Dear Jason:
The Frederick County Department ofPlanning and Development administratively approved the above
referenced site plan on February 14, 2001. The site plan is for some general improvements to the
property, such as the creation of a parking area with painted lines. The primary aspect of the plan
is the construction of a 6,120 square foot warehouse building. As of this date, all comment sheets
have been approved. Future issues that may arise with these agencies or departments should be
addressed accordingly.
I am providing you with several copies of the approved site plan. Please forward these to the
appropriate representative for Garber Ice Cream Company. Furthermore, please advise the owner
that a copy should be kept for future reference and an approved copy must be kept on the
construction site throughout the development process. Once site development is complete, the owner
needs to contact this office to schedule an on -site inspection.

Dear Jason:
I have had the opportunity to review the revised site plan for Garber Ice Cream Company. Thank
you for tackling the majority of concerns mentioned by Staff in the previous review. Unfortunately,
three issues were not addressed in your revisal. Please make the necessary changes so staff can
consider approval of the site plan. These three issues are as follows:
1. Please delineate the dimensions of the two loading spaces. This can be done by providing
lines on the site plan similar to those used for the regular parking spaces.
2. Please explain if the landscaping calculation includes all three lots or just Lot 15 in
determining the total landscaped area. Since all proposed development is located on Lot 15
the landscaping calculation should only take that lot into consideration.
3. Please ensure that the parking calculation reflects all uses on the site. If no office use exists
on the site, please provide a statement to that effect. If office use does exist, please change
the parking calculations accordingly.
After you have revised the site plan, I will need all approved review agency comment sheets and five
copies of the final site plan for approval. Staff has yet to receive a comment sheet from the Frederick
County Sanitation Authority.

We -have received your revised Site plan dated January 29, 2001 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Aloo please provide five (5) sets of approved construction plans
with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 1370
right-of-way. The permit io issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior to
issuance of any land use permits. Dedication should be made to the Commonwealth of
Virginia.
Once satisfactory application has been made, a permit will normally take approximately
thirty days to process and issue. Should you have any questions, do not hesitate to call.

Dear Jason:
I have had the opportunity to review the revised site plan for Garber Ice Cream Company. The
following comments should be addressed and included in a revision of this site plan.
1. Within the project information, please note that "Front Royal Road" is actually "Front Royal
Pike." Likewise, the owner's address on Sheet 1 should be modified to read Pike, rather than
Road.
2. On the location map, please label the subject parcels. If necessary, a map scale of 1" = 1000'
may be used.
3. On the adjoining property owner's map, please note that Parcel 64-A-6 is zoned M2.
4. On the adjoining property owner's map, Parcel 6413-A-13 is listed as a subject parcel.
However, this parcel is not listed on Sheet one as a subject parcel. Please resolve this
discrepancy.
5. If additional easement information has been discovered, please include this information on the
site plan.
6. The requirement for a category "A" buffer between the subject parcel and PIN 64-A-6 was
waived by the Frederick County Planning Commission on August 16, 2000. Please provide
a statement on the site plan which notes this waiver and the date it was granted.
7. Please delineate the dimensions and location of the two loading spaces noted on Sheet 1.
8. Please ensure that the parking calculation reflects all uses existing on site. For example, if an
office component exists, please note this and revise the parking calculation accordingly.

9. In accordance with Section 165-27.E.(5) of the zoning ordinance, parking lots shall be no
closer than five feet from any property line. Two of the proposed parking spaces are within
five feet of property lines. Staff would suggest a re-evaluation of the parking configuration.
It may be appropriate to relocate a portion of the parking area to another area of the site to
meet the standards set forth by the ordinance. Parcel 6413-A-14 maybe an appropriate area
for additional parking.
10. In the landscaping calculation, 38% of the site is said to be landscaped. Does this include
both parcels? The landscaping calculation should be based on parcel 64B-A-15 if all activity
is occurring on that parcel.
11. For your reference, I have included the acreage for each parcel associated with this site
according to Frederick County Real Estate Records.
64B-A-13: .25 acre
64B-A-14: .30 acre
64B A-15: 2.71 acres
After you have revised the site plan, I will need all approved review agency comment sheets and five
copies of the final site plan for approval. Comment sheets are required from the following agencies:

