AREA CODE 703 667-1096 May 6, 1971 P E T I T I O N To: The Frederick County Board of Supervisors and The Frederick County Planning Commission Gentlemen: The Stonewall Development Company has an option to purchase 46.6 acres lying and being situate on the East side of and adjoining U. S. Highway #11 and North of and adjoining Virginia Secondary Route #668 and West of and adjoining the right of way of the Baltimore & Ohio Rail- road being the property of Roy R. Boyce. Stonewall Development Company intends to purchase this property for the development of an industrial park. On the day of ,19_, the Board of Supervisors of Frederick County, Virginia, rezoned this area for this property for industrial general or M2 from the said rail- road track Westwardly to within 400 feet of the U. S. Highway #11. At the time of said rezoning, the purchaser was going to build a fruit processing plant near the railroad tracks and Virginia Secondary Route #668. Your Petitioner alleges that the reservation of the 400 feet from Route 11 Eestwardly for A2 or agricultural purposes or residential purposes is inconsistent with proper zoning. That it would not be to the best interest of the property owners to build dwelling houses and reside next to an indus- trial park; that it is to the best interest of the citizens of Frederick County that the entire tract of land be zoned M2; CMG'-2- that your Petitioner has obtained one purchaser who plans to purchase approximately 14-15 acres at the Northern end of the property and to construct thereon a plant costing in excess of $600,000, and that this business will attract other industries, and that the entire tract of land is necessary for proper development as an industrial park. We, therefore, petition for the rezoning of the area 400 feet in width on the Eastern side of U. S. Highway #11 and extending Northwardly from Virginia Secondary Route #668 to the Northern property line from its present zoning to M2 for the aforesaid purposes. S. Highway No.11 and extending Northwardly from Virginia Secondary Route No.668, to the Northern property line of the lands of Roy R. Boyce now under option to Stonewall Development Company from Agricultural or residential to Industrial 2 in order to conform With the remaining portion of said tract of land wlrich was recently zoned to Industrial 2 known as M2. Copies of thell petition and plat attached are on file with the Executive Secr6tary of the Board of Supervisors of Frederick County, Virginia, in his office on Court House Square, Winchester, Virginia.
