The Frederick County Department of Planning and Development administratively approved the above -referenced
site plan on December 4, 2007. The site plan is approved for revisions to the previously approved Alban Tractor
Site (Site Plan 458-06 and revised with Site Plan 419-07).
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including
review agency comments from all relevant review agencies. I am providing you with three (3) copies of the
approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the
owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the construction
site throughout the development process. Once site development is complete, the owner(s) should contact this

Dear Ms. Perkins,
In response to the comments dated October 4, 2007, regarding the above referenced project,
we offer the following:
1. Comment: Phase 2 — Since Phase 2 of the project has been completely
eliminated, it does not need to refer to a phase, it is only a
landscaped area to be completed with Phase 1. Revise the
coversheet and sheet 6 as indicated.
Response: All references to phasing have been removed from the plan. {See sheets
1 and 6 If
2. Comment: Parking Spaces — There are parking spaces shown with only wheel
stops; all parking spaces must have curb and gutter and landscaped
islands. Remove or revise the spaces as indicated on sheet 6.
Response: The locations of the spaces have been revised as discussed in our
meeting on October 9, 2007. Wheel stops have been removed from the
plan. { See sheet 6 }
3. Comment: Sidewalk — A sidewalk needs to be provided as indicated on sheet 6.
Response: As agree during our October 9, 2007 meeting, the parking spaces along
the north end of the building have been removed from this area and
relocated to other areas of the site. The door on the north end of the
building has also been remove from the plan. This eliminates the need
for a sidewalk in this area. {See sheet 6}

4. Comment: Front Paved Area — Indicate if the front paved area could be
modified to include a large grass island to break up the pavement.
Response: As discussed and agreed during our October 9, 2007 meeting, the large
grass island is not being proposed in order to allow adequate space for
large vehicles such as tractor trailers to maneuver.
Copies of the approvals received from the Frederick County Fire Marshal, Inspections and
Engineering Department are included with this submission. We are still waiting for approval
fi•om FCSA. In addition, we have submitted a copy of the revised sheet C showing the changes to
the parking lot to the Inspections Department for further approval. We will forward the approvals
from Inspections for the parking lot changes and from FCSA once we receive them or when we
submit for final administrative approval.

Dear Ms. Schmidt:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staff's comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Phase 2. Since Phase 2 of the project has been completely eliminated, it does not need to refer to a
phase, it is only a landscaped area to be completed with Phase 1. Revise the coversheet and sheet 6 as
indicated.

Dear Ms. Perkins,
Attached are two sets of revised Construction Plans and Profiles for Alban Tractor —
Whitehall Business Park. These plans have been revised from the original plan
(SP#58-06), which was approved by Planning on September 18, 2006, and the Phased
Building Plan (SP#19-07), which was approved by Planning on May 11, 2007. The
changes have been highlighted on the plan with red revision clouds and are as
follows:
1. Sheet 2 — Concrete Pavement/Stone Surface Joint Detail added, which is
referenced on Sheet 6 of the revised plan.
2. Sheet 3 — Numerous changes have occurred to the building and the
park ing/storage/display areas since the approval of the original plan and the
Phased Building Plan. These changes are further described below with sheets
5 and 6. Revision cloud denotes area which was affected by the changes.
Zachary Ann Lane was not changed from the originally approved plan.
3. Sheet 5 — Fueling area revised to show 3'x3' dispenser pad and relocated fuel
pump. Dimensions added to label for underground diesel fuel tank.
4. Sheet 5 —Above ground propane tank which was in the curb island north of
the fueling area has been removed from the plan.
5. Sheet 5 — Concrete pavement in storage area on south end of site has been
replaced with a stone surface and the curb and gutter has been removed where
stone is proposed. A note referencing sheet 2 for a detail of the connection
between the stone surface and the edge of pavement has been added.
6. Sheet 5 — Employee parking on the south end of the site has been revised as a
result of the concrete pavement being replaced with stone in the storage area.
There are now a total of 40 employee spaces adjacent to the stone storage area
instead of 64. Eleven of the employee spaces from this area have been
relocated to the east of the original employee parking area in order to still
have an adequate number of parking spaces.

