The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review

Dear Ron:
The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on April 6, 2004. This site plan is approved for the construction of a 12,750 square
foot office building on the above -referenced parcel. The approved site plan meets all requirements for
a new office building in the B-3 (Industrial Transition) Zoning District. Furthermore, the site plan is
consistent with the proffered conditions of rezoning application #09-02, which was approved for the
rezoning of 1.39 acres from the M-1 (Light Industrial) and B-2 (Business General) Districts to the B-3
District. As proffered, payment of the monetary contribution of $3,000.00 is due at the time of issuance
of the building permit for the proposed office building.
I am providing you with four copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the development
process. Once site development is complete, the owner(s) should contact this office to schedule an on -
site inspection. Do not hesitate to contact me should you have any questions or concerns.

Dear Ron:
Upon review of the revised site plan dated March 31, 2004, we offer the following
comments:
1) The channel improvement shall be completed as the first step in the grading
operation. The Virginia Department of Transportation will install the twin box
culverts under Lee Avenue during the month of April. The channel improvement
on this property in conjunction with the box culvert installation will be major
factors in improving the stormwater flows within this area.
It appears that all of our previous comments have been addressed. Therefore, we
recommend approval of the subject site plan.

Review Comments:
1) Agency Comments. All review agency comments/approvals noted in Staff s review letter, dated
December 17, 2003, need to be provided to planning staff. In addition, please provide comments
from the City of Winchester. City of Winchester comments were not noted to be required in the
December 17te letter, because the original site plan failed to note that they served the site.
2) Special Limited Power of Attorney Form. Please have theproperty owner complete and notarize
the attached Special Limited Power of Attorney Form As you are aware, this form is required for
all land use applications to ensure that the property owner has authorized the plan designer to
represent him. No further correspondence regardinghis project will be directed to your office until
such authorization is granted.
3) Engineer's Signature. Please ensure that the engineer's seal is signed on the final plans.

We have received your revised site plan dated February 9, 2004 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval. Also please provide six (6) sets of' approved construction plans with
signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 11
right-of-way. The permit is issued by this Office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all
recorded plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior- to issuance of any
land use permits. Dedication Should be made to the Commonwealth Of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

Plannning Staff has reviewed the above -referenced site plan to determine if administrative approval
can be granted. At this time, administrative approval caiulot be granted. This site plan is denied
until the issues in this letter, as well as all issues of the other review agencies, have been adequately
addressed. Please review Staffs continents listed below and then prepare a revised site plan which
adequately addresses each concern.
Review Comments:
1) PINs. There is inconsistent information regarding the PINs of the site. The cover sheet
indicates that the site plan is for PINs 54-A-20, 54-A-20A, 54-A-21, and 54-A-22. However,
the project information section of the site plan indicates that there is just one PIN, 54-A-20.
Also, the site plan drawing only shows PINs 54-A-20A, 54-A-20, 54-A-45, and 54-A-42 (or
44) as part of the site plan. Please provide consistent information. A copy of the recorded
plat is attached for your assistance. Please note that there appears to be an error with the
adjoining PINs for the 132 parcels. This is elaborated further in the following comment.
2) PINs Of Adjoining B2 parcels. Please ensure that all adjoining property information is
accurate. Staffs records indicate that parcel 54-A-44 should be located in the location
shown as parcel 44-A-42. Furthermore, the recently recorded plat for the lot consolidation
shows both of these parcels as being identified by PIN 44-A-44.
3) Use of M1 District Parcels. Please explain what "contractor yard" means in regards to the
use of parcels 54-A-22A and 54-A-23. If this area will be used for the storage of company
equipment and vehicles, then it should be fully screened. In addition, these areas should be
included within the area of the site plan if the use is associated to the proposed use.

