The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on April 27, 2004. The site plan is approved for the construction of a 17,724 square foot
extended stay hotel along Airport Road in the Shawnee Magisterial District. Stays over 30 days shall not be
permitted at the subject hotel. Landscaping, screening, buffering, parking, curb & gutter, handicap accessibility,
stormwater management, and other improvements are required for this development as detailed on the
approved site plan. All requirements of the Frederick County Zoning Ordinance have been met in the
approved site plan, including review agency comments from all relevant review agencies.
At your request, six (6) copies of the approved site plan are being sent to Mr. Katen Patel. Please ensure that
these copies go to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be
kept for future reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this office to schedule
an on -site inspection. Do not hesitate to contact me should you have any questions or concerns.

** DETERMINATION OF NO HAZARD TO AIR NAVIGATION **
The Federal Aviation Administration has completed an aeronautical study under
the provisions of 49 U.S.C., Section 44718 and, if applicable, Title 14 of the
Code of Federal Regulations, part 77, concerning:
Structure Type: Building
Location: WINCHESTER, VA
Latitude: 39-8-42.5 NAD 83
Longitude: 78-9-16.5
Heights: 29 feet above ground level (AGL)
755 feet above mean sea level (AMSL)
This aeronautical study revealed that the structure does not exceed obstruction
standards and would not be a hazard to air navigation provided the following
condition(s), if any, is(are) met:
Based on this evaluation, marking and lighting are not necessary for aviation
safety. However, if marking and/or lighting are accomplished on a voluntary
basis, we recommend it be installed and maintained in accordance with FAA
Advisory Circular 70/7460-1 K Change 1.
The structure considered under this study lies in proximity to an airport and
occupants may be subjected to noise from aircraft operating to and from the
airport.
This determination expires on 6/23/2005 unless:
(a) extended, revised or terminated by the issuing office.
(b) the construction is subject to the licensing authority of
the Federal Communications Commission (FCC) and an
application for a construction permit has been filed , as
required by the FCC, within 6 months of the date of this
determination. In such case, the determination expires on
the date prescribed by the FCC for completion of
construction, or the date the FCC denies the application.
NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETERMINATION
MUST BE POSTMARKED OR DELIVERED TO THIS OFFICE AT LEAST 15 DAYS PRIOR TO THE
EXPIRATION DATE.
This determination is based, in part, on the foregoing description which
includes specific coordinates, heights, frequency(ies) and power. Any changes
in coordinates, heights, and frequencies or use of greater power will void this
determination. Any future construction or alteration, including increase to
heights, power, or the addition of other transmitters, requires separate notice

to the FAA.
This determination does include temporary construction equipment such as cranes,
derricks, etc., which may be used during actual construction of the structure.
However, this equipment shall not exceed the overall heights as indicated above.
Equipment which has a height greater than the studied structure requires
separate notice to the FAA.
This determination concerns the effect of this structure on the safe and
efficient use of navigable airspace by aircraft and does not relieve the sponsor
of compliance responsibilities relating to any law, ordinance, or regulation of
any Federal, State, or local government body.
A copy of this determination will be forwarded to the Federal Communications
Commission if the structure is subject to their licensing authority.

Dear Mr. Patel:
I have been working with your architect, Sejal Patel on this proposed site plan in trying to expedite the FAA
in their response to the 7460-1 that was filed in July 2003. The architect forwarded a copy of the FAA form
7460-1 that was filed in July. Unfortunately, Bill Merritt, Airway Specialist with the FAA, is responsible for
reviewing studies for this airport but he is out of his office until November 14, 2003.
Based on the information provided on the 7460-1, the airport's engineering firm, Delta Airport Consultants,
determined that this site will not impact the FAA Part 77 surfaces of the Winchester Regional Airport.
Mr. Sejal Patel will re -file the 7460-1 today however a response will probably not be received for at least
another forty-five days.
Rather than hold this project up further, I have no objections to the owner beginning the development
process with the understanding that prior to the issuance of a final occupancy permit, the Airport must be
provided a copy of the determination study completed by the FAA and any conditions outlined in the
completed study must be met.
I respectfully request that this condition along with the others outlined in my comment letter of June 27,
2003, be considered.

