application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan_ It is recommended that applicants
contact the Department of Planning & Development to determine which review

A Notice to comply dated August 24, 2009, was sent to your office by certified mail
requesting that Mr. Rea Milam contact this office by September 4, 2009. Consequently, on
September 10. 2009, Environmental Inspector Il, Ben Whitlock and I met onsite, with a
representative of your company to discuss the site deficiencies and corrective measures. At that
time, the following deficiencies were discussed:
1. All denuded areas shall be stabilized. The areas include, but are not limited to, the areas
located near the retaining wall that are washing away, the areas located above and below
the retaining wall, the sheer wall located adjacent to Interstate 81 and all areas located
around the building;
These areas shall be permanently vegetated in accordance with the approved plans. You
have until October 5, 2009, to correct these violations.
After the violations have been corrected and you have obtained a new land disturbance
permit, a reinspection of the subject project shall be scheduled with the Frederick County Public
Works Department. Please note that you will be required to reapply for the land disturbance
permit. pay the $900 permit fee as well as the $50 reinspection fee. If the corrective measures
have been taken, the Stop Work Order shall be lifted after the inspection. If after seven (7) days
from issuance of the Stop Work Orders no corrective actions have been taken, in accordance with
section 79 - 6(C)(4), your cash bond may be pulled to make the said erosion and sediment control
corrective measures. Frederick County shall also assess civil penalties through the District
Court of Frederick County, which includes a fine of $100 per day per violation. We will

The Frederick County Department of Planning and Development administratively
approved the above -referenced site plan On .January 30, 2008. The site plan is approved
for the construction of a two new hotels within the Winchester Gateway Center off
Berryville Avenue (Route 7) in the Stonewall Magisterial District. Required site
improvements include the following:
• COnStrUCtiOn Of two hotels (COMfOrt Suites and LagUlnta Inn & Suites) each with 79
rooms, with adjoining banquet facility and pool area.
• One interstate overlay sign.
• Construction of a parking lot with 238 spaces (including eight handicap accessible),
including Curb and gutter, striping, handicap access and landscaping.
• Five loading spaces and two screened dumpster sites.
• Landscaping as shown on sheet 10 — ensure that all evergreen hedges are 36 inches at
time of planting.
• Outdoor lighting as shown On sheet 1 l - ensure that all pole lighting utilizes the flat
lens option.
All requirements of the Frederick County Zoning Ordinance have been met in the
approved site plan, including review agency comments from all relevant review agencies.
I am providing you with six (6) copies of the approved site plan. Please forward these
copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy
should be kept for future reference, and an approved copy must be kept on the
construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an On -site inspection.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval
can be granted. At this time, administrative approval cannot be granted. This site plan is denied
until the issues in this letter, as well as all issues of the other review agencies, have been adequately
addressed. Please review Staffs comments listed below and then prepare a revised site plan which
adequately addresses each concern.
Review Comments:
1) Parking Tabulations. On Sheet l of 11, provide the number of handicapped spaces and
loading spaces required and provided.
2) Loading Spaces. On Sheet 4 of 11, according to §165-28 of the Frederick County Zoning
Ordinance, one loading space is required per 20,000 square feet of floor area. If there is
107,790 square feet of total building area, six total loading spaces are required. Iowever, the
plan reflects only two loading spaces. Designate loading spaces as required.
3) Signage. On Sheet 4 of 11, provide a stop sign for exiting the southeastern portion of the
property.
4) Parking Space Dimensions. On Sheet 6 of 11, provide dimensions of the loading spaces.
5) Plant Selection. On Sheet 10 of 11, Taxus canadesis is not allowed by §165-36 of the
Frederick County Zoning Ordinance; replace with an appropriate species. Taxus cuspidate or
Taxus baccata is suggested.
6) Landscaping On Sheet 10 of 1 l , 64 total trees are required as noted for interior parking lot

Upon review of the site plan received December 19, 2007, we offer the following comments:
Based upon our site visit, the existing erosion and sediment control measures will not provide
enough control for the proposed development. Super silt fence will be required along the toe of the
slope outside the proposed fill line. Slope drains may be necessary in order to drain stormwater
down the slope prior to the curb and gutter being installed. Please revise the Erosion and Sediment
Control Plan to account for the new controlled fills being placed along the drainage divide.
2. Provide details and cross -sections of the retaining walls which are proposed on -site.
3. You have proposed fill slopes that are 2:1 or steeper. The geotechnical report prepared by Triad
Engineering, Inc. does not provide recommendation for slopes which exceed 2.5:1. Provide
recommendations for these steep slopes as well as a comprehensive stabilization plan to ensure
these slopes will not be an erosion hazard or educe a slope failure. in addition, provide
stabilization recommendations for the steep cut slope along the west side of the site.
Once these comments have been addressed, submit one (1) copy of the plans for further review.
