Lawrence, Zoning Administrator SUBJECT: Preliminary Analysis of Zoning Ordinance Provisions Applicable to Expansion of Shenandoah University within Frederick County DATE: November 20, 1998 In response to your inquiry regarding the possible location of athletic fields and student housing for Shenandoah University in Frederick County, staff conducted a cursory analysis of the Zoning Ordinance's treatment of these uses in an effort to determine the most suitable zoning district(s) for such expansion. Included with this study are two maps, one of which indicates the proximity of parcels over twenty acres in size to the University's main campus and a larger map that includes the zoning designation and property identification number (PIN) associated with these tracts. Additionally, a corresponding matrix identifying the acreage, ownership, improvement value, and zoning category for each property within the study area was prepared. Under the existing structure of the Zoning Ordinance, there are several zoning districts wherein the proposed uses could develop in an integrated environment, Of course, the HE (Higher Education) District represents the category that would most appropriately permit the by -right establishment of either athletic facilities or dormitories as integral yet accessory components of a university's infrastructure. Indeed, the use of this district to facilitate both the foundation and expansion of college and university campuses in Frederick County most completely satisfies the intent of the Zoning Ordinance regarding the development of the subject uses. However, development of athletic fields and student housing is not limited to the HE District as both the RP (Residential Performance) and B-2 (Business General) Districts permit these uses in various forms. Specifically, the RP District allows for high -density residential uses, which could include dormitories manifested as garden apartment type development. The RP District also encourages the provision of recreational facilities as a planned element of such residential development. Therefore, it is appropriate to consider a master planned development integrating student housing, athletic fields and other recreational facilities as a viable concept within the RP District. The B-2 District is logically more restrictive in its treatment of residential uses than the aforementioned districts. However, it is conceivable to permit student housing as a facility most similar to an organization hotel and lodging use, which is permitted in the B-2 District. Indeed, such designation would appropriately imply that the occupancy of the facility would be limited to students who are considered fee paying "members" of the university's organizational community. Furthermore, a park is also a permitted use in the B-2 District. In accordance with its definition in the Zoning Ordinance, a park is any tract of land designated and used for active and passive recreation. It is reasonable to assert that the university's athletic fields would constitute a park and therefore be permissible on B-2 zoned property. Additionally, accessory recreational facilities could be located within the park to the extent that such improvement served as a supportive component of the principal park use. Staff analysis also involved the RA (Rural Areas) District due to its applicability to the vast majority of property in Frederick County. Unfortunately, there is no mechanism through which high density residential development could occur as an independent by -right use within the RA District, to include dormitory style student housing. Furthermore, although public parks are permitted, the establishment of athletic fields intended principally for University use would require Conditional Use Permit (CUP) approval as a commercial outdoor recreation area. Under current Zoning Ordinance language, it is possible to develop athletic fields and student housing as an accessory component of a school, which is included as a permitted use in the RA District. However, to constitute a school, a principal academic building must be constructed on a prospective site prior to development of such accessory facilities. Indeed, the school must constitute the primary use of the property with athletic fields and housing serving a clearly secondary and subordinate role. In essence, a full -service satellite campus would need to be developed in order to utilize the RA District to achieve the rather limited expansion currently proposed. Should the university acquire the property currently utilized as the National Guard armory, it would be possible to relocate this facility in either the B-1 (Neighborhood Business), B-2 (Business General), B-3 (Industrial Transition), M-I (Light Industrial), or M-2 (Industrial General) Districts. The potential to locate the armory use in these districts is due to its classification and subsequent permissibility as a public building. The information presented through this memorandum and the accompanying documents is intended to serve as a general foundation for your evaluation of prospective sites for Shenandoah University's expansion into Frederick County. Further research and analysis by staff may be necessary to accurately address zoning issues affecting specific sites under consideration. It appears that the access road issue can be resolved over the normal course of events with the applicant's engineer working through your office to receive approval to do improvements within the I-81 right-of-way. The County will allow the applicant to work within the University's property outside of the VDOT right-of-way which involves the majority of the work that the contractor is responsible for. A narrative will be incorporated on the plan which identifies the need to satisfy all FHWA/VDOT requirements for that element of the access road project to be utilized for the football stadium. I did not go over the "worst case scenario" that we discussed; however, if your radar screen indicates that will probably occur, I would appreciate to be in the know so we can work with the applicant for a solution. In reviewing the correspondence regarding this site plan, staff has determined the following: County Fire Marshall has not provided approval letter. In conversations with the Director of Emergency Services, it appears that the road proposal will gain approval. The two significant issues are access to the stadium site and the establishment of an access road that accommodates emergency vehicle traffic. The proposed access road will provide the secondary access point to the facility (Price Drive providing the primary access). The width of the access road as presented is satisfactory. 