We have received your revised site plan dated March 15, 2004 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval. Also please provide four (4) sets of approved construction plans with
signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 645
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all
recorded plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to issuance of any
land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

In accordance with your request dated March 22, 2004 you are given permission to install a temporary construction entrance at
the referenced location. This letter is to be considered your permit to do so. The following provisions will be required:
• This letter permit is only for the temporary construction entrance. No other work is to be performed on the right-of-way.
• Work area protection signage is to be in accordance with the current Work Area Protection Manual while working on the
right-of-way.
• All work on the right-of-way is to be confined to the temporary entrance location only.
• A minimum 6" depth of VDOT #1 (2-3 inch stone) at a minimum width of 12' is to be placed from the edge of pavement
and extended a minimum of 70' with a filter fabric underliner.
• All materials spilled, dropped, washed or tracked from vehicles onto the roadway or into storm drains must be removed
immediately.
• Positive drainage is to be maintained within the right-of-way at all times.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this entrance will be repaired by
you to our satisfaction.
• This permit is being issued for 180 days.
• Ali work is to be completed in accordance with the enclosed Virginia Erosion & Sediment Control Handbook,
Specification 3.02.
• The entrance is to be installed at the location shown on the site plan prepared by Perkins & Orrison dated 02/13/04.
• Caution should be used when working near the right-of-way of Route 1092.
The Department of Transportation will not be held liable for suit should such result from this operation nor is it granting
permission to grade on the property of others or disturb underground utility lines. If the above listed items are not followed
this permit may be revoked.

Please see the attached letter regarding the Resident Suites Project. We have asked our
neighbor, Children's Services, permission to regrade a portion of their land in order to
manage the storm water for both properties. We have met with the Owner of Children's
Services, Sam Sabbagh, and he has given us permission to regrade a portion on the west
side of his property. The attached letter is an original signed copy of our agreement for
your record. The letter also summarizes the scope of work. We would like the attached
letter to be part of our submission to the County. Currently, we have re -submitted
drawings for your review with the proposed changes described in the letter.

have spoken to Ms. Serena Manuel regarding the comments, she has asked me to forward
them to you. The Engineers from the Winchester Regional Airport have approved our
submittal, however we are awaiting official comments from the FAA (Aeronautical Study
Determination). This document, along with any additional information required, will be
forwarded to your office upon receipt.
Below is our response to the comments provided from the Winchester Regional Airport:
1. The FAA Form 7460-1 was submitted on July 181h, 2003, we are awaiting
comments from the FAA (Aeronautical Study Determination).
2. All outdoor lights will be shielded to prevent light pollution to approaching or
departing aircraft.
3. The Contractor has been instructed to contact Mr. David Foley (540-662-
2422) before any and all crane operation.
4. Currently, the Contractor does not see the need for burning, however proper
protocol will be followed as noted.
5. As submitted to the Winchester Regional Airport in the FAA Form 7460-1,
the height of the structure is 29'-0" and the finished floor elevation is 726'-0"
AMSL.

I have reviewed the information provided on the referenced project. Based on this information the following
comments are offered:
1. In accordance with the Code of Virginia, Section 15.2-2294, and the Federal Aviation
Administration Notice of Proposed Construction, FAA Form 7460-1 Is required to be fllGd with
the Federal Aviation Administration with a copy forwarded to this office for record. Upon
completion of the aeronautical study by the FAA, a copy must be forwarded to this office for final
review comment.
2. All outdoor lighting should be shielded type to prcavent light pollution to approaching or departing
aircraft.
3. Twenty-four hours prior all crane operations coordination must be made with David Foley,
Winchester Airport Operations Supervisor, in order to ensure coordination with the Dulles
approach center.
4. Due to the proximity of the site to the approach zone for Runway 14, outside burning should be
prohibited if possible and debris removed from the site. Should burning take place, coordination
with Airport Operations Supervisor must be made twenty-four hours pdr)r In order to allow ample
time to notify Dulles approach center.
5. The following additional information is needed by tho airport: maximum height of proposed
structure to include all appurtenances and the finished floor elevation.

