Attached is a petition for the rezoning of a tract of
land lying and being situate on the South side of U. S.
Highway #522, and bounded on the North by the property
of Unger and Darlington and on the South by the property
of Miller and Glaize and the remaining land of C. D.
Hylton, which has previously been rezoned to commercial.
There is a plat attached to the petition showing in
red boundary the land which is requested to be rezoned
from A2 to B2.

Comes now Cecil D. Hylton, t/a C. D. Hylton
Enterprises, by his attorney and agent, and petitions for the
rezoning of a tract of land lying and being situate on the South
side of U. S. Route No. 522 in Gainesboro Magisterial District of
Frederick County, Virginia, containing approximately 29.26 acres,
being the remaining portion of a tract or parcel of land con-
veyed to Cecil D. Hylton by deed from Robert G. Buckley, et ux,
dated August 24, 1964, and recorded in the Clerk's Office of the
Circuit Court of Frederick County, Virginia, in Deed Book 302,
Page 445. The boundary line survey of said tract is attached
hereto and asked to be m part hereof.

approved the rezoning of the said ten acres from Residential to
Business 2 for the development of a shopping center, and the
rezoning of the remaining portion of approximately 29.26 acres
to R2 or Residential multi -family units.
In the opinion of your Petitioner, it is now more
desirable that the remaining 29.26 acres be rezoned from
Residential to Business 2 for the purpose of creating a shopping)
center on the entire tract of land, the larger acreage allowing

and more attractive to prospective tenants.
The 29.26 acres is adjoined on the North by U.
Route No. 522, on the West by the aforesaid ten acres zoned B2
and an old roadway, on the South by Miller which is now probably
owned by Glaize, and on the East by the Darlington Subdivision
and the property of Unger.
That the Planning Commission of Frederick County,
Virginia, at its meeting held on the day of 219712
approved the previous request for this rezoning.
matter has been returned because of incorrect description as to
the Magisterial District.
That it would be advantageous to all parties con-
cerned if the public hearings of the Planning Commission and the
Board of Supervisors were held jointly as provided by Section 15
1-431 of the Code of Virginia as amended in 1968, and since this
involves more than 25 acres of land no notice need be sent by
registered or certified mail to the last known address to the
owners, agents or occupants of abutting property and property
immediately across the street or across the road immediately
affected.
That this petition for rezoning is consistent with
the principals of land use in Frederick County, Virginia, and
will assist in the orderly development and growth of the area
and will be for the benefit of the safety, convenience and
welfare of the community.

P E T I T I O N
Comes now C. D. Hylton, by his attorney, and petitions
for the rezoning of a tract of land lying and being situate on
the South side of Route 522 in Stonewall Magisterial District,
Frederick County, Virginia, containing approximately 22 acres,
bounded on the East by Unger and Darlington Subdivision, on the
South by Miller, and on the West by Claize and remaining parcel
of land of C. D. Hylton previously zoned commercial.
It is proposed that this land will be used as a shopping
center. The land is presumed to be presently zoned as agricultural 2
and the request is for business general or B2.
Your petitioner is willing to contribute to the Frederick
County Sanitation Authority or other proper agency its connection
fees in advance of construction in order to aid the early develop-
ment of water and sewer to serve the property.

the ;Board of Supervisors Room, County Office Building, on July 12,
1971, at 3:00 P.M., to consider the petition of C. D. Hylton,
t/a C. D. Hylton Enterprises, for the rezoning of a tract of land
lying and being situated on the South side of U. S. Highway 1622
in Gainesboro District, Frederick County, Virginia, containing
approxiriately 29.26 acres bounded on the East by Unger and the
Darlington Subdivision, on the South by Miller, and on the West
by a lane and other land of C. D. Hylton previously zoned Business 2.
The petition, requests a rezoning brow; Residential 2 to
Business 2 of the aforesaid 29.26 acres. Al copy of said petition

topographic map of the land of Cecil D. Hylton, but
I still have not received a copy of his petition or
application for rezoning. The hearing on his application
has already been advertised before the Frederick County
Planning Commission. I therefore respectfully request
that I be provided with a copy of the petition for
rezoning in this particular case.
