complete prior to accepting it. If any portion of the application is not complete, it will be returned to the

This Recordation of Plat and Deed of Easement, made this day of
August, 2005 by JEM VII. LLC, a North Carolina Limited Liability Company, being
the owner in fee simple of those certain parcels set forth and described on that certain
"Plat Showing Drainage, Waterline, Sanitary & Access Easements Through Lots 3 and
4 of the Lands of JEM VII, LLC" dated July 29, 2005 and prepared by Elliott Ritchie,
Jr., L.S. attached hereto and recorded herewith. The described property being that
conveyed to JEM VII, LLC, by deed recorded in the Clerk's Office of the Circuit Court
of Frederick County, Virginia as Instrument No. 050015374.
The attached plat places of record, and grants and conveys, for the benefit of Lot
4, an easement for ingress and egress of pedestrians and vehicles accessing Lot 4 across
Lot 3 over and upon that area designated as "Proposed Access Easement" on the plat

This Recordation of Pict and Deed of Basement, made tbiscZ4_- day of

THIS DEED OF EASEMENT, made this �' `t day of August, 2005, by and
between JEM VH. LLC, a North Carolina limited Liability Company, party of the first
part, hereinafter called the Grantor, and the COMMOl1)YEAi,TH OF VIRGINIA,
DEPARTMENT OFTRANSPORTATION party of the other part, hereinafter called
the Grantee.
WITNESSETH: That for and in consideration of the sum of One Dollar ($ 1.00),
cash in hand paid and other valuable consideration, receipt whereof is hereby
acknowledged, the Grantor does hereby grant and convey unto the Grantee those
drainage easements designated "Proposed Drainage Easement" and "Proposed 20'
Drainage Easement" on that certain plat of Elliott Ritchie, Jr., Land Surveyor, dated July
29, 2005, attached hereto and incorporated herein in full by this reference, together with
temporary construction easement ten adjacent thereto, said easements being over and
upon Lot 3 and Lot 4 of the lands of the Grantor acquired by deed recorded in the Office
of the Clerk of the Circuit Court of Frederick County, Virginia as Instrument No.
050015374.
The drainage easements herein conveyed grant to the Grantee the perpetual right
to install, lay and maintain each drainage easement, including the right to go on, over
and upon each easement for the purpose of installing, laying, maintaining, repairing and
replacing the same as needed. The casement designated "Proposed 20' Drainage
Easement" shall be installed, laid and maintained below the surface of the ground.
The said temporary construction easements grant to the Grantee the right to enter
upon them to the extent necessary for and during the original construction, installation
and laying of the said drainage easements. The temporary construction easements shall
expire upon completion of construction of the drainage easements.
Grantor shall retain the right to use its land which is subject to the easements
acquired herein in any manner which shall not interfere with the use and enjoyment of
said rights by Grantee. Grantor shall at all times have the right to cross over and upon
the said easements and to use the surface over the easements in such manner as will

neither injure nor interfere with the construction, operation or maintenance of the
drainage easements, except that no building or other structure shall be erected over the
permanent easements unless by mutual consent of the parties or their successors.

of the ground, it shall be the obligation of Grantee to restore the same to its condition
prior to being so disturbed at Grantee's expense.

Electronic Message Boards: Frederick County does not allow
animated or flashing signs.
Manual Reader Boards. Assuming that these are letters that
have to be changed manually and have no electronic or

The Frederick County Sig,, Ordinance can be obtained online
or a copy can be faxed to you.
Accent lighting may be permitted as long as it does not shine

The code allowed signage sheet from the sign package shows three freestanding signs.
There a large pylon sign and two monument signs. The monument sign along Tasker
Road may be permitted as long as it is at least 50' from the large pylon. The other
monument sign shown along Warrior Drive by the other entrance will not be pern-ritted. If

This letter is in response to your corresponcleliec dated September 8, 2005, to the Zoning
Administrator requesting a zoning cleternlination on the above -referenced property. In
the correspondence, you indicated that this property is in the general business district. Per
your request, Frederick County Zoning requires that all signs on this property must
adhere to the approved site plan and additional requirements set forth in this letter, via
Frederick COL111ty Zoning Ordinance.
The proposed free standing business sign (24' x 15'8", 237 sq.ft.) fails to meet
requirements of the Frederick County Zoning Ordinance. Therefore, the proposed signage
would be prohibited by Section 165-30A(1) and l 65-301-I(1) of the Frederick County
Zoning Ordinance (see attached). Section 165-30A(1) states that animated or flashing
signs shall be prohibited in all zoning districts and Section 165-30I-1(1) prohibits
franchised business signs exceeding 150 sq.ft.