Staff has reviewed the resubmitted preliminary site plan for the above -referenced project, dated
December 23, 2003. The subject site plan is the 3`d submitted site plan reviewed by staff for this project.
Please be advised that the site plan is denied until all of the review comments noted in this letter, and
all agency comments, are adequately addressed. These review comments are as follows:
I) Tree Species. Please replace the myrica pensylvanica (North Bayberry) and viburnum dentatum
(arrowood viburnum) plants with acceptable trees, as specified in Section 165-36 B of the
Frederick County Zoning Ordinance. I would suggest that you use tsuga canadensis (Canadian
Hemlock) for the evergreen tree, and perhaps a variety of prunus (cherry tree) or malus
flowering crabapple).
2) Perimeter Landscaping. The site plan uses the county's old standard for calculating the
number of required trees for perimeter landscaping. The new zoning ordinance requirement
requires one acceptable deciduous shade tree for every 2000 square feet of impervious area.
Please provide new landscaping calculations which reflect this requirement.
3) Number of Evergreen Shrubs. The site plan illustrates 25 evergreen shrubs as part of the
hedge row in front of the parking spaces facing Airport Road. However, the plant materials list
on the same page only shows 15 shrubs. Please correct as necessary to provide a continuous
hedge row to screen headlights from the adjoining road.
4) Landscaping Plan. Please attach the landscaping plan sheets with the site plan rather than
submitting it as a separate document. Please also ensure that a certified Virginia engineer, land
surveyor, or landscape architect signs and seals the plans.

5) CG-6. Please provide CG-6 instead of CG-2 for all parking areas.
6) Frederick County. Please correct the county reference to indicate that this project is within
Frederick County, not Winchester County.
7) Airport Road. Please change the reference from Airport Drive to Airport Road, which is the
correct name of the adjoining road.
8) Title. Please change the title to indicate that this is a site plan, not a site and utility plan. The
utility plan is part of the site plan itself.
9) Use. Please provide a detailed narrative on the site plan elaborating on what an extended stay
hotel means. As you are aware, residential uses of this nature are not permitted in the 132 Zoning
District. I would suggest that you include language which limits stays in the same room to 30
days, which is consistent with the Virginia building code classification system.
10) Inactive Buffer. Is there a retaining wall proposed within the zoning buffer? If so, please label
the retaining wall and move it outside of the inactive portion of the buffer.
11) Special Limited Power of Attorney. Please have the owner of the property complete the
attached power of attorney form. The intent of this form is to ensure staff that your firm has
authorization to represent the property owner for this site plan project.

1) Owner's Information. Please provide the owner's information on the first page of the site plan. This

3) Designer's Information. Please provide legible information for the designer of this site plan on the first
page of the site plan. This includes a name, address, and phone number.
4) Zoning Administrator Approval Box. A statement beside this space should indicate that approval of
the plan is valid for five years from the date of approval.
5) Legible Surveyed Boundary Lines. Please provide legible surveyed boundary lines for the subject
parcel. It is unclear where some of the property lines area are. It is also unclear where some of the
easements are.
6) Proposed Travel Aisle Setback. Please move the proposed travel aisles along the left and right
property lines so they are at least five feet from adjoining properties. The travel aisle along the right
property line will need to be set back at least ten feet to accommodate the required landscape screen
described in the next comment.
7) Buffers. A Category A buffer is required adjacent to the right property line and a Category B buffer is
required along the rear property line. This does not appear to be adequately provided for, as required
by the Zoning Ordinance (also see comment #12, which is related). Being that space appears to bean
issue, you may want to pursue a common shared buffer agreement with adjoining property owners.

shall be shielded and/or directed away from adjoining properties and roads to prevent glare.
9) Outdoor trash receptacles. Please show details of the proposed dumpster fence with the details of the
gate which you have provided. The details should be a standard opaque board -on -board fence at least
six feet in heighth.
10) Signage. It appears that the proposed business sign may be less than ten feet from property lines and
three feet from curbs. Please clarify and change the site plan to conform to these requirements as
appropriate. No standard business sign may exceed 100 square feet in size or 35' in heighth. These
requirements should be stated on the site plan.
11) Loading Spaces and Calculations. Please show the location of all proposed loading spaces and their
maneuvering areas. Please also provide loading space calculations on the first page of the site plan as
determined by the requirements of the Frederick County Zoning Ordinance, Section 165-28.
12) Landscaping Calculations & Plan. The landscaping plan provided needs to be revised as follows:
a) Austrian Pine, Red Pine, Drake Elm, Variegated Pittosporum, White Ash and the Glossy Abelia
are not permitted plant varieties, based on Section 165-36 of the Frederick County Zoning
Ordinance. Please replace these plants with species that are permitted.
b) The size of the required plants at planting should described as follows: deciduous trees - two
inch caliper, evergreen trees - four foot height, and slu-ubs - three gallon container. Of course
these are minimum specifications.
c) Planting a row of trees in the existing rip -rap ditch may be futile. Furthermore, the row of trees
does not conform to the minimum specifications for a landscape screen as described in Section
165-37 B. The same is the case with the proposed screen in the rear of the property. Landscape
screens must be at least ten feet in width and include three trees per ten linear feet. One third
of these trees must be deciduous and the majority must be evergreen.
After you have revised the site plan, please resubmit one copy, so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan for

