application. The Deparmmt of Planning & Development will review the application to ensure that it is
complete prior to accepting it If any portion of the application is not complete, it willbe returned to the

(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan It is recommended that applicants
contact the Department of Planning & Development to determine which review

We have received your revised site plan dated December 21. 2005 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide one (1) sets of approved construction plans
with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 1129
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of any
land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

The above -referenced site plan was approved on February 17, 2006. The site plan is approved for
the construction of a new 8,400sf office/retail building located on Prosperity Drive (Route 1129).
Required site improvements include the following:
Construction of a parking lot with 42 spaces (including two handicap accessible),
including curb and gutter, a sidewalk, landscaped islands, striping, and handicap access.
Construction of a dumpster pad with a six (6) foot wooden fence for screening.
One 12' x 45' loading space.
I am providing you with three (3) copies of the approved site plan. Please forward these copies to
the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for
future reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this office
to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or
concerns.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Curb and Gutter. Curb and gutter are required around the perimeter of all parking lots in the B2
zoning district in accordance with § 165-27E(3) of the Frederick County Zoning Ordinance. While it
may not be needed for drainage reasons, the curb and gutter are required along the sidewalk.
2) Plant Types. Viburnum is classified as being an ornamental shrub and cannot be used for screening.
Please revise this plant to shown one approved for screening (i.e., Yew, Holly, Boxwood, Juniper).
After you have revised the site plan, please resubmit two copies so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan
for final administrative approval. Comment sheets are required from the following agencies: the Frederick
County Inspections Department, the Frederick County Department of Public Works (County Engineer). the
Frederick County Fire Marshal, the Frederick County Sanitation Authority and the Virginia Department of
Transportation.

building and does not require a gutter.

relocated elsewhere on the site. Also, many of the trees are concentrated around the structure
next to Prosperity Drive. Please relocate some of the trees as indicated on sheet 5.

contained on the plan. I will need all approved review agency comment sheets and at least five

11) Tree Location. Three trees appear to be within the stormwater pond; these trees should be
relocated elsewhere on the site. Also, many of the trees are concentrated around the structure
next to Prosperity Drive. Please relocate some of the trees as indicated on sheet 5.
After you have revised the site plan, please resubmit two copies so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five
copies of the final plan for final administrative approval. Comment sheets are required from the
following agencies: the Frederick County Inspections Department, the Frederick County Department
of Public Works (County Engineer), the Frederick County Fire Marshal, the Frederick County
Sanitation Authority and the Virginia Department of Transportation.
