Buildings addition shall comply with The Virginia Uniform Statewide Building Code and
section,303 group A (Assembly) of the BOCA National Building Code/1996.0ther Code that
applies is CABO A117.1-92 Accessible and Usable Buildings and Facilities. Structural plans
submitted for permit application shall be sealed by a Virginia Licensed Design Professional.
Please note the requirements in Chapter 17 of BOCA for special inspection requirements on the
type of structure.( Soils, concrete ect..)
All required egress from the new structure shall be HC Accessible to min. exterior landing.
Section 507 of BOCA will be the reference for the Fire Wall rating between the new addition and
the property line for unlimited building between 30' and 50' from property line. Please note that

This letter is to confirm that the above -referenced appeal application was denied by the Board of
Zoning Appeals at their meeting on January 20, 2004. This denial was of your request, #13-03, for
a restaurant/snack bar with more than 30 seats, and an outdoor soccer field for the parcel bearing
Identification Number 75-A-91 C. This property is located at 221 Commonwealth Court in the
Shawnee Magisterial District. Your appeal application included uses which are not approved
accessory uses to the "Sportsplex": "Physical Therapy", "Chiropractic Center", and "Massage
Therapy". During the meeting, you agreed that these uses are not permitted in the B3 zoning district
on this property.
This decision of the Board of Zoning Appeals may be appealed to the Circuit Court of Frederick

Dear Mr. Mislowsky:
I have had the opportunity to review the Sportsplex revised site plan received by our department on
January 5, 2004. The following comments, in addition to those marked on the attached plan, should
be addressed during the revision of this site plan:
1. Shared parking agreement has not been provided as required by Section 165-27 of the Frederick
County Zoning Ordinance.
2. Restaurant use is not an allowed use in the B-3 Zoning District.
3. Need to attach the floor plan to the site plan. Floor plan should reflect the occupancy load for all
the uses that will occur at the Sportsplex.
4. Need to include the address on the site plan.
5. Tax Identification Number is not the correct number.

Outstanding Sportsplex Issues
The list below are current and future Zoning issues at the Sportsplex. Staff believes these issues should
be resolved prior to issuing of a final occupancy permit.
I. Shared Parking
a. Frederick County has not received or approved any shared parking agreements in accordance 165-
27 D of the Frederick County Zoning Ordinance.
b. These parking agreements are needed for any special events in the future.
c. Current parking requirements on site will not meet these special events
11. Signage Issues
a. Temporary sign permit for sign along Rt. I 1 expires February 28, 2004
b. This sign is an illegal off -premises sign and would require a CUP
c. This sign is located on the Carquest site.

Since the inception of the Sportsplex project, staff has been concerned with
parking in regard to ingress and egress to the facility. This seems to be compounded
�xhen the facility hosts special events. As you know the facility is located at the end of
the street and has previously utilized the cul-de-sac as the unloading/loading point. This
blocks the only entrance to the parking lot, thus blocking access to the building in the
case of an emergency. In the past, vehicles have been allowed to park along
Commonwealth Court, which creates traffic congestion and limited road width for Fire
and ENIS apparatus. If this situation continues it will likely delay Emergency Services.
To date, staff still continues to work with the Sportsplex project to resolve
problems with ongoing construction and special events. I look forward to resoly ng the

This letter is in response to your correspondence, received by the Frederick County Department of
Planning and Development, on October 10, 2003, regarding a Zoning Determination letter on the
above -referenced property (see attached letter). The "Zoning issues" that you have referenced in your
letter for zoning determination are:
You stated in your letter, "indoor sports facilities are not addressed in detail in the
Frederick County Zoning Ordinance in the 13-3 Zoning District." Staff response: The
Zoning Ordinance classifies indoor sports facilities as Amusement and Recreation
Services operated indoors: Standard industrial Classification (SIC) Group 79.
Frederick County uses the Standard Industrial Classification in conjunction with the
Zoning Ordinance to determine the allowed uses in the business and industrial districts.
The Frederick County Zoning Ordinance does not provide for Conditional Use Permits
in the B-3 Zoning District.
2. You reference "other activities that may be planned for the Sportsplex."
a) "Youth and Adult Leagues" - Allowed use.
b) "Mom and Tots programs" - This type of use is allowed only if the daycare is
an accessory use to the Sportsplex or any sports programing involving moms
and tots. An independent day care facility which allows parents not
participating in athletic activities to drop off children is not an allowed use.

General) District, therefore, they are not allowed on this site:
a) Batting and Pitching Cages.
b) Outdoor Jogging Track.
c) Outdoor Soccer Field.
You may have the right to appeal this determination within thirty (30) days of the date of this letter in
accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and
unappealable, if it is not appealed within thirty (30) days. Should you choose to appeal, the appeal
must be tiled with the Zoning Administrator and the Board of Zoning Appeals (BZA) in accordance
with Article XXI. Section 165-155A( I ), of the Frederick County Zoning Ordinance. This provision
requires the submission of an application form, a written statement setting forth the decision being
appealed, the date of decision, the grounds for the appeal, how the appellant is an aggrieved part)', any
other information you may want to submit, and a $250.00 filing fee. Once the appeal application is
accepted, it will be scheduled for public hearing and decision before the BZA.

