application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review

Ms Perkins,
On behalf of the owner/developer, request that the landscaping plans for referenced project
be approved as changed.
The engineer, who is no longer involved with the project, failed to provide a plan for
landscaping the entrance drive to the project. Further, that engineer selected plants that
would not survive in our climate.
I am submitting Pine Knoll Construction, Inc. drawing sheet 10-1 to reflect the landscaping
plan for the entrance. Pine Knoll Construction, Inc. drawing sheet 10-2 is submitted to
change the plant schedule originally submitted on Bowman Consulting sheet 28 of 28. The
remaining information provided by Bowman remains in effect.

Ordinance.
(b) Ornamental trees and shrubs shall comply with the
requirements of § 165-36B. The Zoning Administrator may
allow some of the required ornamental trees and ornamental
shrubs to be planted in areas of common open space so long
as the intent of this section is met.
(3) Tree preservation landscaping. An area with a tree canopy
coverage, of at least 25% of the entire site area, shall be
preserved within dedicated open space. In no case shall individual
building lots be located within the open space. Canopy coverage
shall be calculated from the cumulative total of existing tree
canopies. Preserved trees shall be clustered together to maintain
a contiguous canopy; and shall be protected from construction
activity. These areas of open space may be counted towards the
total required open space, as specified in § 165-63. Residential
developments which are not required to have open space by
§ 165-63 are not exempt from creating open space for the
required canopy coverage. The calculation of tree canopy shall be
based on either the individual tree standards of the "Manual of
Woody Landscape Plants," written by Michael A. Dirr, or through
a comprehensive analysis of existing tree drip lines, conducted by
a Virginia certified engineer, land surveyor, or landscape architect.
Plant selection, planting procedure, and maintenance.
(1) Plant selection. Based on the type of landscaping, required trees
and shrubs shall be selected from the list of acceptable trees and
shrubs shown below.

(2) Planting procedure. All required trees and shrubs shall meet the
specifications of the American Association of Nurserymen. All
trees shall be planted no closer than three feet to the edge of
sidewalks, curb, or other pavement. Deciduous trees shall be a
minimum of two-inch caliper at the time of planting. Evergreen
trees shall be a minimum of four feet in height at the time of
planting. Shrubs shall be a minimum three -gallon container at the
time of planting.
(3) Maintenance. The owner, developer, and/or builder who is
responsible for planting required landscaping shall be responsible
for maintaining it in a state of good health for one year after
planting. After one year, from the date occupancy is approved,
the individual property owner and/or homeowner's association

Enclosed please find a revised plat and cover memo from Bowman Consulting
responding to Planning Staff s last set of comments. After you have reviewed the enclosed, I
believe you will agree that all County comments have been sufficiently addressed and this plat is
now ready for approval signature by the County.
In addition to the above, the owner understands the County's concerns about some
townhouse projects in Frederick County where the garage is not being used for the parking of
vehicles. As you know, the project that is proposed at Regents Crescent is a high end
condominium project and our market research indicates that the garages will be used to garage
vehicles. To further strengthen this, however, this is to confirm this project will have not only a
condominium association, but also restrictive covenants, that will provide that the garages cannot
be modified to make them unusable for the storage of vehicles. This will be a restriction that
runs with the land enforceable by the owners of the condominium units, as well as the
condominium association.

Dear Mr. Suchicital,
We have received your comments concerning the Regents Crescent Site Plan, dated October
27, 2005, and offer the following in response.
1. "On Sheet 1 of 26, a signature line for the Frederick County Zoning Administrator
needs to be provided on the cover sheet along with a note under the signature line
that states that the site plan will be valid for a period of five (5) years from the date of
approval. Please remove the blocks for County Administrator and Director of
Planning. "
Response: The outdated signature blocks have been removed from the cover
sheet. We have replaced the old signature blocks with a modified
block that reflects the requested statement. Please see the cover sheet
for these changes.
2. "On Sheet I of 26, update the last -revised chart to reflect the Planning Department's
comments. "
Response: All of the sheets have had their revision block updated.
3. "On Sheet 2 of 26, Note #4 under Site and Zoning Data, please fill in the notes from
the approved MDP. "
Response: We have inserted the appropriate information from the MDP into the
aforementioned location. Please see sheet #2 for the changes.

