Dear Mike:
The Frederick County Department of Planning and Development administratively approved the above -referenced
site plan on July 15, 2003. The site plan is approved for the construction of a retail plaza in the Stonewall
Magisterial District. The project is proposed to be developed in four phases. The proposed square feet of
building structures for each phase is as follows: Phase One - 17,500; Phase Two - 10,500, Phase Three - 12,000;
and, Phase Four - 23,100. Some of the intended uses for the development include a motorcycle sales business
restaurants, and numerous retail stores. An interim truck parking lot is proposed for Phases One -Three of the
development, but will be converted to required parking in Phase Four.
The approved site plan meets the requirements of the Frederick County Zoning Ordinance, Subdivision
Ordinance, review agencies/departments, and the proffers associated with the rezoning of the property (REZ #04-
03). One new commercial entrance, extensive landscaping and screening, a berm, paved parking, curb & gutter,
striping, a pump station, fire hydrants, loading spaces, sidewalks, and a stormwater detention facility are all
required improvements for the development. Water & Sewer will be provided by the City of Winchester.
I am providing you with three copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and an
approved copy must be kept on the construction site throughout the development process. Once site development
is complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to contact
me should you have any questions or concerns.

We have reviewed die following:
1. North Park Plaza, Sheets 3 of 7 and 7 of 7, dated March 18, 2003.
Based on our review we have the %flowing comments:
1. Sheet 3 of 7, Water. Please show the new watermain and hydrant lines within
a 20' easement.
2. The minimum size ofa watermain in a commercial development is 8 inches.
3. Please change the utility sheet to show the plan on top and the profile on
the bottom.
4. Please show connecting to the existing 12" main with a ductile iron tapping
sleeve and valve.
5. Install 6" valves on all fire hydrant tees at the new main.
6. Service lines cannot be tapped off fire hydrant lines. A separate tap has to be
made at the main. They can be installed in the same ditch with a minimum
seperation of 3 feet.
7. Please submit a water study to insure the existing watermain has Sufficient
capacity and fire flow.
8. Station 11+45 — Fire hydrant line — Remove the 90 degree bend. Line should
run straight to hydrant.
9. Carrier pipe should be installed on casing spacers inside encasement pipe.
10. Please show size of services on the utility plan.
11. If a possibility exists of extending the new watermain east at station 15-I-00, a
main line valve and a length of pipe will have to be installed.

12. Sheet 3 of 7 Sewer — Please submit a sewer study to insure the existing 6"
force main has sufficient capacity for this development.
13. The pump station must have a check valve on the'City side for maintenance
purposes.
14. The pump station and on -site sewer mains are to be privately maintained.
15. Sheet 7 of 7, Water Profile: Please show the location of all hydrant tees and
services on the profile.
16. Please include a detail sheet showing the City of Winchester- Standards for
pipe installation, services, ditch profile, hydrant installation and encasement
pipe details.
No error or omission in either the plans, calculations or applications (whether these plans,
calculations or applications have been reviewed by the City or not) shall permit or release
the applicant and designer from constructing this work in any other manner than that
provided for in the City Ordinances.

Dear Mr. Artz:
'You have made considerable changes to the North Park Plaza site plan since I last reviewed it. However, there are
a few minor issues which need to be addressed before staff is able to grant approval of the site plan. These are the
same comments I discussed with you during our meeting earlier today. Please prepare a revised site plan which
addresses each of the comments shown below.
REVIEW COMMENTS
1) Move Phase 4 sidewalk to Phase 3. Please provide the sidewalk shown in front of the proposed building
of Phase 4 during Phase III construction. This is necessary to provide adequate pedestrian access for the
parking area.
2) Loading Space. Staff recommends that you consider providing a curb cut and crosswalk fortheproposed
loading space in front of the Phase4 building. This would allow for easier unloading fortrucks when they,
require loading and unloading from the side.
3) Access Easement Alteration. Prior to the approval of the site plan, a revised plat will need to be approved
and recorded for the alteration in the access easement used by Quarles Petroleum. Modifications to the
Phase 4 building would be necessary if the access easement is not changed.
Approval of the site plan can be granted after each of the above comments are adequately addressed in a revised
site plan and when all relevant review agencies have provided their approval.

