Boyce and Pearl V. Boyce, subject to contract of sale in favor of Robert E. Kelsoe PETITION FOR AMENDMENT OF ZONING ORDINANCE To the Honorable Supervisors of Frederick County, Virginia: Your Petitioners, Roy R. Boyce and Pearl V. Boyce, his wife, and Robert E. Kelsoe, respectfully state: 1. Petitioners, Roy R.Boyce and Pearl V. Boyce, are owners of a certain tract of land containing 31.6 Acres, designated Tract A on the plat and survey of Charles H. Kirkland, Certified Land Surveyor, dated June 23, 1969, attached hereto and incorporated herein by this reference. 2. Petitioner, Roy R. Boyce has agreed to sell said 31.6 Acre tract, together with the adjacent 15.00 Acre tract as shown on said plat, to Robert E. Kelsoe by contract dated April 1, 1969. 3. Petitioners believe the subject 31.6 Acre tract is zoned Agricultural, Limited, District A-2 under the existing Frederick County Zoning Ordinance. 4. Petitioners believe that it would be in the best interests of the citizens of Frederick County and in keeping with good and sound zoning practice if the zoning on said 31.6 Acre tract were changed to Industrial, Limited, District M-1 (Petition having heretofore been filed for similar zoning change on the adjacent 15.00 Acre tract and this being Phase Two of said overall plan); sound zoning practice would require the orderly development of an industrial area in this neighborhood where no such zoning district exists. 5. Petitioners are advised and believe that there may be good reason for retaining the 400-foot strip adjacent to Route 11 as Agricultural, Limited, District A-2, and your petitioners would have no objection thereto. WHEREFORE, your Petitioners pray the Frederick County Zoning Ordinance be amended to rezone the subject 31.6 Acre tract from Agricultural, Limited, District A-2 to Industrial, Limited, Listrict M-l.
