ALLEN, HELEN C. ALLEN, ANNIE L. KLINE AND SAFEWAY STORES, INC. Petitioners petition the Board of Supervisors of Frederick County, Virginia for an amendment of the Zoning Ordinance of Frederick County, Virginia and set forth the fol- lowing in support thereof: 1. They are the owners of an area approximately 170 feet wide on the south side of the Cedar Creek Grade Route 622 immediately west of Area B-2 and about 400 feet west of U. S. Route 11, extending between parallel lines about 260 feet to the south, and presently under contracts of sale to Safeway Stores, Incorporated which proposes to build a retail food supermarket and parking area on this property as well as on a tract of about two acres immediately east of this area, already zoned for that purpose, presently owned by Petitioners Allen and Choucleris but covered under one of said contracts of sale. 2. A plat and description of the total property involved of 2.9764 acres presently in both Zones B-2 and R-1 is attached hereto as Exhibit "A" and by reference made a part hereof. 3. Most of the 2.9764 acre tract is believed to be within Zone B-2 and may be improved for use as a retail food store (7-1-1) but the additional area covered by this petition is also required to be used for the same purposes to provide the required area for such a retail food supermarket. 4. The rapid commercial development of the adjoining area has rendered the subject property unsuitable and undesirable for any practical use authorized for Zone R-1 but desirable and marketable for uses permitted by Zone B-2, including a retail food store. S. Public necessity, convenience, general welfare and good zoning practice require an ordinance amending the zoning ordinance changing the district boundaries and amending the classification of the subject property so as to include it in Zone B-2, and a copy of the proposed amendment is attached as Exhibit "B" WHEREFORE, Petitioners pray that: (1) All three copies of this Petition and supporting documents be filed by the Clerk. (2) The matter be referred to the Planning Commission for its recommendation and report after the proper advertisement of its public hearing thereon. (3) The Planning Commission hold its hearing and render its report and recommendation on the proposed changes. (4) Upon receipt of the said report and recommendation, or after thirty days from said referral to the Planning Commis - Sion, this Board give the proper public notices of its public hearing thereon. Three copies of a Petition (Section 15.1-492(g) signed by the property owner (ibid) addressed to the Board of Supervisors (ibid) shall be filed with the Clerk of the Board (the Clerk of the Circuit Court of Frederick County) together with three copies of a plat and survey of the property proposed to be rezoned, and a deposit of $ to cover the costs of advertisement (with appropriate refund billing to Petitioner upon completion of its advertisment). 2. The Clerk shall forthwith refer two copies of all such Petitions and exhibits to the Chairman and Attorney of the Planning Commission for its Recommendations, (Section 15.1-493) and Report (14-1-2) . 3. Choucleris, Millard G. Allen, Helen C. Allen, Annie L. Kline and Safeway Stores, Inc. and the Frederick County Board of Supervisors has found that public necessity, convenience, general welfare and good zoning practice required the hereinafter set forth rezoning amendment, NOW THEREFORE BE IT UNANIMOUSLY RESOLVED that the boundary of Zone R-1 be changed from the line 400 feet west of U. S. Route 11 and south of Route 622 to 570 feet west of U. S. Route lland north of Route 622 570 feet, thence south 570 feet from Route 622, parallel to U. S. Route 11 and thence east 170 feet, parallel to the south side of Route 622, to a point 400 feet west of U. S. Route 11 and thence south with the former boundaries that the area beginning 400 feet west of U. S. An Ordinance Amending the Zoning Ordinance So As to Change The District Boundary of Areas R-1 and B-2 Immediately South of: Route 622 (Cedar Creek Grade) Whereas, after clue reference, publications and public hearings held as provided by law, the Frederick County Planning Commis- sion has recommended and reported favorably upon the petition for rezoning of Nannie 0. Choucleris, Millard G. Allen, Helen C. Allen, Annie L. Kline and Safeway Stores, Inc. and the Frederick County Board of Super- visors has found that public necessity, convenience, general walfare and good zoning practice required the hereinafter set forth rezoning amendment. NOW THEREFORE 13E IT UNANIMOUSLY RESOLVED that the boundary of Zones R-1 and B-2 be changed from the present boundary line which is four hundred feet west of U. S. Route 11 and running south from Route 622, four hundred feet from U. S. Route 11, to a new line beginning at a point five hundred seventy (570) feet west of U. S. Route 11. on the south side of Route 622 and running south on a line 570 feet west of U. S. Route 11 for a distance of 260 feet and thence east on a line 260 feet south of Route 622 for a distance of 170 feet, to a point 400 feet west of U. S. Route 11, thence north on a line 400 feet west of Route 11 for a distance of 260 feet to a point on the south side of Route 622 and thence west along the south side thereof 1.70 feet to the point of beginning so that the area described above be henceforth included in zone B-2. 611 -77 --- An Ordinance Amending the Zoning Ordinance So As To Change The District Boundary Of Area R -2 Immediately South of Route 622 (Cedar Creek Grade) And West of Area B-2 Whereas, after due reference, publications and public hearings held as provided by law, the Frederick County Planning Commission has recommended and reported favorably upon the petition for rezoning of Nannie O. Choucleris, Millard G. Allen, Helen C. Allen, Annie L. Kline and Safeway Stores, Inc. and the Frederick County Board of Supervisors has found that public necessity, convenience, general welfare and good zoning practice required the hereinafter set forth rezoning amendment, NOW THEREFORE BE IT UNANIMOUSLY RESOLVED that the boundary of Zone R -1 be changed from the line 400 feet west of U. S. Route 11 and South of Route 622 570 feet, thence south 570 feet from Route 622, parallel to U. S. Route 11 and thence east 170 feet, parallel. to the south side of Route 622, to a point of 400 feet west of U. S. Route 11 and thence North with the former boundaries so that the area beginning 400 feet west of U. S. Route 11 and south of State Route 622 (Cedar Creek Grade) and extending west along the south side of Route 622 for a distance of 176 feet and south, therefrom between parallel lines, a distance of 400 feet be included henceforth in area B-2.