(2) In such cases, the Zoning Administrator may require a "traffic
access plan which describes existing traffic, conditions and
design on the streets abutting the site and the methods proposed
to ensure that the intent of this section has been met.
C. Internal circulation. A complete system of internal traffic circulation
shall be provided to serve all uses in any shopping center, industrial
park or any development included in a single master development
plan, site plan or subdivision plat approved by Frederick County. In
such developments, internal access shall be provided in a fashion so
that all uses can be mutually accessed without entering onto arterial or
primary highways. In such cases, a pattern of internal circulation shall
be designed to ensure that conflicts are avoided between moving
vehicles, parking areas, pedestrian areas, loading areas and the various
uses provided.
D. Pedestrian access. Safe pedestrian walkways shall be provided to all
uses on land included in a master plan or site plan approved by
Frederick County. Sidewalks shall be provided in conformance with
adopted corridor or walkway plans or approved master development
plans. The Planning Commission may require additional sidewalks or
walkways on master plans or site plans to promote a general system
of pedestrian access in residential neighborhoods or business
corridors.
E. Fire lanes. Fire lanes shall be required as set forth in Chapter 90, Fire
Prevention. [Added 12-9-19921
§ 165-30. Signs.
Signs shall be allowed or prohibited according to the following requirements
in order to promote safety, to protect property values, to create an atmosphere
conducive to orderly economic growth and to meet the intentions of this
chapter:
A. Signs prohibited in all districts. The following types of signs shall be
prohibited in all zoning districts:
(1) Animated or flashing signs.
(2) Signs painted directly onto the exterior of buildings.

G. Height. No sign shall exceed the maximum height requirement for the
zoning district in which they are located. All signs other than business
signs shall be no more than 10 feet in height. No freestanding
business entrance sign shall exceed five feet in height.
H. Size. The following restrictions shall apply to the size of signs:
(1) No business sign or directional sign shall exceed 100 square feet
in area. Standardized, franchised signs may exceed 100 square
feet in area but shall not exceed 150 square feet in area. In the
B1 Neighborhood Business District, no business or directional
sign shall exceed 50 square feet in area.
(2) Cottage occupation signs shall not exceed four square feet in
area.
(3) Wall -mounted business signs in the B2 Business General, the B3
Industrial Transition, M1 Light Industrial, the M2 Industrial
General or the MS Medical Support Districts shall be permitted to
encompass 20% of the area of the wall to which the sign is
attached, provided that the total area of the wall -mounted
business sign does not exceed 200 square feet. [Amended

(4) No freestanding building entrance sign shall exceed four square
feet in area.
I. Maintenance. All signs shall be maintained in a state of good repair.
Signs that are damaged, structurally unsound or poorly maintained
shall be repaired or removed within 30 days.
(1) If an off -premises sign advertises a business or activity that is no
longer being operated or conducted or if a directional sign refers
to a location where the advertised activities no longer exist, that
sign shall be considered to be abandoned and shall be removed
by the owner within 30 days.
(2) If the message portion of a sign is removed, the supporting
structural components shall be removed or the message portion
replaced within 30 days.

In accordance with your request dated June 28, 2005 you are given permission to install a temporary construction
entrance at the referenced location. This letter is to be considered your permit to do so. The following provisions
will be required:
• Work area protection signage is to be in accordance with the current Work Area Protection Manual while
working on the right-of-way.
• All work on the right-of-way is to be confined to the temporary entrance location only. A land use permit
will need to be applied for and issued prior to any additional ►vork on the right-of-way. This permit requires
a fee and surety bond coverage.
• A minimum 6" depth of VDOT #1 (2-3 inch stone) at a minimum width of 12' is to be placed from the edge of
pavement and extended a minimum of 70' with a filter fabric underliner.
• All materials spilled, dropped, washed or tracked from vehicles onto the roadway or into storm drains must be
removed immediately.
• Positive drainage is to be maintained within the right-of-way at all times.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this entrance will be
repaired by you to our satisfaction.
• This permit is being issued for 90 days.
• All work is to be completed in accordance with VA Erosion & Sediment Control Handbook, Specification 3.02.
• The entrance is to be installed at the location described in your request letter dated June 28, 2005.
The Department of Transportation will not be held liable for suit should such result from this operation nor is it
granting permission to grade on the property of others or disturb underground utility lines. If the above listed items
are not followed this permit may be revoked.