4. "On Sheet 2 of 26, add a note under Site and Zoning Data indicating that all utilities
will be buried underground. "
Response: A note stating that all utilities will be buried underground has been
added to the sheet #2 of the Site Plan.
5. "On Sheet 3 of 26, Staff recommends an inct-ease in the width of all sidewalks from
four feet to five feet for better pedestrian movement. "
Response: The sidewalks within the development will remain 4' wide. This is the
required minimum as stated in the Frederick County Zoning
Ordinance. Please see Sheet 43 for these changes.
6. "On Sheet 3 of 26, extend a five foot wide sidewalk, along both sides of Trafalgar
Square, from Chelsea Circle to US 522, with the correct sidewalk layer. "
Response: We have extended the 4' sidewalk on the right side of Trafalgar
Square to Rte. 522 and added a 4' sidewalk to Rte. 522 along the other
side of Trafalgar Square. Per the conversation with the Frederick
County Planning Department these sidewalks will remain 4' wide per
the Frederick County Zoning Ordinance. Please see Sheet #3 for these
changes.
7. "On Sheet 3 of 26, include a five foot sidevvalk along the property's edge with US
522. "
Response: Per the conversation with the Frederick County Planning Department
we are showing these sidewalks at a 5' width along Rte. 522. Please
see Sheet 43 for these changes.
8. "On Sheets 3 and 25 of 26, regarding the block between Chelsea Court and St. James

"Proposed Recreational Units: According to the master plan for this project,
two recreational units are required for this project. The master plan states that
these units will provide pedestrian circulation, active recreational equipment and
passive recreational equipment and facilities. The q' walking trail you have
provided constitutes the requirements for both pedestrian circulation and passive
recreational equipment. However, you must still provide an additional recreation
unit that meets the Frederick County Parks and Recreation Department's
requirements for active recreational equipment. "
Response: In response to the above comment an active recreational unit has
been provided on the site which will fulfill our requirement for two
recreational units. The additional proposed unit can be seen on
Sheet #3 of this plan set.
2. "Proposed 4' Walking Trail: Please increase the ividth of the proposed 4;
ivalking trail to S' and provide indications that this ivill be a paved trail. You
must also provide a detail in association with this proposed trail. "

Response: Dimensions have been provided on Sheet #3 of this plan set
showing the linear distances from the townhouse units to the limits

4. "Lot Requirements: The ALlaster Plan.for Regents Crescent calls for no
subdivision of individual lots. Ilotivever, it states that each proposed singley-
family cluster housing option as specified in Section 165-65 D of the Frederick
County Zoning Ordinance. This requires you to actually place the required
10,000 or 8, 000 square foot lots around each home site."
Response: The lots have been revised and the required 10,000 or 8,000 sf lots
have been placed around all single family cluster style units.
"Open Space Calculation: Per Comment 114, you must recalculate the open
space requirement based on these neiv lot configurations. No area tivhich is inside
any given lot can be deemed open space and thous }gout need to still provide the
proposed 1. 78 acres of open space per the Master Plan. "
Response: The open space for the site has been recalculated and can be seen
on Sheet #2 of the plan set. We have provided 3.09 Ac.of open
space. We show the areas used for the calculation on sheet #3.
6. "Off -Street Parking: Section 165-65 (K) 2 of the Frederick County Zoning
Ordinance requires 2.5 off-street parking spaces.for each townhouse you have
proposed. Tlie proposed spaces you have proviced along Chelsea Circle do not
constitute off-street parking spaces. In order for these spaces to be deemed
acceptable you must ensure that they are clearly delineated from the travel way
and completely surrounded by curb bump -outs. Please keep in mind that along
with the aforementioned requirements you must adhere to section 165-27 (8) A of
the Frederick County Zoning Ordinance in regards to parking space and aisle
width. "
Response: We have met the parking requirement for this site by providing on
street parking per the regulations in Section 165-65 (K) 2 of the
Frederick County Zoning Ordinance and have adhered to the
stipulations dictated in Section 165-27 (8) A of the zoning
ordinance concerning parking space and aisle width. We are
providing a street width of 24' from face of curb to face of curb.
We have allowed for a 12' travel way with a parking aisle width of
12'. In addition the on street parking areas have been enclosed
within curb bump outs as directed. These changes can be seen on
Sheet 43 of this plan set.

