PETITION FOR AMENDMENT
OF THE
FREDERICK COUNTY ZONING ORDINANCE
To: Board of Supervisors of Frederick County, Virginia
and the Frederick County Planning Commission
Re: Amendment of the Frederick County Zoning Ordinance
on U. S., Route 11 from Agricultural District to
Industrial General (M-2) District.
Your Petitioner, Western Union Realty Corporation, respect-
fully represents unto the Frederick County Board of Supervisors
and the Frederick County Planning Commission the following:
1. That it is the contract,vendee of that certain tract
of land lying and being situated on the easterly side of U. S.
'Route 11 in the Opequon Magisterial District of the County of

,Frederick, State of Virginia, more particularly described by that
(certain plat and survey dated April 27, 1971, prepared by McNair,
(Simmons and Cline, consulting engineers, hereto attached and
marked Exhibit A, and a property description hereto attached and
;marked Exhibit B.
2. That the said property will be conveyed to the petition-
lers by a deed from Monte Vista Associates, in accordance with an
lagreement of sale and purchase between the petitioners and Monte
(Vista Associates.
3. The said property was conveyed to Monte Vista Associates
by a deed from Edwin B. Orndorff and Maxine F. Orndorff, his wife,
jdated July 14, 1970, of record in the Clerk's office of the
Circuit Court of Frederick County, Virginia, in Deed Book 366
jat Page 445.
4. The Petitioners desire to construct office buildings,
research and development structures, and industrial structures

in conformity with the provisions of Industrial General Zoning
District.
S. This reclassification of zoning will allow the petition-
ers to construct a facility for the Western Union Telegraph
Company known as a central telephone bureau, a higher and better
economic use of the property. The tract of approximately 29 acres
is bounded on the north by an already developed industrial park.
It is bounded on the west by U. S. Route 11 and on the east by
Interstate Route 81. The land across its highways is presently
jvacant land. The tract is bounded on the south by the lands of
�B. E. McDaniel and Bly. The proposed use of the tract will in no
way adversely affect the property values in the area and should
in fact increase the property values.
6. Also attached hereto is a vicinity map indicating the
locale of the land as to which the zoning change is requested.
WHEREFORE, your Petitioner requests that the Frederick
County zoning ordinance be amended to change the classification of
the aforesaid property from Agricultural Tract to Industrial
General (M-2) Tract.

BEGIN' NG at an iron pin in the eastern line of U. S. Route 11, said
iron being corner Lo B. E. McDaniel: thence, with the said eastern
line of U. S. Route 11 N 55 degrees 30' 18" E three hundred fifty-
three and 54/100 (353.54) feet to a concrete monument: thence,
continuing N 54 degrees 54' 54" E one thousand four hundred fifty-one
and .7/100 (1,451.17)feet to a point in the eastern line of a twenty
(20) foot water main easement of the City of Winchester, Virginia:

Dear Mr. Alderman:
This refers to our personal meeting with you at
your office on Thursday, June 3, 1971, when we discussed
the procedure to be followed to rezone the land near Middle-
town, Virginia, upon which we plan to construct a central
telephone bureau.
We are herewith enclosing 3 copies each of an appli-
cation for rezoning, petition for zoning change, plat of
property, vicinity map (two different types) and our check
for $80.00 to cover the filing fee.
We believe this package includes all the required
information, but if anything is missing, we will provide it
immediately upon request.
We had planned to break ground for the telephone
bureau early to mid -July, 1971 and we are most desirous of
meeting this schedule as nearly as is humanly possible. We
fully realize that a certain amount of time will be required
to clear us on zoning but if this can be expedited in any
way, we will greatly appreciate it. The new facility should
bring approximately 350 jobs into the area and we feel sure
you will be as anxious as we are to move this project along.

Would you please associate this with our letter
to you dated June 9, 1971, in connection with our petition to
rezone certain land near Middletown, Virginia.
Since the schedule for the construction of our
central telephone bureau is a tight one, we would greatly appre-
ciate knowing when and if you have an indication that said zoning
will be approved and whether you feel we would be safe in commen-
cing grading, trenching for underground utilities and excavating
for foundations in early or mid -July, pending final approval of
zoning which you felt would be received approximately August 15,
1971.
A delay in work of one month may prevent us from
getting our building under roof prior to the severe winter weather,
and this could result in a rather severe overall slippage in our
proj ect .
We realize you cannot do the impossible, but any
assistance and/or information you can give us at this time would
be sincerely appreciated.

Dear Mr. Snider:
In answer to your letter of June 24, 1971, I would like to
advise you that the Frederick County Planning Commission will
hear the Western Union petition for rezoning at 4 P.M., July 7,
19710 in the Board Room of the Erederick County Office Building.
On behalf of the Board of Supervisors I would like to again
stress our keen interest and desire to assist Western Union
in any way possible? As stated in my conversation with you
earlier the Board does not feel that at this time it could
grant a joint hearing, thus enabling to expedite the rezoning
petition.
I discussed the problem of your construction schedule with the
Board on Monday and at that time it was indicated that the Board
will consider giving you an unofficial ruling depending upon the
outcome and recommendations of the Planning Commission. If the
Board is able to do this, you should have an answer by July 9th.
I hope that this will help you in some way and we are looking
forward to working with you on an even greater expansion of
facilities.
