RE: Rezoning petition of Schenck Foods Company, Incorporated
Dear Joe:
I enclose herewith a Petition and attachments for rezoning by
Schenck Foods Company, Incorporated of approximately 32,683.2
square feet of land located just South of Winchester on the
East side of Road No. 644 in Shawnee District of Frederick
County, Virginia from R-2 to M-1.
Please proceed to hold a public hearing on this petition
by the Frederick County Planning Commission after properly
advertising the same for two weeks in the Winchester
Evening Star. After the Planning Commission meeting, I
request that you advise me as to the recommendations of the
Planning Commission with a copy of your letter going to
George B. Whitacre, Clerk.

PETITION
The undersigned petitioners respectfully represent unto the Board as
follows:
(1) That your petitioners are the owners of two contiguous parcels
of land lying on the corner of Glaize Avenue and Route 644 (Paper Mill Road).
(2) That these parcels are and for some time have been used i.n
connection with Schenck Foods Company, Incorporated's business. There is
a commercial structure upon the back of the two lots presently containing
an automotive repair shop with the front of the two lots used as an office.
(3) That both of these parcels are designated R-2 (Residential) by
the ordinance, although Glaize Avenue represents a single residential
street surrounded by M-2 or M-1 usage, the entire area South of Glaize
Avenue designated M-2 presently.
(4) That the zoning change requested will merely bring the designated
uses to the usage actually in the area and will not prejudice the rights of
other property owners or materially deprecaite the value of surrounding
properties.
(5) It is respectfully requested that the parcels designated as shown
on the attached plat be changed from R-2 to M-1 as provided in Article 14 of
the Zoning Ordinance, and that this Petition be processed as prescribed in
14-1-3 to the Planning Commission for due report and action as provided in
the ordinance.

TO THE BOARD OF SUPERVISORS, FREDERICK COUNTY COURTHOUSE,
WINCHESTER, VIRGINIA, 22601
The undersigned petitioners respectfully represent unto the Board as
follows:
(1) That your petitioners are the owners of three contiguous parcels
of land lying between Commerce Street and Glaize Avenue abutting Virginia
Route 644 (Paper Mill Road).
(2) That these parcels are and for some time have been used in
connection with Schenck Foods Company, Incorporated's business. The parcel
on the corner of Commerce Street and Paper Mill Road contains a warehouse,
and the two parcels on the corner of Glaize Avenue and Paper Mill Road
contain a building used as an office.
(3) That these parcels are all designated R-2 (Residential) by the
ordinance, although surrounded by M-2 or M-1 usage, the entire area south
of Glaize Avenue designated M-2 presently.
(4) That the zoning change requested will merely bring the designated
uses to the usage actually in the area and will not prejudice the rights of other
property owners or materially depreciate the value of surrounding properties.

THIS DEED made and dated this LC%n. day of October, 1964, by
and between Pearl S. Whittaker, widow, party of the first pi.rt, hereinafter
referred to as Grantor; Schenck Foods Company, Incorporated, party of
the second part, hereinafter referred to as Grantee; and Gle in L. Whittaker
and Leona W. Whittaker, his wife, and Sandra J. Baker and Eugene Baker,
her husband, parties of the third part.
I WITNESSETH: That for and in consideration o:: the sum of Ten
Dollars ($10), and other valuable consideration, receipt of which is hereby
acknowledged, the Grantor does hereby grant and convey, w _th general
warranty of title unto the Grantee all those two adjoining parcels of land,
together with all improvements thereon and appurtenances thereunto
belonging, in Shawnee District, Frederick County, Virginia: about one mile

land, running with the east fence line of said Road South 12 West 150 feet
to a stake corner; thence with the north property line of Gla ze Avenue
South 68 1/3 East 50 feet to a stake corner to Parcel Two herein; thence at
l ight angles with Glaize Avenue North 22 3 /4 East 148 feet t ) a point in
Sc enck Foods' line; thence with Schenck Foods' line North '8 1/4 West