Dear Mr. Frook:
Upon review of the subject subdivision plan, we offer the following comments:
1) The plan indicates stormwater pond water surface elevations for the existing pond
located on the Westminster Canterbury property. Also, the stormwater report
indicates flow rates for the two, ten and 100-year storm events. I- owever, these
numbers do not match the stormwater management report for this pond as
designed in 200 1 Ensure that the flow rates in your design are accurate to
properly route the stormwater through the proposed site.
2) On Page 3 of 23, complete the labeling for cross-section A -A.
3) On Page 4 of 23, ten (10) foot storm sewer easements are indicated. Easements of
this size .would be extremely difficult to maintain. The county requires a 20 foot
dedicated easement to allow access for required maintenance. Therefore, the plan
shall be revised to include 20 foot easements.
4) Provide a ditch along the eastern portion of the site to contain post -developed
stormwater run -oft onsite and allow it to drain into the proposed stormwater pond.
5) The plan indicates a 2:1 slope for the proposed stormwater pond. Mowing 2:1.
slopes is difficult at best; therefore, provide recommendations for the type of
permanent stabilization or possible alternatives to be utilized onsite. In addition,
provide a maintenance schedule.
6) Ensure that proposed culvert inlets 117.4 and 12 will not cause a backwater

condition in the event of a 100-year storm event on the Westminster Canterbury
property. If it is determined that the flows front a 100-year storm event will back
Lip onto the Westminster Canterbury property, recorded drainage easements will be
required. Also, ensure that the water routed front culvert 7.4 does not impact the
flow rate from the existing pond located on the Westminster Canterbury property.
7) On Page 5 of'23, the proposed grading plan indicates the foundations will be
placed on controlled, compacted fill. Place a Mote oil the plait that indicates that It will
be necessary to submit geotecllilical cilgllleel'lilg reports for the controlled fill contained oil
all lots at the time of building permit application.
8) The proposed pond design indicates an emergency spillway located along the
eastern portion of the pond. However, if water from a 100-year storm event flows
through the spillway, it will most definitely impact the Strowbridge residence and
associated property as well as the existing Autumn Lane. Consequently, it will be
necessary to revise the proposed pond design to incorporate the necessary
measures to prevent the Strowbridge property from being impacted by a 100-year
storm event. Additional geotechilical engineering certification, slope stability
studies, etc. shall be required for construction Of the proposed pond because Of -'tile
downstream proximity of'the existing home. Please consider relocating the
proposed pond closer to Route 522. Tllis relocation could provide an additional
safety factor in the event of'a pond failure. Provide a channel to accommodate the
100-year storm event flows discharge from the pond to existing channel located
along Route 522.
9) Indicate the routing ofthe existing storm flows in the channel located along Route
522 in the stormwater report to ensure that the time of concentration fi-om the
proposed site does not worsen the flooding condition for the culvert located under
aUtl nin Lane. Provide a colllprellellSlVe analysis of the culvert labeled point 5, the
routing of the different reaches, timing of peak discharges and water Surface
elevatiolls.
10) The stornlwater report shall provide a detailed summary of the proposed
discharges fi-om the pond. Additionally, on Sheet 15, o17233, note 10(13) references
a Happy Creek Knolls, Section II Home Owners' Association for maintenance.
Also, the erosion and sediment control narrative on Sheet 18 of 23 references this
same project which is located in the Town of Front Royal. It is doubtful that Front
Royal would want to maintain anything located ill Frederick C.011ilty.
Consequently, revise the narrative to reflect the site in Frederick County and
pertain to the proposed project.