The 17,500 sq. ft. Building shall comply with The Virginia Uniform Statewide Building Code and
Sections 311, Storage of the BOCA National Building Code/ 1996. Other Code that applies is
CABO A 1 17.1-92 Accessible and Usable Buildings and Facilities. The other structures do not
have a use group classification on the plan at this time. Please submit the use for each structure.
Note table 702.5 of BOCA for Fire resistance rating of the exterior wall between buildings based
upon there use.
HC parking appears to be in compliance however access to and egress from the buildings man exit
doors are not shown on the plan.
Question the design information on the FM sewer pump. Please submit the detail of the pump
station including( GPM, HP, Type Required, Alarms, ect.), unless this unit is property of the
Sewer Authority
Design Professional lic. in VA shall seal the structural plans submitted for permit application and
special inspection requirements of Chapter 17 of BOCA shall apply to this type of structure.

A VDOT review has been completed on the preliminary site plan dated March 6, 2003 for the
referenced project. Our comments follow and arc shown in red on the plan sheets:
Plan Shect 2 of 7
• Curves #32 and #54 radii may be 35'. This will allow proposed Route 1 1 entrance access
to be moved further south. We recommend the entrance be moved as much as possible to
the south.
• CG-1 1 Standard VDOT commercial entrance should be used on the Route 1 1 entrance.
• Appropriate end section treatment should be called for at culvert ends. Please note that
Standard ES-1 is for CO11C1'ete CLllvcrt.
• The entrance should display a standard VDOT stop sign as shown.
• VDOT AADT should be shown of VDOT facilities.
• Width of cntrancc should be 40' F.C.
• The 12' t111-11 lane on south of entrance should have Curb and gutter to property line, 12'
pavement should extend 100' south of property line, a 4" paint stripe should be shown to
outline taper on asphalt.

• Drainage flow arrows should be used on parking surface and entrance.
• A typical section should be provided for Route 11 turn lane and a profile of entrance.
• Length, sire and type Of Culvert should appear on plan sheets.
• May be desirable to relocate ADA parking space to less active area.
• Construction entrance activity should be an access to Route 1323, Park Center Drive.

concrete culvert, please designate appropriate ES.

We have received your revised site plan dated June 3, 2003 for the referenced project. It appears all of our
earlier review comments have been satisfactorily addressed. Please advise the owner of our approval. Also
please provide six (6) sets of approved construction plans with signed seal for VDOT distribution.
Per our June 11, 2003 meeting, the pipe at the entrance to Route 11 should have size and length placed on the
plan sheet.
The appropriate land use permit may now be applied for to cover work within the Route 11 right-of-way. The
permit is issued by this office and will require a minimum processing fee, surety bond coverage, and the salary
& expenses of a State assigned Inspector. A copy of any/all recorded plats of dedication for drainage
easements or additional right-of-way required for implementation of this proposed project should be provided
to VDOT prior to issuance of any land use permits. Dedication should be made to the Commonwealth of
Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty days to process
and issue. Should you have any questions, do not hesitate to call.

have completed a preliminary review of the site plan for North Park Plaza. Comments are listed below
'or your consideration. Each review comment must be adequately addressed. I have enclosed an edited

REVIEW COMMENTS
General Zoning Comments:
1) Internal Zoning Line. Please show and label the internal zoning boundan- line. Metes and
Bounds of the line should be provided.
2) Access Easement. Please label the access easement which provides access to Park Center Drive.
3) Structure Within Access Easement. Please remove the proposed structure from the access
easement referred to above.
4) Outdoor Display Area. Please move the proposed outdoor display area further away from
Route 1 I. The 10-foot landscape strip must be located outside of the display area.
5) Signage. Please show the location of all proposed signs. Please also show the proposed signs'
details on the site plan.
6) B3 Zoning District Structure Setbacks. Please provide the required setbacks for the B3

