HomeMy WebLinkAbout036-70 Fredericktowne Company - BackfileBEFORE THE BOARD OF SUPERVISORS OF FREDERICK COUNTY, VIRGINIA: Petition of Fredericktowne Company The undersigned, Fredericktowne Company, a Virginia Corporation hereby respectfully petitions the Board of Supervisors of Frederick County, Virginia, and the Planning Commission of Frederick County, Virginia, for rezoning that certain tract of land, lying and being situate a short distance South of Virginia Secondary Route 277 about one mile East of Stephens City, Virginia, in Opequon Magisterial District, Frederick County, Virginia, containing 31.5 acres, more or less. A plat showing the locations of said property is attached hereto as Exhibit A, and prayed to be read as a part hereof. The present status of said tract is that it is presently zoned Agricultural, General District A 2 under the provisions of the Frederick County Zoning Ordinance. Your Petition respectfully requests that said tract be rezoned Residential, General District R 2 in order to permit the construction of single family dwellings on lots having an area of at least 10, 000 square feet. It is the intent of your Petitioner to use this area only for single family dwellings, with duplex dwellings being permitted only if erected on parcels containing a minimum of two lots having an area of 10, 000 square feet each. Your Petitioner, Fredericktowne Company, has been advised, and so avers, that certain property owned by Harry L. Fake and Mary Etta Fake, of record in the Office of the Clerk of the Circuit Court of Frederick County, Virginia, .in Deed Book 317 at page 569 and lying North of and II: contiguous to the aforesaid parcel containing 31.5 acres, more or less, is presently zoned Business, General District B 2. Said property contains 2.1 acres, more or less, has a frontage on Virginia Secondary Route 277 of approximately 300 feet, an eastern boundary approximately 402 feet in length, a rear boundary approximately 304 feet in length, and a western boundary approximately 306 feet in length. Said tract or parcel of land is identified as "Fake Land" on a plat which is attached hereto as Exhibit A and prayed to be read as a part hereof. Should the Board of Supervisors of Frederick County, Virginia, and the Planning Commission of Frederick County, Virginia conclude that said property is not presently zoned Business, General District B-2, your Petitioner respectfully requests that said tract be rezoned Business, General District B-2 to permit commercial construction in accordance with the provisions of the Frederick County, Virginia, Zoning Ordinance. Stickley, Executor of the :Estate of Mary Evelyn Stickley, Deceased, and Harry L. Fake and Mary Etta Fake, do hereby advise the Board of Supervisors of Frederick Bounty, Virginia, and the Planning Commission of Frederick County, Virginia, that the previous Petition of Fredericktowne Company for the rezoning of that certain tract of land, lying and being situate a short distance South of Virginia Secondary Route 277 in Opequon Magisterial District, containing 31.5 acres, more or less, from A-2 to R-2, and the rezoning of that certain tract containing 2. 1 acres, more or less, fronting on Virginia Secondary Route 277, from present use of B-2 to zoned B-2 was made with our full knowledge and consent, and that Fredericktowne Company did, in fact, act for us as Petitioners in filing such Petition, and that at all times although we were the legal title holders to these premises, Fredericktowne Company has been and is the equitable title holder, with an exercised option for the purchase thereof. The purpose of this notice of having joined in the previous Petition is to clarify any uncertainty presently existing under the laws of the State of Virginia regarding the status of property owners who may petition for rezon- ing change.