to 8.0 inches, not 6 inches as indicated in accordance with the TR-55 rainfall chart,
Figure B-8. Re -analyze and revised the calculations based on the revised rainfall
amount.
12) A sediment basin is indicated on Sheet 16 Of 23. Provide a comprehensive design
and details for the sediment basin in accordance with the Virginia Erosion and
Sediment Control Handbook standard 3.14. The plan proposes discharging the
sediment nun -off onto the Fincham property as a point source. Provide an
adequate outfall for the concentrated flow which corresponds to the area in the
location of the proposed stormwater pond.
13) The pre -developed CN values for the site shall be based on the actual soil type for
the project. Based on the soils onsite, an appropriate value would be a CN of 55.
Provide a comprehensive analysis of the runoff curve number to verify the
proposed numbers.
There are numerous other review comments; however, we will not perform a more
comprehensive review of these plans until major revisions have been made to more fully comply
with the county's requirements. We are requesting that you contact this office to schedule a
meeting to discuss these comments.

Dear Mr. Erickson:
I have had the opportunity to review the Site Plan for Regents Crescent, received by our office on February 17,
2005. Please address the following comments:
1. Proposed Recreational Units: According to the master plan for this project, two
recreational units are required for this project. The master -plan states that these units will
provide pedestrian circulation, active recreational equipment and passive recreational
equipment and facilities. The 4' walking trail you have provided constitutes the requirements
for both pedestrian circulation and passive recreational equipment. However, you must still
provide an additional recreation unit that meets the Frederick County Parks and Recreation
Department's requirements for active recreational equipment.
2. Proposed 4' Walking Trail: Please increase the width of the proposed 4' walking trail to 5'
and provide indications that this will be a paved trail. You must also provide a detail in
association with this proposed trail.
3. Townhouse Setbacks: Please provide setback information from each townhouse end unit to
the limits of the parcel line.
4. Lot Requirements: The Master Plan for Regents Crescent calls for no subdivision of
individual lots. However, it states that each proposed single-family detached residence shall
be designed to the specifications of the single-family cluster housing option as specified in
section 165-65 D of the Frederick County Zoning Ordinance. This requires you to actually
place the required 10,000 or 8,000 square foot lots around each home site.
5. Open Space Calculation: Per continent #4, you must recalculate the open space requirement
based on these new lot configurations. No area which is inside any given lot can be deemed
open space and thus you need to still provide the proposed 1.78 acres of open space per the
Master Plan.

6. Off -Street Parking: Section 165-65 (K) 2 of the Frederick County Zoning Ordinance
requires 2.5 off-street parking spaces for each townhouse you have proposed. The proposed
spaces you have provided along Chelsea Circle do not constitute off-street parking spaces. In
order for these spaces to be deemed acceptable you must ensure that they are clearly
delineated from the travel way and completely surrounded by curb bump -outs. Please keep in
mind that along with the aforementioned requirements you must adhere to section 165-27 (8)
A of the Frederick County Zoning Ordinance in regards to parking space and aisle width.
7. Identification: Please identify the phrase "See Sheet XX of XX" directly below the future B-
2 commercial development site located on sheet 3 of 23.
8. Landscaping Plan: Please reverse the view of the landscaping plan so it more closely
matches the direction that the other views of the site are shown in.
9. Stop Sign: Provide a stop sign for the entrance on Route 522.