16) Proposed Travel Aisle Setback. Please move the proposed travel aisles along the left and right

right Property line will need to be setback at least 10 feet to accommodate the required landscape
screen described in the next comment.
17) Buffers. A Category A buffer is required adjacent to the right property line whicli adjoins an M1
Zoned parcel. A Category A buffer requires a landscape screen, as defined by the Frederick
County Zoning Ordinance. alld a Il1I1111"U1ll of 10 feet In width. A Category B buffer is required
front the rear property line, which adjoins residential properties within the RA Zoning District.
A Category B buffer requires a minimum of 50 feet of buffer area with a full screen, as defined

inches in hei apt and made of concrete material CG-6 is the standard curb used for developments
in Frederick County. Please change the site plan as necessary to address this issue.
119) Parking Lot Islands. Raised concrete and landscaped islands are required at the ends of all
parking bays. While this is provided on the proposed plan, the width of these islands is less than
required. All islands are required to be at least nine (9) feet in Nvidth.
210) Outdoor lighting fixtures. Please show the location of all proposed outdoor lighting fixtures.
A statement should be provided on the site plan to the effect that all light shall be shielded and/or
directed away from adjoining properties and roads to prevent glare.
21) Outdoor trash receptacles. Please show the location of all proposed outdoor trash receptacles.
All clumpsters should have a concrete pact and an opaque fence and gate for screening.
22) Signage. Please show the locations of all proposed signs. The proposed dimension of the signs

24) Pat -king Lot Calculations. Please provide parking space calculations as determined by the
requirements of the Frederick County Zoning Ordinance, Section 165-27. Hotels required at least;
one parking space per room plus additional spaces of restaurant/food service areas and meeting

25) 1 aI1dSCaj)lilg Calculations & Plan. Please provide a landscaping plan and include landscaping
calculations For interior and perimeter landscaping, as required in Section 165-27E(11). Please
note that the Board of Supervisors recently adopted a revised Section 165-27E(11). The revision
changes the way perimeter landscaping is calculated. This hotel would be required to provide one
deciduous tree (at least 2" in caliper) for every 2,000 square feet of impervious area, plus one
deciduous tree for every 10 parking spaces of the interior landscaping. The landscaping plan
should include a planting schedule which provides the caliper (for deciduous trees) and height (for
evergreen trees) at planting. The species of plant and quantities of plants should also be provided
in the planting schedule. This includes landscaping required for the required buffer screens and
evergreen hedges.
Z6) Open Space Calculations. Please provide theamount Ofopen space (landscaped area) provided
Nvith this development. The zoning ordinance requires that at least 15% of the site be landscaped
area; of this. at least 5% of the interior parking area must be landscaped.
27) Evergreen hedges. Please provide an evergreen hedge at the end of parking spaces which are
pointed outward from the property. This includes the parking bay facing Airport Road and the
parking bay facing the left property line.
28) Height. Please provide the proposed llcight of all proposed structures.

Office area, recreation, vending machine, food service, or otheI' areas.

32) Statement Regarding Extended Sta31 Hotel Use. Please provide a statement on the site plan
which describes an extended stay hotel, as proposed. The zoning of the property is not
appropriate for residential use. I ant of the opinion that a statement should also be provided
which explains that no rooms shall be rented for a period of time longer than a week at a time.
Another statement to the effect that no rooms will be used for residential use is necessary. Please
also provide a typical layOUt Of a 1'00111 on the Site plan.

total floor area and total ground floor area should be given.
34) Speed Limit. Please provide the speed limit along Airport Road.
35) Entrance Spacing. Please provide the proposed spacing between the proposed entrance to the
subject property and the closest entrance off of Airport Road to both the east and west.

36) Utilities. Please show all utility lines and their proposed connections. Any existing easements
need to be shown on the site plan.

(I 0' x 18' or 9' x 20').

contained on the plan. I will need all approved review agency comment sheets and at least five copies
of the final plan for approval. Comment sheets are required from the following agencies: the Virginia
Deparnnen/ u1 Transrnrtation, the Frederick County Inspections Department, the Frederick County
Ei7gineer. the Frederick County Fire ,1✓farshal, the Frederick County Sanitation Authority, the Frederick
County Health Department, and the Frederick County Airport Authority.
