That he and his two sisters, Evelyn Heath Stickley and Virgin.. S. %step, are the owners of certain hereinafter described proper 6y in Opequon Magisterial District, Frederick County, Virginia, and that he, by virtue of a certain power of attorney dated the day of December, 1970, is empowered to act on behalf of the said Evelyn Heath Stickic:y and Virginia S. Estep. 2. That your petitioner and his sisters have heretofore develops_ some residential building lots which are described and set forth on a piat of the Plymn Owen Estates of record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, in Deed Book 362, page 647. 3. That all of the lots lying on Harman Street as shown on said i plat are presently zoned R-1 and were originally planned for single i i detached residences. 4. That at the cul-de-sac at the eastern end of Harman Street E Ili I are five lots, Nos. 13, 14, 15, 16 and 17, which because of their sL:e an:. II II properties, cannot be used to best advantage for single detached dwelling:, and they are not suitable for the same type of improvements which ,v ill placed upon the other lots fronting on Harman Street. 5. That the said lots, because of their location and because they may be used as a whole, are peculiarly suitable and adaptable to garden -type apartments, and your petitioner is advised and belie 0S7 that if they be zoned for such purposes he can readily sell them, thus enhancing the value of the other lots. 6. That a proper description of the land herein sought to be re- zoned would be "all that land at the eastern end of Harman Street lying east of the eastern boundaries of Lots No. 12 and 18 and bounded on the north by the lands of the Frederick County School Board, on the east by f Williams, on the south by Bowman and Virginia State Highway Departme I..t. 7. That the only lots in said Subdivision which have heretofore been sold have been to William L. Ramey and Elizabeth N. Ramey, who have, as evidenced by their signatures hereto affixed, consented to the said lots being re -zoned. Wherefore, your petitioner respectfully requests that the herein - above described land comprised of five lots, Nos. 13, 14, 15, 16 and 17, be zoned to permit the erection of multi -family dwellings as set forth in the zoning category of R-2. j Robert K.
