet.

1) Use, zoning, and PIN of all adjoining properties.
2) Identify pavement types and limits of pavement use.
3) Indicate the curb and gutter proposed for both entrances.
4) Proof that easements have been obtained for off -site drainage and 'grading.
5) Parking lot setback lines. Confirm that parking areas comply with 25-foot setbacks.

1) Thirty-foot Road Efficiency Buffer. This buffer should include a landscape element
consisting of three evergreen trees per 10 linear feet. Typically this is achieved by
providing a double row of trees at 8-foot centers within a 10-foot landscape easement.
The trees should be 4-6 feet at time of planting. This landscaping should be placed
on the southwestern side of the buffer, enabling future road expansion with minimal
disturbance to the landscape. I have enclosed a diagram of how this landscape buffer
is typically achieved.
2) Confirm that the hedge and trees will not be planted in the stormwater management
area.
3) The evergreen hedge should be a minimum of 3-feet high at time of planting; shrubs
should be planted at 4-foot centers. Please confirm plant count based on the 4-foot
center requirement.
4) Confirm that the SVVIM located south of the site does not interfere with the Marcel
Drive right-of-way.
5) If a compactor is to be utilized, an evergreen screen should be provided.

Please revise your site plan to address the above comments, those on the red -lined plan, and the
comments provided to you by the review agencies.
You will also need to provide this office with the approved comment sheets from all required review
agencies. The required review agencies include: Virginia Department of Transportation, Sanitation
Authority, Inspections Department, County Engineer, Fire Marshal, and the Planning Department.
Once all comments have been addressed, please resubmit one copy of the revised site plan to this
department for final review. If the revised site plan satisfies all agency comments, we will request five
copies of the final site plan and recommend the site plan for approval.

WHEREAS, the Planning Commission held a public hearing on this rezoning on July 2, 1997;

WHEREAS, the Board of Supervisors held a public hearing on this ordinance adoption on
August 13, 1997; and
WHEREAS, the Frederick County Board of Supervisors finds the approval of this rezoning to
be in the best interest of the public health, safety, welfare, and in conformance with the
Comprehensive Policy Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors that
Chapter 165 of the Frederick County Code, Zoning, is amended to revise the Zoning District Map

Development Plan for Eastgate Commerce Center, dated January 27, 1997.
Voluntarily proffered is the attached Master Development Plan and as shown on the
Master Development Plan for Eastgate Commerce Center the following improvements:
1. A thirty foot (30') wide road efficiency buffer along both sides of Tasker Road
landscaped with a double row of evergreen plains four feet (4') minimum in height will
be installed by the undersigned. The road efficiency buffer may be used for right-of-
way expansion of Tasker Road.
2. A traffic signal at the intersection of Tasker Road and Front Royal Pike (US Route
522) and the exansion of the left turn lane from northbound Front Royal Pike (US
Route 522) west onto Tacker Road will be constructed by the undersigned within nine
(9) months of an official notification by VDOT.
3. Additional right-of-way for the construction of turn lanes and/or travel lanes along

WHEREAS, Rezoning application 9006-91 of Eastgate Commerce Center

WHEREAS, the Planning Commission held a public hearing on this
application on August 7, 1991; and

We, the undersigned, WRIGHTS RUN L.P., sole owner of the land to be
rezoned under zoning request number 000-a) , referred to as the Eastgate
Commerce Center rezoning, and the applicant for said rezoning, hereby
voluntarily proffer the following conditions. The conditions proffered shall be
binding upon the heirs, executors, administrators, assigns, and successors in
interest of the undersigned. In the event the Frederick County Board of
Supervisors grants said rezoning to B-2, B-3 & M-1 and accepts these conditions,
the following proffered conditions shall apply to the land rezoned in addition to
other requirements set forth in the Frederick County Code:
1. As shown on the attached Generalized Development Plan, access to the
property to be developed will be by two intersections along the proposed Rte. 642
(Point B) and one intersection along U.S. Rte. 522 south. (Point D)
2. Within 60 days after rezoning approval by the Board of Supervisors
the owner will transfer to the Virginia Department of Highways or to the County
of Frederick, the eighty foot (80') fee simple right-of-way together with necessary
easements as shown on said plat as running from U.S Rte. 522 (Point C) to the
lands of James T. Vickers (Point A).
3. Wiring for electrical and telephone services within the development
area will be placed underground. The development area is the area bounded by
the limits of this proposed rezoning and adjacent rights -of -way.
4. The owners proffer the construction of a frontage road along the
commercially zoned frontage with Rte. 642 as shown on the Generalized
Development Plan from Point E to Point F. All B-3 zoned uses will be developed
utilizing this frontage road. A road efficiency buffer 30' in width between
pavements provided with landscaping and/or seeding for aesthetic purposes
along the cooridor will be: provided.

5. If or when, in the opinion of the Virginia Department of Transportation,
traffic signal(s) are required, the owners will construct the signalization and
associated improvements at the intersection of Va. Route 642 and the proposed
access road intersection (Point B) and/or at the US Route 522 and industrial
access road intersection (Point D). The signal light system will meet all VDOT
requirements. Notification shall be made at the time of any site plan review for
uses within the park. The owner proffers to construct the signal system within
nine (9) months of the date of such notification.
6. The owners proffer that all development on this site will be served by
central sewer and water facilities, which will be brought to the site by the
developer and provided by the Frederick County Sanitation Authority; except,
that individual sewer and water interim onsite facilities may be used for each of
the first three established business, in aggregate totalling no more than 400
employees. Such interim facilities are to be specifically approved by the Health
Department prior to site plan approval.
7. The owners proffer that storm water detention calculations will be
presented with final design which show no adverse impacts created by the
imposition of increased storm water on the existing downstream water course.
Storm water detention structures will be designed to limit post -development
flows to pre -development levels in accordance with state and county regulations.
Also, at the time of site plan approval, suitable analysis of run off quality impacts
will be performed, so as to mitigate a portion of the impact created by industrial
development of the site.
S. The owners proffer to construct a right turn lane on US Route 522 (Point
D) when the industrial' access road is constructed. This access road may be
constructed and placed in operation prior to improvement of US Route 522 by
V.D.O.T. The owner further proffers to construct all road facilities to V.D.O.T.
requirements. and.for.-V.P.O.T. approval prior to development.

9. The owners proffer that interim uses described in #6 above, will be
provided with interim on -site fire protection satisfactory to the County Fire

the first building lot or issuance of the first grading permit and an additional

several of these comments need to be addressed. Notes can be added to
the erosion and sediment control plan to address the appropriate comments
so that a permit can be issued by December 1, 1997 as you requested.

appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval.
Item No. 6 in VDOT review letter dated December 1, 1997 should be made a part of this
approval. Prior to issuance of VDOT land use permit(s) a signalization agreement will be
required at the intersection of Marcel Drive with State Route 642 (Tasker Road). The
developer(s) will provide 100% of the cost of installation for a period of five years (renewable at
VDOT discretion) from the completion date of the Specialmade project. VDOT will monitor the
warrants during the specified dates.
The developer(s) will also be required to install (and bear the cost) of turning lanes in the event
traffic analysis indicates the need for turn lanes.
The appropriate land use permit(s) may now be applied for to cover work within the Route 642
right-of-way. The permits are issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector.