Upon review of the subject site plan, we offer the following comments:
An infiltration trench is not allowed in Frederick County. In this area, the geology
prohibits the use of any type of infiltration system. The shale geology does not allow any
infiltration of the stormwater into the soils. With the limestone geology, there is a high
potential for the creation of sinkholes.
2. The proposed stormwater discharge needs to drain into an adequate channel. We also
recommend that all roof drains discharge into the storm sewer system.
3. Provide perimeter erosion and sediment control for the site.
4. Place a note on the plan that a land disturbance -permit shall be obtained- from our office
prior to commencing site grading operations.
Once these -comments are addressed, submit two (2) copies of the site -plan for further
review. If you have any questions, do not hesitate to contact me.

I have had the opportunity to review the above -referenced site plan submitted to our department on
June 6, 2000. The following comments should be addressed and included in a revision of this site
plan.
1. Please provide the name, address, and phone number of the owner/developer.
2. Please provide a space labeled, "Approved by the Zoning Administrator," for the approval
signature and date of approval. In addition, provide a note stating that the site plan is valid
for five years from the approval date.
3. , Please provide a location map which clearly identifies the subject parcel.
4. Please provide the use, zoning, and PIN for all adjoining properties, including those located
across road right-of-ways.
5. Please provide survey coordinates for the subject parcel.
6. Please state the total acreage of the subject parcel.
7. Please state the maximum height for the B2 zoning district.
8. Please state the applicable setbacks for the B2 zoning district and delineate the location of
such setbacks on the site plan.
9. Please show the location and dimension of all sidewalks and pedestrian ways.
10. Please show the location, height, and dimensions of all existing and proposed signs. If no
signs are proposed, please provide a statement to that effect.

11. Please provide information regarding the location and specifications of all outdoor lighting.
Outdoor lighting should be directed so as to avoid casting light on adjoining properties. If
no outdoor lighting is proposed, please provide a statement to that effect.
12. Please show the location of all outdoor storage areas. If no such areas are proposed, please
provide a statement to that effect.
13. Please show the location of all proposed outdoor trash receptacles. If no such receptacle is
proposed, please provide a statement to that effect.
14. Please provide a FAR calculation which includes the current FAR and the revised FAR based
on the proposed warehouse addition.
15. Please show the approximate boundaries of Windy Hill Lane and state the posted speed limit
on that street.
16. Please show the location of all proposed utilities and provide a statement ensuring the
underground placement of all new utilities.
17. Please show the location and width of all easements, including access, utility, and drainage
easements.
18. Please show the location of all fire hydrants and fire lanes.
19. In the B2 District, a minium of 15% of the lot area must be landscaped. Please provide a
current calculation for the landscaped area and a revised calculation based on the proposed
addition.
20. A category "A" buffer is required between the subject parcel and PIN 64-A-6. Please refer
to Section 165-37.D. for standards regarding the required buffer.
21. Please delineate the existing parking area to include all parking, loading, and handicap spaces.
In addition, please provide a parking calculation which details the current number of spaces
and provide a revised calculation based on the use of the proposed addition. One parking
space is required for each warehouse employee.
22. Please provide information regarding the location of all environmental features.
23. If additional landscaping is to be provided, please provide a detailed landscape schedule.

On June 2, 2000 I received one site plan, an application, and a $500 minor site plan fee for Garber's
Ice Cream. Minor site plans are those which do not increase the gross floor area by more than 20%
and do not exceed 5,000 square feet in area. Because the proposed building addition exceeds 5,000
square feet, the addition cannot be considered a minor site plan. The regular site plan fee is $1,000
plus $100 for every acre, up to five acres. A total of 0.3 acres are to be developed with this site.
Therefore, a site plan fee of $1,030 is required. The minor site plan distinction is used only for
determining the fee. Information required to be shown on a site plan remains consistent for regular
and minor site plans.
A cursory review of the submitted plan indicates that much of the required site information is not
Included. Staff would recommend that you re -submit two copies of the site plan to include all
checklist information and attacli the appropriate fee. The site plan application requires the applicant
to submit two site plans. This enables staff to return a marked -up copy for your benefit.
