BRANT, ET UX * EXHIBIT C TO DEED E. E. BAYLISS, JR., ET UX THIS DEED, made this 8th day of October, 1957, between Hillar M. Brant and Frances C. Brant, his wife, of the first part, hereinafter called the Grantors; E. E. Bayliss, Jr. and Mary L. Bayliss, his wife, of the second part, hereinafter called the Grantees; J. Frederick Larrick, Trustee, of the third part, hereinafter called the Trustee, and Shenandoah Valley National Bank of Winchester, at Winchester, Virginia, of the fourth part, hereinafter called the Beneficiary. Fred Stine, et al, dated October 19, 1945 and recorded in the Clerk's Office of the . Circuit Court of Frederick County, Virginia in Deed Book 194, at page 240. This conveyance is made subject to the rights of way affect the aforesaid realty and to the following restrictive covenants, which are con- stituted covenants real running with the land: 1. The property hereby conveyed, and all buildings erected thereon, shall not be used otherwise than as a private dwelling for one family, and such building shall not be used for a boarding house, apartment house, tenem house or for any business, except for the purpose of operating a "tourist home." 2. Before the lot hereby conveyed may be used for residential purposes, a septic tank for sewerage disposal shall be constructed thereon and maintained, such tank to meet the Virginia State requirements. 3. No dwelling shall be erected upon this lot unless the cost cr- 0 thereof shall be more than $5,000.00. 4. No building shall be erected and located on this lot within 75 feet of the property line along the highway (U. S. Route 11). 5. No livestock, except poultry for home use, and domestic pet such as dogs and cats, may be kept on the lot. 6. No more than one dwelling house shall be erected on this to . 7. NOW, THEREFORE, THIS DEED FURTHER WITNESSETH: That for and in consideration of the premises and the sum of One Dollar ($1.00), cash in hand paid by the Grantors to the Trustee and Beneficiary, the Trustee does grant and convey unto the Grantees, as tenants by the entirety, in fee simple, with survivorship as at common law, all his right, title and interest in and to the aforesaid realty. First, this is not an extension of the City Limits, this is a rezoning action on land lying north of the City Limits lying in Frederick County, Virginia, The land in question was sub- divided and is known as the Hunter M. Stine Estate lots of which the Winchester Outdoor Advertising Corporation is on record as owning Lot #1. The major portion of owners of residences lying on these lots have requested the rezoning classification of this land he changed from its existing classifications (Industrial M-2 on the west side of Route 11 and Business B-2 on the east side of Foute 11) to Residential R-1. t�dvertising signs are not a permitted use under the Residential R-1 classification under the current 'Zoning Ordinance. The letter to you was required by the Code of Virginia as notification to adjoining property owners prior to conducting a Public Hearing regarding the rezoning request. As you are presently using the land for advertising the rezoning Should not affect your usage.
