The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on July 13, 2004. This site plan is approved for the construction of a 6,163 square foot
restaurant at the corner of Route 839 and Route 11 South, in the Back Creek Magisterial District. All
requirements for development of a restaurant within the B2 Zoning District have been satisfied in the
approved site plan. Furthermore, all relevant review agencies have approved the project at this time.
I am providing you with five (5) copies of the approved site plan. Please forward these copies to the property
owner and/or other appropriate persons. Please inform the property owner that a copy should be kept for
future reference, and an approved copy must be kept on the construction site throughout the development
process. Once site development is complete, the owner should contact this office to schedule an on -site
inspection. Feel free to contact me should you have any questions or concerns.

We have received your revised site plan dated June, 2004 for the referenced project. It appears all of our
earlier review comments have been satisfactorily addressed. Please advise the owner of our approval.
Also please provide six (6) sets of approved construction plans with signed seal for VDOT
distribution.
Due to the magnitude of improvements on VDOT facilities, it appears a preconstruction conference
should be held by the engineer/developer with the attendance of the contractor, various County agencies,
and VDOT prior to initiation of work.
The appropriate land use permit may now be applied for to cover work within the Routes 11/839 right-
of-way. The permit is issued by this office and will require a minimum processing fee, surety bond
coverage, and the salary & expenses of a State assigned Inspector.
Once satisfactory application has been made, a permit will normally take approximately thirty days to
process and issue. Should you have any questions, do not hesitate to call.

As per our conversations about this location, I am sending you this to look over. If I understood
this correctly then the following would work out.
You said we base off of exit #310 which is 805' mean sea level
According to the topo map we have the rear left elevation is 743'
Which gives us a difference of 62', plus the original height of 35' for this sign would allow us
97'. We are asking for one at 80' in height with the supporting photos included. I have also
included a very basic drawing of the sign to give you an idea of what we are proposing for this
location.

Staff is in receipt of the site plan for the above -referenced project, accepted on April 20, 2004. At this
time, the site plan is denied until the following comments are adequately addressed.
Review Comments:
1) Aisle Widtli. The parking aisle closest to Route 839 is only 20' wide. Please increase the aisle
width to a minimum of 22', as required by the Frederick County Zoning Ordinance for 90 degree
parking spaces. Changing the parking space dimensions closest to Route 839 from 9' x 20' to 10'
x 18' would allow for the 2' needed without significant changes.
2) Speed Limit For Valley Pike. Please provide the posted or unposted speed limit for the portion
of Valley Pike (Route 11 N) which fronts the subject property.
3) Historical Markers. Pedestrian access to the historical markers along the front of the property
appears to be appropriate. Please consider adding a small sidewalk for such purpose.
4) Maintenance of Landscaping Note. The maintenance of landscaping note on page 4 of 7
appears to be the standard continent used for the City of Winchester. Please remove the portion
of the statement after the first sentence (All landscaped area shall be maintained in good condition
by owner).

5) Magisterial District. The proposed restaurant is located in the Back Creek Magisterial District,
not the Opequon District. Please correct as necessary on the title page and on each individual page
of the site plan.
6) Existing Off -Premise Business Sign. Please note that the existing off -premise business sign for
Route 37 Self -Storage shall be removed from the property. A conditional use permit is needed
to keep the existing sign on the property or to erect a new off premise business sign on the
property.
7) Adjoining Meat Vendor to South. A sidewalk or trail linking the subject property and the
property to the south is recommended "if' regular deliveries will be made between parcels.
Once you have adequately addressed all of these comments, please resubmit a copy for my review. I will
need all approved review agency comment sheets and at least five copies of the final plan for approval.
Comment sheets are required frorn the following agencies: The Frecerick County Department of
Building Inspections, The Frederick County Fire Marshal, The Frederick County Engineer, The
Frederick County Sanitation Authority, The Frecerick County Health Department, The Frederick
