SITE PLAN APPLICATION CHECKLIST
The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review
agencies are relevant to their site plan application. A list of potentially relevant

We have revised the site plan based on the comments received and dated June 8, 2004 and offer the
following responses to those comments:
Comments from Frederick County Department of Planning and Development
Comment 1: Special Limited Power of Attorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should be notarized
and completed to grant the applicant (you) with the authorization to represent them for this site plan.
Please also note that the owner is required to sign the final copies of the site plan prior to approval.
Response: Owner has filled out and signed the Power of Attorney form as required along with the final
cx)pies of the site plan for County approval.
Comment 2: Entrance Signs. Please note that the details for the proposed entrance sign have the arrow
pointing in the wrong direction
Response: We have made revision on the sign direction accordingly.
Comment 3: Future Business .Sign. Please show the location of any proposed or future business sign. A
sign permit is required to be issued through the Department of Building Inspections prior to the installation
of any sign.
Response: A business sign for this development will be included with the existing business sign at the
main entrance. Location has been added to the plans. Comment acknowledged that a sign permit is
required.
Comment 4: Landscape Area. Please note that the proposed landscaped area must be topsoiled and seeded
in addition to the planting of the proposed trees and shrubs. The total number of required trees for the
proposed impervious area (I tree per 2000 s. f. of impervious area = perimeter landscaping) and number of
parking spaces (I tree per 10 parking spaces = interior landscaping) is two (2). Although it is not required
for approval, staff encourages that the existing gravel/grassed area north of the kiosk be landscaped as
well.

Conunent S:Electrical Connection. Please demonstrate how electric will be connected to the proposed
kiosk.
Response: A 220 electrical feed from the existing electrical hookup at the existing electric sign will
provide the electrical service for the proposed kiosk. The developer has coordinated with the electrical
company for the supply and connections.
Continent 6: Directional Arrows. Please provide direction arrows to direct the traffic through the
proposed drive-thru lane.
Response: A directional arrow has been added to the plan.
Comment 7: Surface !Material. Please note that the drive-thru lane and parking area ntust be paved with
asphalt or bituminous concrete.
Response: The drive-thru lane and parking area has subsequently been paved with asphalt after the
previous plan submission.
Comment 8: Trash Receptacles. Please show any proposed outdoor trash receptacles.
Response: An outdoor trashcan has been added.
Comnwnt 9: Outdoor Sit-down area. Based on the submitted plan there will be no outdoor sitting area.
Please show such an area if this area is proposed or planned for the future.
Response: A bench has been added for the employees.
Comment 10: Review Agency Comments. Please provide me with copies of all review agency comments.
Review agency comments are required from the Building Inspections, Fire Marshal, and Public Works
prior to approval of the site plan.
Response: We have attached the Fire Marshal approval letter. There is no water or sanitary line proposed
for this project. Employees will use the facility at the Winchester Motor Sports. Building Inspection and
Public Works review comments will be provided.

Dear Ms. Snapp:
Staff is in receipt of the site plan for the above -referenced project, accepted on May 25, 2004. At
this time, the site plan is denied until the following comments are adequately addressed.
Preliminary Review Comments:
1. Special Limited Power of Attorney Form. Please have the property owner sign the
attached Special Limited Power of Attorney Form prior to further review or approval. This
form should be notarized and completed to grant the applicant (you) with authorization to
represent them for this site plan. Please also note that the owner is required to sign the final
copies of the site plan prior to approval.
2. Entrance Sign. Please note that the details for the proposed entrance sign have the arrow
pointing in the wrong direction.
3. Future Business Sign. Please show the location of any proposed or future business sign.
A sign permit is required to be issued through the Department of Building Inspections prior
to the installation of any sign.
4. Landscaped Area. Please note that the proposed landscaped area must be topsoiled and
seeded in addition to the planting of the proposed trees and shrubs. The total number of
required trees for the proposed impervious area (1 tree per 2000 s.f. of impervious area =
perimeter landscaping) and number of parking spaces (1 tree per 10 parking spaces = interior
landscaping) is two (2). Although it is not required for approval, staff encourages that the
existing gravel/grassed area north of the kiosk be landscaped as well.

5. Electric Connection. Please demonstrate how electric will be connected to the proposed
kiosk.
6. Directional Arrows. Please provide direction arrows to direct traffic through the proposed
drive-thru lane.
7. Surface Material. Please note that the drive-tln•u lane and parking area must be paved with
asphalt or bituminous concrete.
8. Trash Receptacles. Please show any proposed outdoor trash receptacles.
9. Outdoor Sit-down Area. Based on the submitted plan there will be no outdoor sitting area.
Please show such an area if this area is proposed or planned for the future.
10. Review Agency Comments. Please provide me with copies of all review agency comments.
Review agency continents are required from Building Inspeclions, Fire Alarshal, and Public
NVorks prior to approval of the site plan.
Once you have adequately addressed all of these comments, please resubmit a copy for my review.

Lease Agreement
This LEASE AGREEMENT, made the 17th day of May, 2004, between
Dr Raymond Fish, (LESSOR) and SamCon, LLC (LESSEE).
WITNESSETH That in consideration of the mutual covenants and agreements to
be kept and performed on the part of said parties hereto, respectively as to herein state,
the said party of the first part does hereby covenant and agree that it shall.
• The Lessor shall provide the Lessee parking lot space on said discussed area located
' - at The Kingdom H& Complex, 117 Hopewell Road, Clearbrook, Virginia to place

ft' house. Location to be on the North side of the Highway
sign post located in what is now the teardrop in the parking lot.
• The Lessee covenants agrees that it shall:
1. Provide rent in the amount of Two Hundred and Fifty dollars ($250.00) due and
payable to the Leaser on the I" day of each month starting when the coffee house is
set and the Zoning Department of Frederick County has agreed to its placement.
2. This Lease shall be subject to review and revision at the end of each twelve (12)
month period of time. This Lease may be terminated by either party on giving
ninety days (90) written notice to the other party prior to the anniversary date of
this contract. At the end of the lease term herein provided, the LESSEE shall have
an option to renew this Lease Agreement.
3. Lessee shall be responsible for all trash and snow removal in said area of coffee
house.
4. Electric and Water Supply will be the responsible of the Lessee.
5. Lessee agrees to keep the coffee house clean and to maintain its business in a
professional manner.
6. The Lessee shall place surface mounted concrete car blocks for protection of the
coffee house.

personal representatives. Time is of the essence on all undertakings. This
agreement shall be enforced under the laws of the State of Virginia. This is the
