PETITION FOR AMENDMENT OF THE FREDERICK COUNTY ZONING ORDINANCE
TO: Board of Supervisors of Frederick County, Virginia
and Frederick County Planning Commission
RE: Amendment of the Frederick County Zoning Ordinance
from R-1 to M-2 to permit an addition to an existing
truck terminal
Your Petitioner, J & P Properties, Inc., respectfully
represents unto the Frederick County Board of Supervisors and
its Planning Commission the following:
1. That it is the owner of 31.625 Acres of land in
Shawnee Magisterial District, Frederick County, Virginia, fronti
on the East side of U. S. Highway No. 522 and approximately
one-half mile South of U. S. Highway No. 50 as more particularl
described by plat attached hereto as Exhibit A.
2. That said property was purchased on March 29, 1966,
by Deed duly recorded in the Clerk's Office of the Circuit Court
of Fredericx County, Virginia, in Deed Book 321, page 167, for
its intended use as a truck terminal.
3. That shortly after its purchase a truck terminal
was constructed on said land and is presently being used as such.
4. That your Petitioner believes and so alleges that
at the time of the purchase of said real estate and the con-
-truction of said truck terminal the Frederick County Zoning
Ordinance had not been adopted and was not adopted until March,
1967. Your Petitioner believes that at the time of adoption of
the Zoning Ordinance said parcel would be classified as a non-
conforming use within the intent of such Zoning Ordinance.
5. That the Board of Supervisors did in March of 1967
adopt a bning Ordinance placing your Petitioner's land in that
certain district designated a3 71 which is contrary to its then
existing use.

That the use of said parcel as a truck terminal and
service center is not permitted in R-1 district but would be
a permissable use in a M-2 district.
That your Petitioner desires to add to this truck
terminal certain warehouse facilities more particularly
described by Exhibit B attached hereto.
WHEREFORE, your Petitioner requests that the Frederick
County Zoning Ordinance be amended change the classification of
his said 31.625 Acres as follows:
Southern portion - 15.446 Acres from R-1 to M-2.
Northern portion - 16.179 Acres from R-1 to B-2.
Said Northern and Southern portions are more particularly
set forth on plat attached hereto and as a part hereof.