Dear IVIr. Hodgson:
This letter is in regards to Our meeting on December 18, 2003, with the Frederick County Department of

Planning and Development, Building Official, County Engineer, Fire Marshal, and the Assistant County
Administrator. The topics of discussion at this meeting were intended to resolve any possible zoning and
building violations at the Sportsplex site, and to better Understand the necessary steps which you 111LISt
accomplish in order to open and operate the facility.
YOU were advised of a number Of significant bUildlilg iSSLICS that require additional coordination with the Fire
Marshal and the Building Official. You will need to deal directly with their respective departments to address
their issues.
In terms of the Plamling Department's outstanding issues for the Sportsplex project, most significant is the
required parking for the facility. As we discussed, the expanded occupancy loads of the snack bar area
raised concern in terms of the necessary on -site parking requirements. We agreed that the establishment of
a maximum occupancy load of 30 persons within the designated snack bar area would resolve the oil -site
parking concern. Accordingly, Notations regarding the lllaxlilllllll OCCLIpancy load should be included in the
building permit file, and a notation on the site plan shall establish a maximum Illlillber Of 30 seats within the
snack bar area. In a similar nature, the maxlill1,1111 seating associated with the Coffee kiosk would be tell seats,
and should be noted accordingly.
In order to satisfy the parking requirements for your various special events (trade shows, conference and
banquet facilities, etc.), you have elected to enter into a shared parking agreement with two adjoining
properties, rather than providing actual parking on site. This shared parking agreement shall be in
accordance with Section 165-27 B of the Frederick County Zoning Ordinance. Per the ordinance
requirements, the agreements shall be in a lease form and include authorized signatures of the property
owners, identification of the number of parking spaces available, and the times when the parking spaces will
be available for use. As we discussed, these shared parking spaces will not be available unless the business
on the site of the parking is closed. For example, if you intended to utilize the CarQuest parking lot,
CarQuest must be Closed prior to your use of the parking lot. Pleasc provide the Planning Department with

Dear Mr. Hodgson:
This letter is regarding the meeting of December 1, 2003, with the Frederick County Department of
Planning and Development. The topic of discussion at this meeting was resolving any possible zoning
violations at the Sportsplex site. As of the date of this letter, the Frederick County Department of
Planning and Development has not received a revised site plan to address the uses and parking at this
site.
At this meeting, we discussed the different types of uses that may occur at the Sportsplex, and some
of these uses will need to be better identified. These different types of uses will effect the parking
requirements as they relate to the Sportsplex. The use of shared parking was discussed and shall only
occur within the Commonwealth Business Park. Shared parking at this site shall be in accordance
with Section 165-27 B of the Frederick County Zoning Ordinance. The site plan should be revised
to reflect the parking agreement. The signed agreement shall be included with the revised site plan as
an attachment.
The Building Official and this office will need a new floor plan with all uses included on the plan.
This plan will have new occupant loads assigned to all the areas of the site. This new occupant load
will be reflected on the parking requriments for their uses on this site. Please be advised that this
office will not grant any zoning approvals for this site until these issue have been resolved.

Ron Hodgson, the owner, is trying to finalize the uses to be provided within his new indoor recreational facility
in the Commonwealth Business Center. Just to remind you, during the design of the site, Ron worked with the
Planning Staff to determine the amount of parking required for this facility. Mike Ruddy made the final
determination of the parking required for the recreational facility and the current site plan meets that standard.
Ron has meet with Patrick Davenport to determine what uses would be allowed as accessory to the Indoor
Recreational Use. Patrick issued a letter of 20 October clarifying his rulings as to what is and is not allowed.
Mr. Hodgson is interested in including those items listed in Patrick's letter under item 3 "uses allowed in the
B-3 zone, but not allowed per the site plan." Patrick has advised that a revised site plan application would be
required to change the proposed use from Indoor Recreational Facility to Indoor Recreational Facility and
Event Center. As a result, we've revised the site plan and enclosed here the application , fee and new site plan
sheet 2 for your review and approval.
The building includes a 16,000 S.F. area that while normally used for indoor sports activities, can also be used
for assembly. Those assembly type uses could include any and all of those listed in Para 3 of Patrick's letter.
This 16,000 S.F. assembly use would require 64 parking spaces (1/250). While an assembly use is ongoing,
activities throughout the rest of the facility would normally be curtailed. Ron Hodgson has determined that
when using the 16,000 S.F. as assembly area, the maximum remaining usable recreation area would be 58,000
S.F. That remaining usable recreation area is 75% of the total area, accounting for 184 of the provided parking
spaces. Therefore, when an assembly use is occupying the 16,000 S.F. area, the required parking total is
64+184 or 248. As 250 spaces are provided, parking is adequate to support this alternate use.