Within two weeks, I should have the Surety Bond and Application to Rhonda for the road
improvements that we are required to make to Warrior and Tasker Roads.
We anticipate being able to start construction by July 15`h, and as you informed me the
last time we spoke, this letter is to request permission from you, to access our site from
the northernmost curb cut on Warrior Road.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Siana e. It was our understanding that the developer, in discussion with Mr. Lawrence and Mr.
Ruddy, was willing to provide some additional features to make this site more aesthetically
pleasing. Due to the location of this property, and that this is the first commercial development
in the area, it is strongly suggested that a monument style sign be utilized that is similar to the
CVS sign for the new building on Valley Avenue (excluding message board) to enhance this
corridor.
2) Plant Substitutions. On Sheet 12 of 13, under the landscape installation notes, include with
note 11 that all plant substitutions must be approved by the Frederick County Planning
Department.
3) Zoning District Buffer. On Sheet 12, the shared buffer for this portion of the property is a 100'
landscape buffer (25/75). The active portion of the buffer on the CVS is 25'; please label the
portions of the buffer.
4) Zoning District Buffer Trees. The approved Subdivision Design Plan for the Guards shows
that the landscaping is going to be installed by the subdivision in their inactive portion of the
buffer. It is understood that this site plan is showing the plants on "The Guards" property to
depict the screen of the shared buffer. For clari fication purposes, the zoning district planting list
should be removed from Sheet 12 of this site plan and a statement by "The Guards" plantings
stating that these are being provided by the subdivision developer. Also, it is understood that the

d. Wheesstops: The design of the entrance of the proposed CVS building has a
covered sidewalk/entrance with support columns that will be very close to the
curb of the parking area. The wheelstops are to prevent motorists from pulling
their car too close and damaging the columns and their cars. The wheelstops are
only necessary directly in front of the covered entrance but installing them in the
entire bank of parking will provide aesthetic continuity and also provide a better
visual indicator that the wheelstops are there.
Inter parcel Connector: The proposed inter parcel connector has been labeled on
the plans. However, The "do not enter" sign has been left in place. The bank of
11 parking spaces next to the sign is designed for two-way traffic. Moving the
sign closer to Tasker Road would create more confusion about traffic patterns on
the site.
13'. Signage: All signs for the CVS development shall conform to the Frederick
County Zoning Ordinance. This has been noted on the plans.
14. Landscaping: A note has been added to Sheet:12 stating all plantings shall
conform with the Frederick County Zoning Ordinance.
45. Existing Trees: Because of site grading operations that will occur on the site to
install the proposed stream culvert and parking areas it is not possible to
preserve all the trees along the property/buffer line. However, the limits of
construction line indicates that some of the vegetation will be preserved along at
feast a portion of the buffer area.
L16.Common Shared Buffer Landscaping: As indicated in the landscape notes on
Sheet:12, The screening plants for the buffer are located in the shared inactive
buffer on the adjacent property as well as preservation of the existing trees with
in the inactive buffer. The trees proposed in the active buffer on the CVS site are
supplementary to provide extra screening for the proposed residential
development.

We have received your revised site plan dated April 1, 2005 for the referenced
project. It appears all of our earlier review comments have been satisfactorily
addressed. Please advise the owner of our approval. Also please provide five
(5) sets of approved construction plans with signed seal for VDOT
distribution.
The appropriate land use permit may now be applied for to cover work within the
Routes 719 and 642 rights -of -way. The permit is issued by this office and will
require a minimum processing fee, surety bond coverage, and the salary &
expenses of a State assigned Inspector. A copy of any/all recorded plats of
dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to
issuance of any land use permits. Dedication should be made to the
Commonwealth of Virginia.
Also, we will need a copy of the recorded plats from the Frederick County
Clerk's Office for the two drainage easements prior to permit issuance.
Once satisfactory application has been made, a permit will normally take
approximately thirty days to process and issue. Should you have any questions,
do not hesitate to call.

