The site plan is approved for the construction of a 17,724 square foot extended stay hotel along Airport Road in the Shawnee Magisterial District. Stays over 30 days shall not be permitted at the subject hotel. Landscaping, screening, buffering, parking, curb & gutter, handicap accessibility, stormwater management, and other improvements are required for this development as detailed on the approved site plan. All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including review agency comments from all relevant review agencies. However, if marking and/or lighting are accomplished on a voluntary basis, we recommend it be installed and maintained in accordance with FAA Advisory Circular 70/7460-1 K Change 1. The structure considered under this study lies in proximity to an airport and occupants may be subjected to noise from aircraft operating to and from the airport. This determination expires on 6/23/2005 unless: (a) extended, revised or terminated by the issuing office. (b) the construction is subject to the licensing authority of the Federal Communications Commission (FCC) and an application for a construction permit has been filed , as required by the FCC, within 6 months of the date of this determination. In such case, the determination expires on the date prescribed by the FCC for completion of construction, or the date the FCC denies the application. NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETERMINATION MUST BE POSTMARKED OR DELIVERED TO THIS OFFICE AT LEAST 15 DAYS PRIOR TO THE EXPIRATION DATE. This determination is based, in part, on the foregoing description which includes specific coordinates, heights, frequency(ies) and power. The architect forwarded a copy of the FAA form 7460-1 that was filed in July. Unfortunately, Bill Merritt, Airway Specialist with the FAA, is responsible for reviewing studies for this airport but he is out of his office until November 14, 2003. Based on the information provided on the 7460-1, the airport's engineering firm, Delta Airport Consultants, determined that this site will not impact the FAA Part 77 surfaces of the Winchester Regional Airport. Mr. Sejal Patel will re -file the 7460-1 today however a response will probably not be received for at least another forty-five days. Rather than hold this project up further, I have no objections to the owner beginning the development process with the understanding that prior to the issuance of a final occupancy permit, the Airport must be provided a copy of the determination study completed by the FAA and any conditions outlined in the completed study must be met. I respectfully request that this condition along with the others outlined in my comment letter of June 27, 2003, be considered.