2. County Public Works has provided approval. 3. Planning Department. Zoning related issues have been satisfied. Awaiting all agency approvals prior to formally approving plan. 4. City Planning Department. Via telephone conversation with Tim Youmans, the plan has addressed all staff comments. The City is not concerned with VDOT's approval as the interstate is outside the City's jurisdiction. 5. City Utilities. Awaiting minor revisions to plan to increase separation distance between utility lines and Abrams Creek. 6. City Manager approval - Based on conversations with Tim Youmans, the City Manager is prepared to authorize approval of the plan once City Utility comments are satisfied. 7. VDOT. The plan has been forwarded to the Federal Highway Administration. The applicant has been advised that the FHA has the plan for review. (Steve Melnikoff will provide copies of all past and future correspondence.) A Conditional Letter of Map Revision Request for the bridge crossings of Abrams Creek has been submitted to FEMA. Further, The Army Corps of Engineers Nationwide #14 Permit has been issued for the proposed crossings, and the Virginia Marine Resources Commission has approved their permit. I've attached a copy of the Corps Nationwide #14 Permit. As soon as we receive the VMRC Permit, I'll provide a copy of that to you also. The plans include a 30 foot wide driveway with a sidewalk on the north side of the creek and a sidewalk on the south side. Associated street lighting, storm water culverts, utility conduits and landscaping are also provided. This project crosses under Interstate 81. I have discussed the project with most of you previously assuming that the existing easement granted unrestricted access to all of the University's land in Frederick County. This latest proposal arises from a finding that the current easement of record limits use of the 60-foot access easement across Jim Barnett Park to providing access only between the main campus and the 7.5 acre tract of land conveyed to the University by the City in 1987. The proposed stadium is not on this 7.5 acre tract, but instead on other land owned by the University on the east side of 1-81. At the June 201h Planning Commission public hearing, it was suggested that the University explore the alternative of acquiring the portion of Jim Barnett Park encumbered by the proposed access road (which effectively functions as exclusive private use of public property). The attached plan and plat depicts a 1.9 acre area which encompasses the area encumbered by the roadway and the necessary grading associated with constructing the road. The Planning Commission closed the public hearing, but tabled decision on the site plan until its July 1 1`h meeting. They would like the applicant and staff to explore the conveyance alternative and address issues such as who (i.e. City or University) would have responsibility and liability for incidences occurring within the easement area if the land is not conveyed to the University. While the current easement instrument grants permission to the University to build and maintain the roadway within the easement, it does not require the University to do so and is silent as to who responds to incidents along it. MEMO • • June 23, 2000 Page 2 The University will either need to seek amendment of the current deed of easement to eliminate the specific language restricting access to only the 7.5 acre tract located on the north side of Abrams Creek on the east side of I-81 or it could pursue acquisition of the encumbered area as proposed in Mr. Mislowsky's attached request. I support consideration of the conveyance based on the exclusive nature of the use of this portion of the Park for Shenandoah, but seek your input and opinions. Obviously, the Parks & Recreation Board needs to advise Council on this. During the public hearing discussion, Dr. James Davis, President of Shenandoah University mentioned the University's interest in developing a streambelt park system along Abrams Creek including University property. Should consideration be given to securing access for bike and pedestrian travel through Shenandoah University property on both sides of 1-81? Thinking on a community -wide basis, bike and walking trails connecting the College Park residential area to Jim Barnett Park and the proposed Town Run bike/walking trail makes sense. Regardless of the remedy sought, I would also appreciate input on what, if any, consideration Council should give to requiring additional access from the public street system on the east side of I-81 for the uses programmed on the 16+/- acres beyond the 7.5 acres covered under the current easement. Long-term, the stadium is not the only use proposed. Short-term, it is inconceivable that the University will limit use of the stadium to the five or so home football games per year. Now is the time to note issues, if any, related to sole regular access and unchained emergency access relying upon the proposed connection to the public street system in the City. As proposed, this entails two new creek crossings, passage under the two Interstate bridges (scheduled for replacement with I-81 widening) and passing through the main campus in the City (including a third crossing of Abrams Creek). I recognize that many of you are busy with other important projects, but urge you to provide me with any input you have before the July 11 "' Planning Commission meeting. Thank you.