4) Outdoor Storage. Please show the location of all proposed outdoor storage. If no storage
is proposed, then please provide a statement to this effect and provide a narrative that all
existing outdoor storage shall be removed. All outdoor storage should be frilly screened and
used only in association with the on -site business.
5) Outdoor Trash Receptacles. Please show the location of all proposed outdoor trash
receptacles. This includes dumpsters. All dumpsters shall be fully screened and placed on
a concrete pad. If no dumpster is proposed with this site plan, then please provide a
statement to this effect and explain how trash will be managed on the site.
6) Landscape Screen of Category B Buffer. Please provide an acceptable deciduous tree
species instead of the forsythia sln-ub for the landscape screen of the category B buffer
required adjacent to the B2 Zoning District.
7) Evergreen Hedge Spacing. Please plant the holly shrubs between two and three feet apart
to provide a continuous screen. Pour and one half foot spacing is not acceptable. Also, the
required size of shrubs at planting has changed from a minimum 36" tall to a minimum three -
gallon container. Please change the planting schedule and the note on the site plan as
appropriate.
8) Parking Lot Landscaping. The landscape plan illustrates 12 deciduous trees for the
parking area; however, 16 of these trees are required. Please add four additional deciduous
trees. Staff would suggest that at least two of these trees be located along Route 11.
9) Proffer Statement. Please provide a list of all proffered conditions on the site plan for
reference purposes. A copy of the official proffer statement is attached.
10) Raised Concrete Landscaped Islands. Please provide a nine foot wide raised concrete
island at the end of all parking bays. The temporary anchored concrete wheel stops do not
satisfy this requirement.
11) Curb & Gutter. Please provide curb and gutter along the northern side of the two parking
spaces located adjacent to the railroad.
12) Setbacks. The setbacks provided in the project summary section appear- to be inaccurate.
The site plan shows a front setback of 68.87', a side setback (right) of 18.72', and a rear
setback of 22.64'. Furthermore, the required parking setback is actually 25' from the left
side, 10' from the front, and 5' from other property lines. Please make all necessary changes.

Rezoning Application ,MQM for the rezoning of 1.39 acres from the Light Industrial (M-1) and Business
General (B-2) to Industrial Transition (B-3). Development of the subject property shall be done in
conformity with the terms and conditions set forth herein, except to the extent that such terns and
conditions may be subsequently amended or revised by the applicant and such be approved by the
Frederick County Board of Supervisors in accordance with Virginia law. In the event that such rezoning
is not granted, then these proffers shall be deemed withdrawn and of no effect whatsoever. These
proffers shall be binding upon the applicant and their legal successor or assigns.
Monetary Contribution
The undersigned, who owns the above described property, hereby voluntarily proffers that if the Board
of Supervisors for the County of Frederick, Virginia approves the rezoning for the 1.39 acres, with
frontage along U.S. Route 11 in the Stonewall Magisterial District of Frederick County, Virginia from
M-1 and B-2 to B-3.
This monetary proffer provides for $2,000.00 for Frederick County Fire and Rescue and $1,000.00 for
Sheriff's Office. Payment shall be made at the time of issuance of building permit.
Parkin14 Lot
A 10' clear planting strip shall be provided between the U.S. Route 11 right of way line and the parking
lot limits to allow planting of street trees and landscaping.
The conditions proffered above shall be binding upon the heirs, executors, administrators, assigns and
successors in interest of the Applicant and Owner. In the event the Frederick County Board of
Supervisors grant said rezoning and accepts these conditions, the proffered conditions shall apply to the
land rezoned in addition to other requirements set forth in the Frederick County Cod .

WHEREAS, Rezoning #09-02 of Aikens Property, was submitted by G. W. Clifford & Associates,
Inc., to rezone to rezone 1.34 acres from M1 (Light Industrial) and .05 acres from B2 (Business
General) to B3 (Business Industrial Transition). This property is located west and adjacent to
Martinsburg Pike (Rt. 11) and south and adjacent of Stine Lane and is identified with Property

and
W11E, REAS, the Planning Commission held a public hearing on this rezoning on September 4,

in the best interest of the public health, safety, welfare, and in conformance with the Comprehensive

We've prepared a site development plan for a corporate office building at 1025 Martinsburg Pike. The site is on the west
side of US Route 11, just north of Lee Avenue. A three story, 12,750 sq. ft. office building is proposed.
Primary access is provided from an upgraded commercial entrance from Route 11. Interparcel connections are made to
the existing H&W Construction site to the north. A future interparcel connector to the commercial (132) lots at Lee
Avenue is also provided.
The entire site drains to an existing 5'x5' box culvert under Route 11. The plan will provide a new storm conveyance
channel from this box, west through the B2 lots to the new box culverts under Lee Avenue. Due to short time of travel
from our site to the existing 5'x5' box, there is no increase in peak flow rates. Also note, much of the site is already
covered with gravel and impervious surfaces.
Seger service is provided by an extension of a public sewer line to the site from Lee Avenue. Water and other utilities are
available at die Route 11 right-of-way. The existing water meter at the entrance has been deemed sufficient by the owner
and will be relocated to behind the new entrance curb. A fire hydrant is also provided. There is no sprinkler protection
provided.
The required landscaping and screening are provided. The buffer to the B2 parcel will be a shared buffer, imposing no
requirements on the B2 lots once theydevelop.
The site grading will result in excess material which will be used to fill the B2 lots. This area will be seeded once final
grades are achieved.