Building shall comply with The Virginia Uniform Statewide Building Code and section 309, use
group M (Mercantile ) of the International Building Code/2000. Other code that apply are CABO
Al 17.1-98 Accessible and Usable Buildings and Facilities.

Enclosed please find revised plans for the CVS Pharmacy site plan identified as
SP-11-05. The plans have been revised to address the comments made by you and
your staff. The comments concerning the site plan have been addressed as follows:
1. Parking Spaces: After recounting the parking spaces proposed on the site plan
we found that there are 66 parking spaces shown.
2. Project Overview: The adjoining property information for the land across Tasker
Road has been added to the Sheet:1 project overview.
3. Utilities: Our office is currently in the process of coordinating with Allegheny
Power the location of the underground electric connection.
Et. Bike Path/ Sidewalk: The Asphalt bicycle path has been increased to 10' in width
with a 2' grass strip between the face of curb and the trail. The concrete sidewalk
that is proposed along Tasker Road has been increased to 5' wide. There
continues to be a 2' grass strip proposed along Tasker Road. Please refer to the
street sections and plans on Sheet.-5 for additional information regarding the
R-O-W improvements.
5. Grass Strip: Please refer to Sheet.-5 for information regarding the R-O-W
improvements.
6. Pedestrian Crossing: A 4 ' wide pedestrian crosswalk has been added to the
plans in the Warrior Drive and Tasker Road entrances.
7. Building Size: 13,013 sf represents the building footprint area. 14,391 represents
the total floor area including a mezzanine area. This has been labeled more
clearly in the coversheet notes and on Sheet: 7.
S. Dumpster Area: The proposed dump.�ter area has been labeled on Sheet:7. The
construction detail referenced on Sheet:13 indicated a screening wall instead of
--a board on board fence.
Stream: The intermittent stream existing on the site has been added to the plans.
.Legal References: All legal references for all known existing easements have
been added to the plans.

11. Wheelstops: The design of the entrance of the proposed CVS building has a
covered sidewalk/entrance with support columns that will be very close to the
curb of the parking area. The wheelstops are to prevent motorists from pulling
their car too close and damaging the columns and their cars. The wheelstops are
only necessary directly in front of the covered entrance but installing them in the
entire bank of parking will provide aesthetic continuity and also provide a better
visual indicator that the wheelstops are there.
12. Inter parcel Connector: The proposed inter parcel connector has been labeled on
the plans. However, The "do not enter" sign has been left in place. The bank of
11 parking spaces next to the sign is designed for two-way traffic. Moving the
sign closer to Tasker Road would create more confusion about traffic patterns on
the site.
"gnage: All signs for the CVS development shall conform to the Frederick
Ileounty Zoning Ordinance. This has been noted on the plans.
,44. Landscaping: A note has been added to Sheet:12 stating all plantings shall
conform with the Frederick County Zoning Ordinance.
15. Existing Trees: Because of site grading operations that will occur on the site to
install the proposed stream culvert and parking areas it is not possible to
preserve all the trees along the property/buffer line. However, the limits of
construction line indicates that some of the vegetation will be preserved along at
-least a portion of the buffer area.
16. Common Shared Buffer Landscaping: As indicated in the landscape notes on
Sheet:12, The screening plants for the buffer are located in the shared inactive
buffer on the adjacent property as well as preservation of the existing trees with
in the inactive buffer. The trees proposed in the active buffer on the CVS site are
supplementary to provide extra screening for the proposed residential
development.
17. Deciduous Tree Size: The Dogwood planting size has been increased to 2
inches.
18. Shrub Spacing: The shrub spacing has been left at 4' o.c. An offset double row
of shrubs is proposed to provide the desired headlight screening by preventing
gaps.
V,,Temporary Access Road: A note indicating that the road shall be upgraded at
the time of development of that site was added to the plans.
20. Rezoning Proffers: A note has been added to Sheet 1 stating that the monetary
proffer is required at the issuance of the first building permit on the site.
21. Power of Attorney: The POA is forthcoming.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Parking Spaces. On Sheet 1 of 13, under parking space requirements, it states that 66 spaces
have been provided; however, on the plan there are only 65.
2) Protect Overview. On the project overview on the cover sheet, provide the adjoiner information
across Tasker Road.
3) Utilities. Provide a statement on the cover sheet that all utilities will be placed underground.
Also, on Sheet 7 of 13 it is unclear where the site is being provided with electricity.
4) Bike Path/Sidewalk. The bike path along Warrior Drive is shown as being eight feet wide.
The standard with for these paths is ten feet. Please ensure that this path matches up with the
existing bike path. Also please increase the width of the sidewalk along Tasker Road to five feet
instead of four feet, as that is what VDOT prefers.
5) Grass Strips. Please ensure that a two foot grass utility strip separation is provided between the
sidewalks and the curb.
6) Pedestrian Crossing. Provide a pedestrian crosswalk over the entrance to Tasker Road and
Warrior Drive.
7) Building Size. On the cover sheet, the building size is shown as 14,391 sf; however, on Sheet 7
the building is labeled as 13,013sf. Please revise the plan to show which number is correct.
8) Dumpster Area. Label the dumpster area on sheet 7 and state that it is screened by a board on

