The cbecklist shM;M below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine Which review

Dear Mr. Verdi:
The above -referenced site plan was approved on February 20, 2009. The site plan is approved
for the construction of a new 150,061 square foot Wal-Mart Supercenter at the Winchester South
Market Place Development located on Maranto Manor Drive and Tasker Road in the Shawnee
Magisterial District. Required site improvements include the following:
• Construction of a parking lot with 765 spaces (including 20 handicap accessible),
including curb and gutter, striping, handicap access and landscaping.
• A ten foot asphalt trail along Front Royal Pike (Route 522) and Tasker Road (Route 642)
and a sidewalk along Maranto Manor Drive, as well as sidewalks internal to the site as
indicated on the plan.
• Six loading spaces and trash compactor site as indicated on the site plan.
• Interparcel access in three locations as shown on the plan.
• One freestanding business sign.
• Buffers and landscaping as shown on sheets 32-33A.
With the approval of this site plan, it needs to be recognized that all road improvements
associated with this development can be found on the South Market Place Roadway
Improvements approved by VDOT (latest revisions dated 1/15/09) and the Maranto Manor Drive
Plan, approved by VDOT (latest revisions dated 11/07/08).
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with eight (8) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the

This is to acknowledge receipt of your revised plans, with latest revisions dated 1 1/07/08 for the referenced
project. The plans appear satisfactory and are approved. Please advise the developer accordingly. Please
provide 5 sets of approved construction plans with signed seal for VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of the
contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road & Bridge
Specifications applicable during construction of this development.
Our review and comments are general in nature. Should conditions in the field exist such that additional
measures are warranted, such measures shall be completed to the satisfaction of the Department prior to
inclusion into the Secondary Road System.
• Attached is a copy of the minimum requirements and information needed prior to acceptance of
subdivision streets into the Secondary System. This is the responsibility of the developer.
• 0
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe or
drainage easement.
• The appropriate land use permits shall be obtained before any work is performed on the State's right-of-
way. The permit is issued by this office and will require a minimum processing fee, surety bond
coverage, and the salary & expenses of a State assigned Inspector.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum standards. This is
the developer's responsibility.
• Any signs to be installed will be in accordance with the Manual on Uniform Traffic Control Devices
(MUTCD) and the approved plans.
• 1 suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled
completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of any pavement
settlement.
• A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permit. Dedication should be made to the Commonwealth of Virginia.
• A copy of any/all RECORDED PLATS of dedication to public use (the County of Frederick) for
drainage easements or additional right-of-way required for implementation of this proposed project
should be provided for VDOT review prior to issuance of any land use permit.

The following are our responses to your comments dated December 30, 2008, regarding the
above referenced project.
Comment 1. Sheets 5, 5A, 513 and 10-13 — there are lighting fixtures shown in the parking lot.
The fixtures shown on sheet 5C are shown in islands.
Response: Sheets 5, 5A, 513, and 10-13 have been updated to show the correct location
of the street lights.
Comment 2. On sheet 10 ensure that there are I -IC ramps for the trail onto the access road off
of Tasker Road.
Response: IIC ramps have been clearly labeled on grading sheet 14.
Comment 3. The site is permitted to have one freestanding monument sign. The revised plan
doesn't show any proposed signs, if a sign is going to be constructed it needs to
be shown on the plan.
Response: The proposed monument sign location has been shown on sheets 10 and 14.
Comment 4. It doesn't appear that the landscaping plan has been revised since our last
conversation. Please ensure that the islands that contain both light poles and
trees will be acceptable and ensure that the evergreens planted along the entrance
road off of Tasker Road will have adequate space.
Response: The islands that contain light poles do not have any proposed trees.
Adequate space has been provided for the evergreen trees planted along the
entrance road off Tasker Road.
Comment 5. Revise note 22 on sheet 33.
Response: Note 22 has been revised on sheet 33.
Comment 6. On the buffer schedule revise the Zoning District deciduous trees to show 2"
caliper instead of 4'.
Response: The deciduous trees' caliper has been revised from 4" to 2".

