Jeremy,
As a follow up to our meeting on 2-10-04, I have prepared a recap of
changes to the landscape plan we discussed. Per your request, I have
changed the perimeter plants from 5 ft spacing back to 4 ft, as on original
plan. I have also changed south side (front), to prevent headlights from
shining on Rt. 277. The following changes are what we agreed on. I also
have included a copy of revised drawing. Overall the plan is basically the
same and will meet and exceed intent of orginal plan.

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on February 13, 2004. The site plan is an approved revision of the site plan
approved September 11, 2003 for the construction of a fast-food restaurant, located off of Fairfax Pike
(Route 277). The revised plans allow for the possibility of a sewer connection from the adjoining
property (Domino's Pizza), contingent on an agreement between property owners. The restaurant will
have a total floor area of 3,562 square feet. All requirements for development within the B2 Zoning
District have been met. Furthermore, all relevant review agencies have approved the project at this time.
I am providing you with several copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the development

THIS DEED OF TEMPORARY EASEMENT made and dated this 3 I? day of
September, 2003, acknowledges that B.R.H. Properties, Inc. (hereinafter called
"Grantor") in consideration of the sum of One Dollar ($1.00), cash in hand paid, receipt
of which is hereby acknowledged, does hereby grant unto Easter Management Company,
LLC, a limited liability company, hereinafter called "Grantee", a temporary grading
easement, for the purpose of grading and related purposes, over, under, through and
across the land situated along the west side of the property owned by the Grantor, and
described as:
All that certain land in Opequon district, Frederick County, Virginia, on
the north side of Virginia Route 277, and designated as Lot 2 on that certain
plat of subdivision of Commercial Lot "D", Section 2, Plymn Owen Estates,
drawn by Elliott Ritchie, Jr., L. S. dated April 16, 1990, of record in the Clerk's
Office of the Circuit Court of Frederick County, Virginia in Deed Book 760 at
page 1899. This property is the same property shown on Frederick County,
Virginia Tax Assessment Map 74B-7-2-D2.
For use in conjunction with the construction of a commercial structure on Lot 1 of the
aforementioned plat, necessary to achieve proper grading and provide for proper
drainage, and other requirements associated with the same.
This temporary grading easement provides for the right of ingress and egress
reasonably necessary for the use as herein described.
Upon completion by grantee of said grading and related improvements, grantee
will restore the easement area in good and workmanlike manner to a condition
comparable to its condition before construction or alteration.

Below are comments from the revised site plan for the above -referenced property, which was submitted on
August 22, 2003 for approval. All comments must be adequately addressed prior to final administrative
approval.
Review Comments:
1. Entrance Spacing. Please show the spacing between the proposed entrance and the closest entrances
to the east and west of Fairfax Pike. [I65-29A(4)] The distance between the proposed entrance and the
existing entrance to the west is not labeled.
2. Temporary Construction Easement. Please provide a copy of the legal agreement for the proposed
temporary construction easement.
3. Existing Fence. Please clarify that the existing fence along the front and left property lines will be
removed.
I will need all approved review agency comment sheets and at least five copies of the final plan for approval.
Comment sheets are required from the following agencies: The Frederick County Department of Building
Inspections, the Frederick County Health Department, the Frederick County Fire Marshal, the Frederick County

Dear Tim:
Thank you for the submission of the above -referenced site plan, which staff received on July 1, 2003.
I've reviewed the site plan and there are a few concerns which need to be addressed before final site plan
approval can be considered. Please review Staff's comments shown below and then prepare a revised
site plan for my review. A photocopy of the site plan is attached illustrating some of Staff's comments.
Review Comments:
1) Drive-Thru Lane. Please show the appropriate stacking distance for the proposed drive-thru
lane. The zoning ordinance requires a minimum length of 90 feet. [165-27E(10)]
2) Pick -Up Lane. Please provide a minimum width of nine feet for the proposed pick-up lane, as
required by the zoning ordinance. [165-27E(10)]
3) Parking Islands. Please provide parking islands at least nine -feet wide at all locations. It
appears that doing this will result in the reduction in the total number of provided parking spaces
as shown. However, I believe that the vehicle spaces in front of the drive-thru and pick-up lane
can be included in the total number of provided parking spaces. Therefore, the calculations for
the total number of provided parking spaces can be increased. Also, it is possible to relocate the
handicap parking spaces to the parking bay in front of the building, if this is useful. [165-
27E(4)]
4) Entrance Spacing. Please show the spacing between the proposed entrance and the closest
entrances to the east and west of Fairfax Pike. [165-29A(4)]
5) Inter -parcel Connector. Staff encourages the use of an inter -parcel connector to the right of
the proposed entrance, below the proposed handicap parking spaces.

6) Shared Entrance. Staff encourages the use of a shared entrance between the subject parcel and
the parcel immediately to the east.
7) Plant List. There appears to be an inconsistency with the plant list and the landscaping plan.
The key does not include JP, which is shown as part of the required landscape screen. Please
change as necessary.
8) Zoning Buffer Screen. It appears that the natural grade and retaining wall in the rear of the
property will serve as a berm for the required full screen of the zoning buffer. Please indicate
this on the site plan for clarification purposes.
9) Parking Lot Landscaping. On the cover page, you indicate that 22 trees are required for
parking lot landscaping, 17 perimeter and 5 interior. However, on the landscaping plan you
show 23 trees. I suggest that you remove the Hornbeam tree in the narrow island beside the
loading zone. It is questionable if a tree will thrive at this location.
10) Temporary Construction Easement. Please provide a copy of the legal agreement for the
proposed temporary construction easement.
11) Adjoining Properties. Please show all information for the adjoining parcels located across
Fairfax Pike.
12) Existing Fence. Please clarify that the existing fence along the front and left property lines will
be removed.