9) Stream. Label the intermittent stream located on the property.
10) Legal References. Provide the legal references for all existing easements.
11) Wheel Stops. There are wheel stops located in the parking spaces by the building. Since these
parking spaces have curb and gutter, it is unclear why these wheel stops are needed.
12) Interparcel Connector. There appears to be a connection to the adjacent site near the dumpster.
If this area is intended to provide a connection to the next lot when it's developed, label it as a
future interparcel connector. Also, the area where this interparcel connector is located is one-
way. To prevent customers from accessing this entrance from the Tasker Road entrance (without
going around the building), the Do -Not -Enter sign should be moved closer to the Tasker
entrance.
13) Sianage. The sign for the CVS is shown as a pylon sign. Since this is the first commercial
development in this area, it is suggested that a monument style sign be utilized that is similar to
the CVS sign for the new building on Valley Avenue (excluding message board) to eifliance this
corridor.
14) Landscaping. Provide a note on Sheet 12 that states all plantings shall conform with § 165-36B
of the Frederick County Zoning Ordinance.
15) Existing Trees. It would be beneficial to preserve any existing trees along the zoning district
buffer.
16) Common Shared Buffer Landscaping. The trees for the zoning district buffer are shown
within the active and inactive buffer portions. These trees need to be located entirely within the
inactive buffer portion.
17) Deciduous Tree Size. On Sheet 12 of 13, the minimum caliper for deciduous trees is two
inches. Some of the trees are shown at two and one half inches and the dogwood is shown as one
and one half inches.
18) Shrub Spacing. The shrubs are proposed to be planted four feet oc. Three feet oc is preferred
for the shrub rows to prevent gaps in the screening.
19) Temporary Access Road. Provide a statement that this road will have to be upgraded to include
curb and gutter when that portion of the site is developed.
20) Rezoning Proffers. The proffers that pertain to this property (REZ#2-98) state that there is a
monetary proffer of $6,545.97 required at the issuance of the first building permit on the site.
21) Special Limited Power of Attorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should
be notarized and completed to grant the applicant (you) with authorization to represent them for

Dear John:
Upon review of the subject site plan. we offer the following comments:
1) The proposed erosion and sediment control plan indicates that the storm sewer system is in
place. Indicate on the plan the proposed erosion and sediment control measures to be
utilized during the initial clearing and site grading phases. A sediment trap shall be
installed in accordance with ►ninium standards 4 and 6 of the Virginia Erosion and
Sediment Control Regulations. In accordance with VESCH Standard 3.13, provide the
design calculations and details for the proposed sediment trap.
2) The stonnwater report indicates that a culvert will be installed in the intermittent stream
which is located along the southern portion of the site. The Corps of Engineers may
require issuance of a permit for this work. Consequently, if required, a copy of the permit
will be required prior to our issuing a land disturbance permit. Place a note on the plans
which indicates that additional erosion and sediment control measures may be required at
the time of the proposed culvert installation to ensure that the intennittent stream will not
be impacted by erosion.
Once these continents have been addressed, submit one (1) cope of the plan for further review.