Comment 7. On sheet 2, the proffer compliance narrative needs to correspond to the
applicable rezoning application. Please note that both rezoning 1/02-97
and #02-07 apply to this site. Also, it is unclear how compliance is being
achieved for the road improvements when the narrative states that they
will be bonded with other site plans. All improvements need to be
completed/bonded with this development.
Response: Proffers and proffer compliance narrative have been updated for this
submission. See sliects 29-31.
Comment 8. The proffer narrative states that this road is by others. The extension of
Ivlaranto Manor Drive needs to be completed before this site can open.
Response: The Maranto Manor Drive extension has been shown. See sheet 5.
Comment 9. All adjoining properties need to be shown on sheet 5.
Response: Adjacent properties and property owners have been shown. Sec sheet
5.
Comment 10. Curb and gutter (CG-G) needs to be provided around all parking spaces;
provide curb and gutter as indicated on sheets 10-13. Also, the typical
curb and gutter detail note needs to referenced a page in the site plan.
Response: Curb and gutter has been added to the plan. See sheets 10-13.
Comment 11. Parking spaces need to be a minimum of 180 sf, the spaces shown in the
plan don't comply with this requirement.
Response: 23' wide travelways have been provided so as to allow for parking
space dimensions of 19' x 9.5', or 180.5 sL See sheets 10-13.
Comment 12. Landscaped islands are required at the ends of all parking bays and striped
islands are not permitted. Islands need to be provided as indicated on
sheets 10-13.
Response: These islands have been provided. See sheets 10-13.
Comment 13. Directional arrows need to be provided throughout the parking area of the
development.
Response: These have been provided. See sheets 10-13.
Comment 14. On sheet 5A, the standard paving should be shaded so that it does not
blend in with the landscaped areas.
Response: This has been done. Standard duty asphalt has been shaded so as to
distinguish from the landscape islands. See sheet 5A.
Comment 15. It is unclear why a 50 foot BRL is shown along the adjacent property to
the east as indicated on sheet 5A.
Response: This has been removed froin the plan. See sheet 5A.

Comment 16. There are notes throughout the site plan regarding pylon signs. Per 165-30
of the Frederick County Zoning Ordinance, only monument signs are
permitted. The proposed location and size of any freestanding signage
needs to be provided on the site plan.
Response: All sign locations have been shown. All references to pylon signs have
been removed.
Comment 17. The road improvements for Tasker Road in this area need to be shown on
this site plan.
Response: This has been provided. See sheets 5-513, 10 & 17.
Comment 18. Since the primary entrance for the site is shown on Maranto Manor Drive,
a sidewalk should be provided that connects the Route 522 trail to the
entrance.
Response: A connection fi-oni the trail along Route 522 to the entrance along
Maranto Manor Drive has been made. See sheets SA and 5I3.
Comment 19. Details for the Route 522 trail and the Tasker Road sidewalk need to be
provided on the plan.
Response: A cross section of the trail has been provided on sheet 4.
Comment 20. An interparcel connection needs to be provided for parcel 76-A-53J as
indicated on sheet 5A.
Response: Two intei-pai-cel connections have been provided. See sheets 5-5I3, 12
& 16.
Comment 21. It is unclear how the proffer regarding the loading area visibility is being
met since there are loading areas visible front Tasker Road.
Response: The entrance from Tasker Road has been revised and additional
landscaping has been provided as screening for the loadiIIg areas pet"
proffer 4.2. Sec sheet 32.
Comment 22. Locations and details of pole lights need to be provided in the site plan
along with the type of fixture being used. Locations and details for any
proposed building mounted lighting need to be provided as well.
Response: A lighting plan has been provided with this submission. See sheet 5C.
Comment 23. Crosswalks and ramps need to be provided for all entrances on Maranto
and Tasker.

Response: The plant schedule has been revised and broken into three sections:
Buffer landscaping, Interior Parking Lot landscaping and Pei-imeter
Parking Lot landscaping.
Comment 30. The islands currently shown as striped islands need to be landscaped
islands with trees.
Response: This has been done. See sheet 32.
Comment 31. There are islands shown on sheet 35 that arc not shown anywhere else in
the plan.
Response: These islands have been removed. See sheet 32.
Comment 32. The zoning district buffer as shown on sheet 35 seems to only have one
type of plant. The buffer requires three trees per ten linear feet and the
landscaping needs to consist of one third deciduous trees and two thirds
evergreen trees. A detail for the buffer fence also needs to be provided.

Comment 34. On sheet 36 under the plan schedule, the winged Cuonymous needs to be
changed to a deciduous tree. The Japanese Yew needs to be a minimum
of 36 inches at time of planting.
Response: The Winged Euonynious previously located in categoiy "B" zoning
district buffer has been replaced with a combination of Serviceberiy
and Redbud trees per buffer i•equireinents. The Japanese Yew
located in the Interior Parking Lot landscape area has been replaced
with Cheriy Laurel, min. 36". Japanese Yew located in the Perimeter
Parking Lot landscape areas have been replaced with Blue Holly,
Winged Eponymous and Inlcbei•iy Holly respectively.
Comment 35. It appears that the deciduous trees could be more spread out on the site,
see sheet 35 for locations. Also, sheet 36 states that there are 209 trees but
sheet 35 shows 211.
Response: Deciduous tree locations and spacing have been revised . Overall tree
and slimb counts have been revised as well.