7. Sheet 5 — 8' vinyl clad chain link fence has been changed to 8' chain link
fence. Fence has been relocated to run along property line and the gate in the
south end of the site has been removed. A note has been included where the
fence is being located in the tree save area that only the fence is to be installed
and that no clearing is to occur outside the limits of clearing.
Sheets 5 and 6 — South end of building originally called out as Phase 3 on the
Phased Building Plan has been revised to specify a concrete floor with roof
overhang. This area is intended to be used as an outside work area. Drain
basins have been removed from this area.
9. Sheets 5 and 6 — Antifreeze holding tanks have been removed from south end
of the building. Oil and coolant holding tanks have been specified at two
locations along the west side of the building with 3 bollards protecting each
set of tanks.
10. Sheets 5 and 6 - Overhead and ingress/egress door locations have been revised
at different locations in the proposed building.
11. Sheet 6 — Phase 2 of the building is never to be built. As a result, the future
doors are no longer shown and the proposed building breakdown has been
revised. Phase 2 is intended to remain grassed open space.
12. Sheet 6 — The parking tabulations have been revised to reflect the changes
made to the plan.
13. Sheet 6 — Parking space locations along main entrance, loading dock and
north end of site have been revised. The curb and gutter in these areas has
also been revised. A small portion of sidewalk and curb and gutter adjacent to
the loading docks has been removed since trucks will need to back up to the
covered loading dock. Wheel stops have been specified for the parking spaces
adjacent to the railing for the uncovered loading ramp. A wheel stop detail
has been added to sheet 6.
14. Sheet 6 — Loading space adjacent to after hours service parking has been
removed fiorn the plan since it is no longer needed. There are now 10 after
hours service parking spaces instead of 9.
15. Sheet 6 - Roof drain locations have been revised. The roof drain notes now
specify 8" roof drains unless otherwise noted instead of 6" roof drains.
16. Sheets 5 and 6 — Additional spot elevations have been added around the
outside of the building.

17. Sheet 6 - 8' vinyl clad chain link fence has been changed to 8' chain link
fence. Fence has been revised along north side of the building to allow more
space between the gate controls and the rolling gates.
18. Sheet 6 — Pole sign has been relocated from the site entrance near Zachary
Ann Lane to between the display area and Interstate 81.
19. Sheet 6 — The 10-inch curb and potential truck wash have been removed from
the plan and the three 15'x76' parking spaces have been relocated to adjacent
the curb and gutter along the north end of the site.
20. Sheet 6 — The fire hydrant which was once located in the 10-inch curb area
has been relocated to station 161-21 on WM "A" in the curb area just outside
the rolling gate along the west side of the site. In addition, the water main
named WM "B" has been removed from the plan.
21. Sheet 6 — The pavement and curb and gutter on the north end of the site has
been revised with the option of expanding the paved area out to the original
curb and gutter in the future.
22. Sheet 6 — The bollards shown with the four above ground propane tanks along
the west side of the site have been relocated to inside the curb and gutter -
below the tanks.
23. Sheet 6 — Dimensions have been added to the standby generator and
transformer pad. The locations of the standby generator and transformer pad
have been revised and additional bollards added to the curb island surrounding
these items.
24. Sheet 6 — Three pull boxes have been added outside the fence on the north end
of the site. These are to be installed by Allegheny Power.
25. Sheet 1 1 A — This slicet has been added to include additional typical sections
for Zachary Ann Lane where the ditches are located. The other typical
sections for Zachary Ann Lane which were once shown on sheet 1 1 have been
relocated to sheet I IA.
26. Sheet 12 — The water fitting table and the profiles have been revised to reflect
the removal of Watermain "B" and the relocation of the fire hydrant from
Watermain "B" to station 16+21 on Watermain "A".
27. Sheet 13 — The 8" W/L crossing for Watermain "B" has been removed from
the storm profile between storm structures 20 and 21.
28. Sheet 13 — A profile has been added for the 10" and 12" PVC roof drain
between structures 22 and 50.

29. Sheet 23 — Tree locations have been revised as necessary due to the previously
mentioned changes. The areas where trees have been relocated have been
surrounded with red revision clouds. Additionally, the pole sign location
change is reflected on this sheet.
30. Sheet 23 — The landscape calculations and notes have been revised to reflect
the revisions to the plan.
31. Sheet 24 — The concrete tickle ditch which was on the originally approved
plans has been replaced with a French drain. This has been reflected in the
plan and profile on this sheet.
32. Sheet 26 — A detail for the French drain has been added.
33. Sheet 27 — A note has been added below the `Concrete Pavement & Storage
Areas Typical Section' pertaining to compacted subgradc and joints/scoring.
34. Sheet 28 — The detail for CG-10 has been removed since it is no longer
proposed.

On March 10, 2009 I conducted a site inspection for the above referenced site. During that
inspection, I noticed the presence of multiple animated and portable signs on the property, as
well as signs placed at the intersection of Zachary Ann Lane and Rest Church Road. In
accordance with Section 165-30A of the Frederick County Zoning Ordinance, animated signs
and portable signs are prohibited in all Zoning Districts in Frederick County. Therefore, the
presence of these signs constitutes a violation of the Frederick County Zoning Ordinance.
This office will not issue any certificates of occupancy for this property until all of the violations
of the Frederick County Zoning Ordinance have been resolved. Specifically, resolution of this
violation may be accomplished by permanently removing all animated and portable signs from
the property, as well as the signs along Zachary Ann Lane.
