Shenandoah Pools, Inc. would appreciate it if you
would put on your agenda for the April 5, 1973 meeting the matter
of the B. M. K. Subdivision. As yob yt!rr may not recall, this
subdivision was approved by the Board of Supervisors on July 14,
1969. However, through inadvertence the plat was not recorded.
I have talked to Mr. Redgy King of the Virginia State
Highway Department and Mr. King informs me that the Highway
Department will accept maintenance on the road if the Frederick
County Board accepts the dedication.

VIRGINIA AND THE FREDERICK COUNTY PLANNING
COMMISSION
Shenandoah Pools, Inc., a Virginia Corporation, hereby petitions
the Frederick County Board of Supervisors and the Frederick County Planning
Commission to rezone the area shown gridded on the attached map marked
Exhibit 1.
1. This parcel of land is located on the South side of U. S. Route
50, 1 1/2 miles West of the City of Winchester, Virginia at the intersection
of Route 50 and Highway No. 37, the Western By -Pass of Winchester, Virginia.'
2. The above parcel consists of 16.3 acres, more or less, and is
a portion of a larger tract of land conveyed to Shenandoah Pools, Inc. by deed
dated June 30, 1959 from Mary Katherine Butler and Clarence L. Butler, her
husband, which deed is of record in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia in Deed Book 258 at Page 207.
3. That the land is presently zoned R-l.
4. That the Department of State Highways, having condemned
adjacent land for the Route 37 By -Pass, has rendered the subject land unfit for
residential development by virtue of the fact that the land is subjected to an
extreme flooding problem and, in addition, the new Route 37 will create an
embankment of 17 feet in height along part of petitioner's adjoining land making
residential development extremely doubtful.
WHEREFORE, your petitioner prays, pursuant to Atricle 14, that
the Zoning Ordinance of Frederick County, Virginia be amended, and that the
subject land be rezoned from R-1 to General Business, B-2.

The Board of Supervisors of Frederick County, Virginia, will hold
a public hearing on February 10, 1969 at 3:00 p. m. , at the County Office
Building, Winchester, Virginia upon the petition of Shenandoah Pools, Inc.
recommended to it by the Frederick County Planning Commission. The
recommendation of the Frederick County Planning Commission is that the
Board of Supervisors of Frederick County, Virginia grant the .requested
petition to rezone that certain tract of land, containing 16.3 acres, fronting
on the South side of U. S. Route 50 West and on the East side of proposed
Highway No. 37, from R-1. to B-2 for the construction of a restaurant, motel,
and service station.
A copy of the petition and a plat of the property to be rezoned may
be found in the Office of the Clerk of the Circuit Court of Frederick County,
Virginia, Winchester., Virginia.