We have completed our review of the subject site plan and offer the following comments:
1. Refer to Sheet 1, provide the responsible land disturber (RLD) signature block. Although
an RLD may not have been determined at this time, the signature block will be required
for completion by the RLD upon Issuance of the land disturbance permit.
2. The site plan indicates that the extension of Maranto Manor Drive to Rainville Road as
existing; however, this portion of the road has not been constructed. The culverts and
retention pond associated with the Maranto Manor Drive extension shall be completed
prior to completion of the subject project. In accordance with the proffer statement, the
Maranto Manor Drive extension shall be completed prior to issuance of an occupancy
permit for the proposed building.
Refer to sheet 8, Phases of Land Disturbance, include "Schedule an onsite pre -
construction meeting with the designated E&S inspector prior to initiating any site work"
as the first point.
4. Refer to Sheet 9, Sediment Basin 1 Calculations, in accordance with Frederick County's
erosion and sediment control ordinance (Section 79-3.A.1), the outfall system shall be
designed to maintain the structural integrity of the basin during a 100-year storm of
twenty-four hour duration. Revise the basin calculations to comply with these standards.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staff's comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Cove►•sheet. On the coversheet under the site data, provide the PIN for this site.
2) Owner. The property owner is listed as Wrights Run, LP, but County records show that this property
is owned by Wal-Mart.
3) General Notes. On the coversheet, provide the following notes: (1) All outdoor lighting must be
shielded to prevent glare onto adjoining properties and road right-of-ways, and (2) All utilities must
be underground.
4) Building Size. On sheet 2, the building is shown to be 169,244sf and sheet 5A shows the building at
150,200sf; clarify what the actual building size is.
5) Required Parkin. On the coversheet under required parking, utilize the County's retail calculation
for parking spaces (1 /200so.
6) Building Height. On sheet 2, provide the actual building height.
7) Proffer Compliance Narrative. On sheet 2, the proffer compliance narrative needs to correspond to
the applicable rezoning application. Please note that both rezoning 902-97 and 902-07 apply to this
site. Also, it is unclear how compliance is being achieved for the road improvements when the
narrative states that they will be bonded with other site plans. All improvements need to be
completed/bonded with this development.
8) Maranto Manor Drive. The proffer narrative states that this road is by others. The extension of
Maranto Manor Drive needs to be completed before this site can open.
9) Adjoining Properties. All adjoining properties need to be shown on sheet 5.
10) Curb and Gutter. Curb and gutter (CG-6) needs to be provided around all parking spaces; provide
curb and gutter as indicated on sheets 10-13. Also, the typical curb and gutter detail note needs to
reference a page in the site plan.

11) Parking Space Size. Parking spaces need to be a minimum of 180sf; the spaces shown in the plan
don't comply Nvith this requirement.
12) Landscaped Islands. Landscaped islands are required at the ends of all parking bays and striped
islands are not permitted. Islands need to be providcd as indicated on sheets 10-13.
13) Directional Arrows. Directional arrows need to be provided throughout the parking area of the
development.
14) Paving Legend. On sheet 5A, the standard paving should be shaded so that it does not blend in with
the landscaped areas.
15) Building Restriction Line. it is unclear why a 50 foot BRL is shown along the adjacent property to
the east as indicated on sheet 5A.
16) Siana6e. There are notes throughout the site plan regarding pylon signs. Per § 165-30 of the
Frederick County Zoning Ordinance, only monument signs are permitted. The proposed location and
size of any fi•eestanding signage needs to be provided on the site plan.
17) Tasker Road. The road improvements for Tasker Road in this area need to be shown on this site
plan.
Tasker Road Entrance. It is unclear why the entrance on "Masker Road is shown as being for truck
traffic as it appears that truck traffic can easily be restricted to Maranto Manor Drive. If permitted by
VDOT, this entrance should accommodate vehicular traffic accessing the site. This entrance should
also be moved west to provide access to the remaining commercial acreage that has not been
developed yet.

Dear Sir:
In the May 21, 2008 edition of the Winchester Star it was reported that Wal Mart is
indeed opening a third store in the Winchester, Virginia area. This new store is to be
located at the intersection of Route 522 and Tasker Road in what appears to be a mature
growth of trees. I was encouraged to read from the article that you intend to protect
mature trees and appear to be building a more environmentally friendly store. If so, I
encourage you to protect as many of the mature trees on your property as possible so that
the existing wildlife can survive even in the midst of a new store. Your protection of the
mature trees has the added benefit of reducing the heating and cooling load on your store,
and will provide a more pleasant shopping experience for your customers as well.
I can think of no better publicity for your firm, and your new store, than a demonstration
of your commitment to the environment while maintaining your growth and
development. However, I can think of no worse publicity than citizens and residents'
picketing the proposed site of your new store as the mature woods are clear cut and the
wildlife killed all for the sake of a new Wal-Mart store. I am hopeful, based on the
newspaper article, that you will want to take the former rather than the latter approach
and work to save the environment and wildlife at your new store site.
Please do not respond that you are only a tenant of the project and that you do not have
control over the proposed site. As the major tenant you have a lot of pull as to what is
constructed in this area. In addition, please also do not reply that you only intend to meet
local codes and regulations. They are insufficient to produce the product that is required
and do not provide the ingenuity needed to make an environmentally friendly Wal Mart a
reality.
