PLANNING COMMISSION By Secretary ACTION OF THE BOARD OF SUPERVISORS On the Governing Body took the following action on the attached petition for rezoning: MASSIE AND SNARR ATTORNEYS AT LAW WINCHESTER, VIRGINIA PETITION FOR REZONING TO: Board of Supervisors of Frederick County, Virginia and Frederick County Planning Commission Petitioners, Paul B. Brice and Jewel H. Brice, respect- fully, petition the Board of Supervisors of Frederick County, and the Frederick County Planning Commission to amend and re -zone the present zoning boundaries established with respect to a parcel of land hereinafter -described which is owned by the petitioners. In support of their petition, they set forth the following facts and circumstances: 1. They are the owners of a parcel of land containing 1.82 acres, located at Kernstown, and principally in Back Creek Magisterial District, Frederick County, Virginia, fronting on the West side of U. S. Highway No. 11, and contiguous on the North with the southern boundary line of the City limits of Winchester, Virginia. Attached hereto and made a part hereof by reference is a plat and survey of said parcel as prepared by Richard U. Goode, C. L. S., dated February 17, 1964. This property is improved by a brick dwelling house erected about 1800, a garage and swimming pool. A small portion of this land lying on the northwestern corner is physically within the boundaries of the City of Winchester. 2. This parcel of land is located in a B-2 zoning district as established by the governing body of Frederick County and lies at the extreme northern limits of this zoning district MASSIE AND SNARR ATTORNEYS AT LAW WINCHESTER. VIRGINIA where it joins the boundary limits of the City of Winchester. 3. Since the petitioners acquired their property in 1964, various changes have occurred in and near the vicinity of it. Among these are: the completion of U. S. Interstate Highway No. 81 to the East of their property; the rapid development of new industry in the Winchester Industrial Park to the East; annexation by the City of Winchester of territory contiguous on the North boundary of the petitioners' property, including a small portion thereof on the Northwest corner lying North and West of Hoge Run; and the development along and near Route No. 11 at Kernstown of residential and commercial enterprises. 4. The present character of neighborhood properties fronting on Route No. 11 at Kernstown is substantially residentia and the petitioners believe that their land and the lands in the vicinity are best suited for residential purposes. Taking into consideration the foregoing facts and cir- cumstances, the petitioners believe that effect upon the safety, health and general welfare of the community here concerned would be promoted by re -zoning the land owned by them from B-2 Business General to R-2 Residential General; and they respectfully petitio the Board of Supervisors of Frederick County and the Frederick County Planning Commission to consider this petition for rezoning of the petitioners' land herein described for that purpose.