;) Acreage References. Please remove the acreage references shown on the Quarles parcel. They
do not appear to serve any useful purpose.
Parking (.'ommenls:
Aisle Width. Please provide parking aisles at least 22 feet wide at all locations. The parking
aisle closest to Route I 1 is shown as only being 19 feet in Nvidth.
�)) Internal Parking Circulation. Staff sloes not believe that the layout of the proposed parking

lot provides adequate circulation of vehicles, and may pose a traffic hazard. Tile layout has no
means of controlling tral�fic flow to and ft•olll the Route I I entrance. Please provide a center
travel lane fi•olll the Route I i eiltt•ance till•OLlgll the part(invT area to the rear entrance. A possible
alternative is chwvii on the attached site plan.
10) Phase III Parking Lot Access. Please provicle adequate pedestrian access from the Phase III
parking lot to the proposed retail plaza. Potentially, the lame parking lot island between the
development and the Phase IIi parking lot could be constructed Nvith a park -like clesign, Nvith
trails, benches and street lights. This may be feasible, because you could satisfy the buffer
recluil•ement ill the pl•ocess.
1 1) Phase i Interim Truck Parking. Please show curb and gutter, striped concrete islands,
landscaped islands, landscaping, and all other required improvements for the Interim Truck
Pairkim, facility. All required inlprovelllents need to be constructed during Phase 1.
12) Phase I Parking. Please provicle colic] -etc bumpers, at least 6 inches tall, at the perimeter of the
Phase I parking area that adjoins the Phase 11 parking area. These concrete bumpers would only
be permitted as a temporary measure until the phase II parking is constructed. Please provicle
a statement on the site plan to the effect that curb and gutter shall be constructed along this
perimeter if after five years, Phase It is not built.
13) Phase I & It Parking Lot Access. Please provicle crosswalks and/ol• sidewalks to the Phase I
and II Parking Lot.
14) Loading Spaces. Please provicle loading space calculations. Please show and label all proposed
loading areas, including spaces.

15) Zoning Buffer. Please provide the required Category B Zoning Buffer along the internal zoning
line, which separates the B2 Zoning District from the B3 Zoning District.
16) Details Of All i3uffers & Landscape Easements. Please provide details of all proposed buffers
and landscape easements.
17) Evet-grcen Hedge. The proposed shrubs along Route 1 i do not appear to provide a continuous
evergreen hedge. Please decrease the separation of these shrubs as necessary.
18) GI-ading & SeediIlg. Please Co11sider grading and seeding Please 11 during Phase I of the
development process.
The land which would comprise this development is presently in the rezoning process. The Fredericl:
County Board of Supervisors is scheduled to reconsider the rezoning during their meeting on April 9,
2003. The Board deferred the consideration of the rezoning cluring their March 10. 2003 meeting, in
order to give the owner the opportunity to remove all tractor truck trailers from the subject parcel of
land. Site plan approval cannot occur unless the Board Of Supervisors approve this rezoning.
Please prepare a revision Of this site plan, which addresses all comments, and submit one Copy for Illy
review. Once all of the above issues are adequately acich•essecl, and all other agency conlnlents addressed,
the site plan should he ready for approval. Approved comment sheets are required from the following
agencies: the Virginia Department of Trcnnsportalion (hDOT), the Frederick Coamty Inspections
Departmenl, the Freclerick('ounty hire AI,-nwhal, the the,4i/7)07't

Dear Mr. and Ms. Simkhovitch:
An Irrevocable Letter of Credit (LOC) was received by Frederick County, on November 13, 2003. This
LOC was for the amount of $120,000, to insure completion of Phase 1, North Park Plaza (Site Plan #21-03. )
All of the site improvements must be complete by June 1, 2004. If the site improvements are not complete
by June 1, 2004, Frederick County will execute the terms of this LOC to make all the necessary
improvements to the site.
